History: On January 22, 1996, the Planning Commission approvecl a conditional use permit for take-out
service for World Wrapps restaurant at 1318 Burlingame Avenue (see attached letter dated February 6,
1996). One of the conditions of approval states that the project shall be built as shown on the plans
submitted at that time. World Wrapps now intends to remodel the restaurant and expand the seating
area. This requires an amendment to the conditional use permit.
Summary: The applicant, Niccolo Valerio, is requesting an amendment to a conditional use permit for
take-out service to allow expansion of the seating area in an existing 1529 SF restaurant at 1318
Burlingame Avenue, zoned C-1, Subarea A. The existing seating area consists of 322 SF of floor area
with 8 tables and 28 chairs at the front of the restaurant. The applicant proposes to remodel the
restaurant space to increase the seating area to 434 SF with 12 tables and seating for 42 people.
The food establishment will be open daily from 11:00 a.m. to 10:00 p.m. This is a change from the
original permit where the hours of operation were 8:00 a. m. to 10:00 p. m. , seven days a week. There
will be 6 employees on site from 11:00 a. m. to 5:00 p. m. , and 4 employees on site after 5:00 p. m. It
is expected that 195 customers will come to the site before 5:00 p.m. on weekdays, and 105 customers
will come to the site after 5:00 p. m. on weekdays. On weekends, it is expected that 260 customers will
come to the site before 5:00 p. m. and 140 customers will come to the site after 5:00 p. m. There will
be a maximum of 49 customers and employees on site at any one time. The numbers of customers is
expected to increase slightly 5 years. No trucks or service vehicles are expected to park on the site for
this business, there will only be occasional deliveries which last 10 to 20 minutes.

This project meets all other zoning code requirements.
Staff Comments: The Chief Building Offcial, the Fire Marshal and the City Engineer had no
comments on the project. Planning staff would note that the information on number of customers and
employees has been refined since the original application in 1996. The applicant is showing a slight
increase in the number of customers on weekends and a decrease for weekdays. In 1996, the applicant
stated there would be a maximum of ten employees on site while in the current application, the
ma�cimum number of employees is six. The numbers in the current application appear to be based on
data from the current business operations at this site.
Study Meeting: At the February 22, 1999, Planning Commission study meeting, the commission asked
several questions regarding the proposal. The applicant has responded in the attached letter and diagram
date stamped March 2, 1999. The commission asked if the applicant plans to keep the two tables and
chairs at the front in the public right-of-way. The applicant states that they do plan to keep these two
tables and chairs, and notes that they have an encroachment permit for them. The commission asked
to see an overlay of the existing and proposed seating area so that they could see the change in the
coniiguration. The existing and proposed seating areas are outlined on the attached diagram date
stamped March 2, 1999.
The commission asked what the rationale is for the need to increase the seating area by 35 % and the
number of seats by 50%. The applicant notes that after conducting a customer survey, World Wrapps
has discovered that a large percentage of the existing customer base would prefer to consume their meals
on site but are prevented from doing so by the limited number of seats. The objective of the proposed
remodel project is to address these concerns by maximizing the potential for the number of seats and
by improving both the quality of the seating and the atmosphere of the interior of the restaurant. The
new design includes high-end cushioned chairs, booths and banquettes with upholstered backing as well
as other new design features. World Wrapps believes that the proposed new design will be more
compatible with the surrounding area since it is more upscale.
The commission asked how the applicant arrived at maximum number of people on site being 49, and
noted that the seating is increasing from 28 to 42, why are there so few additional customers. The
applicant notes that the maximum number of people was derived by adding up the total number of seats
(42) and the total number of employees (6) at one time. The average number of people using a table
for 4 at any one time is statistically 1.75. Therefore, the actual occupancy load was adjusted at 35±
people. The proposed occupancy load is similar to the current occupancy load, except with the current
layout there are more people standing.

Amendment to Conditional Use Permit for Take-out Service 1318 Burlingame Avenue
The commission notes that the owner and employees will park in metered parking, where will they park.
The applicant notes that the original approved conditional use permit stated that the maximum number
of employees at any one time is 10 people. The current application is requesting a maximum of six
employees at any one dme. Approximately 50% of the employees do not own cars and rely on foot or
public transportation to get to work. T'he remaining 50% that own cars are responsible for making their
own parking arrangements.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame
general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on
adjoining properties in the general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include iindings. The reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
Conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department and
date stamped February 1, 1999, Sheets A0.1, A2.1 and ID.1, with a business site of 1529 SF
and customer seating area of 434 SF;
2. that the applicant shall maintain daily, or more often if necessary, the trash receptacle(s) of the
streetscape design as approved by the City to be located inside the door, along Burlingame
Avenue at the front of the store, and/or at locations as required and approved by the City
Engineer and the Fire Department;
3. that the food establishment with take-out service may not be open for business except during the
hours of 11:00 A.M. to 10:00 P.M. daily, with no more than 6 employees on site at any one
time including the manager, and that the number of customers and employees on this site shall
never exceed iire department occupancy requirements;

