Previous Use: Vincenzo's Restaurant, Italian Food, sit down food establishment Pro�osed Use: World Wrapps, International Food, sit down and take-out food establishment Allowable Use: Restaurants and Retail Shopping and Service, take-out service requires a special permit. Summary: The applicant, Matt Blair, is representing a food establishment (World Wrapp's) already in business at 1318 Burlingame Avenue. World Wrapp's specializes in international food wrapped in a variety of flavored tortillas and juice drinks. The applicant is requesting a permit to allow them to sell these items to their customers, to go. The percentage of take-out business is determined by demand. Take-out food service requires a special permit in the C-1 subarea A zoning district. World Wrapps is open 8:00 a. m. to 10:00 p. m. , seven days a week and has customer seating for 32 people. The maximum number of customers expected to be on site at any one time is 60, with a maximum number of employees of on site at any one time of 6. Parking is not required for first floor retail uses including food establishments in Subarea A of the C-1 zoning district. There is no parking on site. The restaurant operators aze suggesting to their employees to park in the long term (10 hour) parking areas. The applicant states in his letter dated December 1, 1995 that most of the employees working at the Burlingame site do not drive. Parking is available along Burlingame Avenue and the side streets and in the public parking lots. Meets all other zoning code requirements. 1318 BDRLINGAME AVS ALLOWED/REQ'D food estab.& take out with special permit * Staff Comments: The City Engineer notes in his December 4, 1995 memo that at least one trash container needs to be placed in front of the store and that the sidewalk and gutter shall be kept clean of refuse within 50'-0" of the store front. The Chief Building Official and the Fire Marshal had no comments. Required Findings for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and shall include findings. The reasons for any action should be clearly stated. At the public hearing the following condition should be considered: Conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped December 1, 1995, Sheet 1, General Floor Plan; 2. that the conditions of the City Engineers' memo dated December 4, 1995 shall be met and that the applicant shall purchase and maintain daily, or more often if necessary, a trash receptacle or receptacles of a type approved by the City, at the door along Burlingame Avenue and/or at locations approved by the City Engineer and Fire Department; 3. that World Wrapp's shall be open 8:00 A.M. to 10:00 P.M. Blair (Owner) Property Owner: Philip King Previous Use: Restaurant Proposed Use: Sit In and Carry Out Quick Service Restaurant We will do everything in our power, here at World Wrapps, to make sure the approval of a take out permit will only mean a better City of Burlingame. We will place a trash can outside the store and maintain a clean and garbage free store front. We will instruct all of our employees to pick up any trash whenever they enter or leave the restaurant, simultaneously a formal sidewalk clean up will be required at least 3 times a day. All of our garbage cans will be cleaned inside our store in the back dish washing area, where we have the facilities for a thorough cleaning. If the sale of smoothie "To Go" are a concern, as far a spillage out on the street, let me reassure you that all "To Go" smoothies must be served with a lid. All of our employees understand this and it has not been a problem at all at our Chestnut Street location. Our hours of operation will be Monday-Sunday 8:00 A.M.- 11:00 P.M. We will have seating well under the capacity of the previous restaurant for about 32 customers. Summary: The applicant, Matt Blair, is representing a food establishment (World Wrapp's) already in business at 1318 Burlingame Avenue. World Wrapp's specializes in international food wrapped in a variety of flavored tortillas and juice drinks. The applicant is requesting a permit to allow them to sell these items to their customers, to go. The percentage of take-out business is determined by demand. Take-out food service requires a special permit in the C-1 subarea A zoning district. World Wrapps is open 8:00 a.m. to 10:00 p.m., seven days a week and has customer seating for 32 people. The maximum number of customers expected to be on site at any one time is 60, with a maximum number of employees of on site at any one time of 6. Parking is not required for first floor retail uses including food establishments in Subarea A of the C-1 zoning district. There is no parking on site. The restaurant operators are suggesting to their employees to park in the long term (10 hour) parking areas. The applicant states in his letter dated December 1, 1995 that most of the employees working at the Burlingame site do not drive. Parking is available along Burlingame Avenue and the side streets and in the public parking lots. The Chief Building Official and the Fire Marshal had no comments. Required Findings for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and shall include findings. The reasons for any action should be clearly stated. At the public hearing the following condition should be considered: Conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped December 1, 1995, Sheet 1, General Floor Plan; 2. that the conditions of the City Engineers' memo dated December 4, 1995 shall be met and that the applicant shall purchase and maintain daily, or more often if necessary, a trash receptacle or receptacles of a type approved by the City, at the door along Burlingame Avenue and/or at locations approved by the City Engineer and Fire Department; 3. that World Wrapp's shall be open 8:00 A.M. to 10:00 P.M. We will place a trash can outside the store and maintain a clean and garbage free store front. We will instruct all of our employees to pick up any trash whenever thcy enter or leave the restaurant, simultaneously a formal sidewalk clean up will be required at least 3 times a day. All of our garbage cans will be cleaned inside our store in the back dish washing area, where we have the facilities for a thorough cleaning. If the sale of smoothie "To Go" are a concern, as far a spillage out on the street, let me reassure you that all "To Go" smoothies must be served with a lid. All of our employees understand this and it has not been a problem at all at our Chestnut Street location. Our hours of operation will be Monday-Sunday 8:00 A.M.- 11:00 P.M. We will have seating well under the capacity of the previous restaurant for about 32 customers. Thank you MARGARET MONROE CITY PLANNER FRIDAY, DECEMBER 29, 1995 RESOLUTION NO RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT FOR TAKE-OUT FOOD RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for take-out food at _ 1318 Burlin�ame Avenue APN• 026-152-200 ; property owner• Kine Family Irrevocable Trust 320 Pinehill Road Hillsborou�h ; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on _January 8, 1996 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DET'ERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption per Article 19. Monday through Sunday with a maximum of 6 employees an site including the manager at any one time; 4. that the applicant shall remove once a day or more frequently if determined to be necessary by the city engineer, all take-out debris on the sidewalk, in the gutter, and in the planters, in the front of the store along Burlingame Avenue and within 50'-0" of the store front, and shall arrange and pay for additional BFI pick up service if necessary as determined by the City Engineer; and 5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