4, that the applicant shall remove once a day, or more frequently if determined to be necessary by
the City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs, in the
gutter, and in planters, in front of the store along Burlingame Avenue, and within 50' on each
side of the store front, and shall arrange and pay for additional BFI pick up service to dispose
of trash in cans provided on site or on street if necessary as determined by the City Engineer;
and
5. that any improvements for the use shall meet all California Building and Fire Codes, 1995
Edition as amended by the City of Burlingame.

CP Monroe briefly presented the staff report and the commissioners asked: does the applicant
plan to keep the two tables and chairs at the front of the business in the public right-of-way; this
is an increase in 112 SF of seating area, could the applicant overlay the existing and proposed
plans so commission could see exactly what the change in the configuration of the uses on the
site are; what is the rational for the need to increase the seating area by 35 % and the number
of seats by 50%; how did they arrive at the maximum number of people on site being 49; notes
that owner and employees will park in metered parking, at what location; seems this proposal
would increase usage, increasing seating from 28 to 42, why so few additional customers with
more seating and good business, observation is that the place is often packed with people. There
were no further questions from the commissioners and the item was set for public hearing on
March 8, 1999, providing all the information is given to Planning staff in a timely manner.

CP Monroe briefly presented the staff report and the commissioners asked: would like to see
the palate of colors for the sign program; how will the "open" sign work, will it flash when the
store is open or change to closed when it is not; how will the projecting sign be lit, also how
will the clock be illuminated; could see this sign being reduced by 3 SF so it would not need an
exception for size; open neon tubing is inappropriate for this period of sign, explain why it is
needed; will the stripes of neon tubing on the site be removed along with the signage; why need
florescent lighting for the sign, why no use indirect lighting it is the more traditional way to light
such signs. There were no further comments and the item was set for public hearing on March
8, 1999, providing all the information is submitted to the Planning Department in time.

Response to Planning Commission Study Items from meeting of 2/22/99.
In regards to the comments that werc made by the Planning Commission on their meeting of
2/22/99 we would like to respond ae follows:
1) As indicated on the construction documents that were submitted to the bu�lding dept. for
permitting, World Wrapps plans to keep the two tables and chairs that are ]ocated outside
on the public right of way and for which they have che appropriate encroachment permit.
2) We have attached a diagram indicating the old customer area vs. the new, [Vote that the
customer area inerease was obtained by reducing the kitchen area not by increasing the
total square Eootage of the restaurant.
3) The rationale Eor increasing the seating area by 35"/o and the number of seats by t50"/� ie as
follows: After conducting a customer survey, World Wrapps ha9 diecovered that a large
percentege of their existing custamec base would prefer to consume their meals on site but
are prevented from doing so by the limited number of seats and the uncomfortable nature
of the seating layout. (i.e. Hard wood chairs, high counters, etc.). The objective of the
proposed remodel project is to address these concemv by maximizing the potential for the
number of seats and by improving both the quality of the seating and the general
atmosphere of the interior of the restaurant. The new design utcludes high end cushioned
chairs, booths and banquettes with upholstered backing, decorative suspended sofits and
pendant lights, slate and parquet flooring, ornarnental iron details, clear, blonde wood
veneer cabinets, a I�rge custom mural along the entire interior West wall and new
decorative graphics throughout. World Wrapps believes that the proposed new design will
be more compatible with the surrounding area since it is more upscale.
4) The maximum no. of people on site was calculated by adding up the total no. of seats (42)
and the total no. of employees (6) at one time. The average no. oF people using a table of 4
at any one time is statistically 1.75. Therefore the actual occupancy load was adlu9ted at t35

5) The origin�l CUP was approved with a stated maximum no. of employees at any one time
of 10. The current maximum no. of employees is actually only 6. Therefore World Wrapps is
operating with less employees than previous(y approved anc� does not intend to increase
the numbcr of employees after the remodel. Approximately 50% of World Wrapps
employees do not own cars and rely on foot or public transportation to get to work. The 50"/�
that owns cars is responsible for making their own parking arrangements.
Additional comments:
1) Last year sales ehowed a 30`%a decreaBe Erom the first year of operation, The objcctive of thi�
remodel is to recuperate the lost clientele by addressit�g customers concerns. In addition tc�
the request for additional and more comfortable seating, World Wrapps customers have
complained about waiting too (ong for thei� food. The second objective of the remodel is to
improve the kitchen performance and expedite productivity by decreasing the distance
employees have to move from one station to the other. World Wrapps is trying to achieve
the same productivity with less employees but at the same time have the cuetomers wait
less time for the food.
2) In general World Wrapps believes that the quality of their food is not well represented by
the current decor of their stores which gives rnore the impression of a fast food than a fast
casual sit down restaurant.

1) Answer to question no. l of City of Burlingame Conditional Use Permit Application:
We do not believe that the proposed improvement will have a detrimental or injurious impact
to property or improvements in the vicinity or to public health, safety, general welfare or
convenienee. World Wrapps already has an approved CUP to allow take-out at this location.
After conducting a customer survey throughout their 30 or so locations, World Wrapps has
discovered that a large percentage of their existing customer base would prefer to consume their
meals on site but are prevented from doing so by the limited number of seats and the
uncomfortable nature of the seating layout. (i.e. Hard wood chairs, high counters, etc.). The
objective of the proposed remodel project is to address these concerns by maximizing the

World Wrapps is not proposing a change of use. The existing as well as the proposed use is a
commercial and pedestrian friendly activity and therefore it is in conformance with the
Burlingame General Plan and Zoning Ordinance for this site. The existing restaurant has an
approved CUP to allow take-out. As mentioned above the proposed improvements are aimed at
luring World Wrapps customers to eat on the premises and therefore add to the livelyhood as
well as the quality of the pedestrian activity along Burlingame Avenue.
3) Answer to question no. 3 of City of Burlingame Conditional Use Permit Application:
Since the proposed project is for�the interior remodel of an existing restaurant it will not have
any impact on the aesthetics, mass, bulk and character of the existing and potential uses on
adjoining properties in the general vicinity.

Dear Mr. Blair,
Since there was no appeal to or suspension by the City Council, the January 22, 1996 Planning
Commission approval of your special permit application became effective February 6, 1996.
This application was to allow take-out for a restaurant at 1318 Burlingame Avenue, zoned C-1,
Subarea A.
The January 22, 1996 minutes of the Planning Commission state your application was approverl
with the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped December l, 1995, Sheet 1, General Floor Plan;
2. that the conditions of the City Engineer's memo dated December 4, 1995 shall be met and

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15301, existing facilities, Class 1(a), interior or exterior alterations involving

1529 SF and customer seating area of 434 SF;
2. that the applicant shall maintain daily, or more often if necessary, the trash receptacle(s) of
the streetscape design as approved by the City to be located inside the door, along
Burlingame Avenue at the front of the store, and/or at locations as required and approved
by the City Engineer and the Fire Department;
3. that the food establishment with take-out service may not be open for business except during
the hours of 11:00 A.M. to 10:00 P.M. daily, with no more than 6 employees on site at any
one time including the manager, and that the number of customers and employees on this

History: On January 22, 1996, the Planning Commission approved a conditional use permit for take-out
service for World Wrapps restaurant at 1318 Burlingame Avenue (see attached letter dated February 6,
1996). One of the conditions of approval states that the project sha11 be built as shown on the plans
submitted at that time. World Wrapps now intends to remodel the restaurant and expand the seating
area. This requires an amendment to the conditional use permit.
Summary: The applicant, Niccolo Valerio, is requesting an amendment to a conditional use permit for
take-out service to allow expansion of the seating area in an existing 1529 SF restaurant at 1318
Burlingame Avenue, zoned C-1, Subarea A. The existing seating area consists of 322 SF of floor area
with 8 tables and 28 chairs at the front of the restaurant. The applicant proposes to remodel the
restaurant space to increase the seating area to 434 SF with 12 tables and seating for 42 people.
The food establishment will be open daily from 11:00 a.m. to 10:00 p.m. There will be 6 employees
on site from 11:00 a. m. to 5:00 p. m. , and 4 employees on site after 5:00 p. m. It is expected that 195
customers will come to the site before 5:00 p.m. on weekdays, and 105 customers will come to the site
after 5:00 p.m. on weekdays. On weekends, it is expected that 260 customers will come to the site
before 5:00 p. m. and 140 customers will come to the site after 5:00 p. m. There will be a maximum
of 49 customers and employees on site at any one time. The numbers of customers is expected to
increase slightly 5 years. No trucks or service vehicles aze expected to park on the site for this business,
there will only be occasional deliveries which last 10 to 20 minutes.

Staff Comments: The Chief Building Official, the Fire Marshal and the City Engineer had no
comments on the project. Planning staff would note that the information on number of customers and
employees has been refined since the original application in 1996. The applicant is showing a slight
increase in the number of customers on weekends and a decrease for weekdays. In 1996, the applicant
stated there would be a maximum of ten employees on site while in the current application, the
maximum number of employees is six. The numbers in the current application appear to be based on
data from the cunent business operations at this site.
