Summary: The applicant, William A. Ryan, is requesting a determination for freeway orientation and
if not determined to be a freeway oriented sign a sign exception for size and height in order to place
a double faced 220 SF sign extending 9'-2" from the sixth floor wall facing the freeway at 851
Burlway Road, zoned O-M.
The determination is required for freeway orientation (CS 22.36.010). The sign code prohibits a"...
sign ... designed to be primarily viewed from a main traveled roadway of a freeway" . This sign will
be placed so high and at such an orientation on the building so that it will be clearly visible for
considerable distances from the freeway (see pictures view from north and south) but possibly hard
to see from a car at grade. If the commission determines this to be a freeway oriented sign, it is
prohibited and no further action on the application is necessary.
If the sign is determined not to be "primarily viewed" from the freeway then the commission should
consider the sign exceptions requested. The first is an exception for size, 110 SF per face, total 220
SF where the code allows 75 SF on a secondary frontage. The second in an exception for height of
65' (sixth floor level on this structure) where the code allows no signage above the third floor (0 SF
allowed, 220 SF requested).
The proposed sign will be the logo for Atlas Asia - Pacific's own line of oil product called Top Oil.
Atlas Asia - Pacific is a tenant in the 851 Burlway Rd. building. The 9' X 12' product logo will be
red and yellow with interior lighting. The business name is not included on the logo. The landlord
has promised Atlas Asia - Pacific exclusive rights to exterior signage on the building if they will stay
on the premise. They note that the proposed signage is a part of an established logo that cannot be
varied under trademark requirements.

Staff Comments: The Senior Building Inspector states in his September 9, 1994 memo that there
needs to be anchors on the sign that can withstand 80 m.p.h. winds. The City Engineer and the Fire
Mazshal had no comments.
Study Meeting: At the October 11, 1994 Planning Commission Meeting the Planning Commissioners
had several questions (see P.C. Minutes October 11, 1994). There are no proposed flashing or
moving lights. The proposed sign is a cabinet sign with interior lights that shine through the faces.
The Outdoor Advertising Act which regulates product advertising within 660' of the edge of the
freeway, exempts signs advertising a building or a tenant in the building. The secondary face of this
building is approximately 350' from the edge of the free way paving.
Atlas Asia - Pacific responded to the Planning Commissions questions in their letter dated October
14, 1994, stating that the company wants the sign as proposed because it identifies the 851 Burlway
Road as the world wide headquarters for the Top Oil Products company. Atlas Asia - Pacific states
that having a sign at any other location would not represent the direct correlation between the building
and the Top Oil line of products.
Atlas Asia - Pacific is the manufacturers representative for U. S produced automotive products for sale
in the Asia-Pacific region. Atlas Asia - Pacific served as manufacturers representative and marketer
for many popular lubricants, however, once these products became house hold names in the United
States the manufacturers took back the marketing and representation of their own products. Atlas Asia
- Pacific is now interested in promoting their exclusive line of oil products, Top Oil. Because Top

Oil has been very successful in the last ten years the applicants feel that it is necessary to put the Top
Oil logo on the 851 Burlway building to underscore their presence in Burlingame for their world wide
visitors and to slowly introduce the logo into the U.S. market.
The most recent wall sign approved was for the DHL Corporation at 700 Airport Boulevard. The
approved sign was a 74 SF wall sign placed at a height of 50'-0" (60 SF allowed at 36'-0" above
grade) which is equivalent to the pazapet of the building. The DHL Corporation is a tenant in the
building and at present time occupies about 30% of the building area.
See photos for existing signs which face the freeway. All pictures were taken by staff, traveling
North bound on the freeway and/or Gilbreth Road. It should be noted that all the roof signs in the
pictures predate our cunent (1978) sign code requirements. Also, there are no projecting signs
currently facing the freeway. The Hammer slag roof sign (which projected from the face of the
building) was removed within the past year after the company left the premise.
Required Findings for Sign Exception: In order to grant a Sign Exception relating to height, area,
location or number of signs the Planning Commission must apply the following circumstances (Code
Section 25.06.110 a-b):
(a) any exception granted shall be subject to such conditions as will assure that the adjustment
thereby authorized shall not constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and the district in which the subject property
is situate; and
(b) because of special circumstances applicable to the subject property, including size, shape,
topography, street frontage, location or surrounding land use; the size or height of the building
on which the sign is to be located; the classification of the street or highway on which the sign
is located or designed primarily to be viewed from, the strict application of zoning regulations
is found to deprive subject property of the privileges enjoyed by other properties in the vicinity
and under identical zone classification.
Planning Commission Action:
The Planning Commission should hold a public hearing. Action should include findings made for the
determination and the special permit requested. Reasons for any action should be clearly stated for
the record. At the public hearing the following conditions should be considered:
1. that the sign shall be installed as shown on the plans submitted to the Planning Department and
date stamped September 8, 1994, Sheets 1,2,3&4;
2. that should Atlas Asia - Pacifc cease to be a tenant in this building they shall remove this sign
within 15 days of terminating tenancy;

3. that the conditions of the Senior Building Inspectors memo dated September 9, 1994 shall be
met;
4. that maintenance of this sign in good repair shall be the responsibility of the tenant and any
change to the face or text of this sign shall require amendment if this sign permit including a
public hearing; and
5. that the installation of the sign shall meet all of the requirements of the Uniform Building and
Uniform Fire Code requirements as amended by the City.

To whom it may concern:
The following are our responses to questions 3, 4 and 5 listed in
your sign exception form.
ITEM 3) Aesthetically, the best possible sign placement on the
building is at the proposed location shown on the plans
submitted. By placing the sign elsewhere, the harmonious balance
of the architecture would be compromised.
ATLAS ASIA-PACIFIC (AAP) has been located in the building
for over 12 years. We have approximately 500 international
visitors per year. The building has no identification.
The building has experienced serious financial problems over
the years due to the softening of the commercial real estate
market in the area. The ownership of the building has been
transferred three times since we have been here. As a result,
the condition of the building is not up to the standards we would
like.
We were in the process of evaluating alternate locations.
As an enticement to stay our new landlord agreed to allow us to
have a lease that allows AAP as the only company in the building
to have signage rights.
We are certain that a sign of the quality we propose will
enhance the image of the building (as well as the area) and
attract additional tenants to the building.
ITEM 4) ATLAS ASIA-PACIFIC is an Export Marketing Corp. that
specializes in the export of US-made lubricants, automotive and
industrial parts to all parts of the world. ATLAS ASIA-PACIFIC
received the enclosed commendation from the Mayor of Burlingame
Within the lubricants product line is our private brand TOP OIL
PRODUCTS. It is this logo that we are endeavoring to feature on
this building.

Summary: The applicant, William A. Ryan, is requesting a
determination for freeway orientation and sign exception for size
and height in order to place a double faced 220 SF sign extending
9'-2" form the sixth floor wall facing the freeway at 851 Burlway
Road, zoned O-M.
The determination is required for freeway orientation (CS 22. 36.
O10). The sign code prohibits a"... sign ... designed to be
primarily viewed from a main traveled roadway of a freeway". This
sign will be placed so high and at such an orientation on the
building so that it will be clearly visible for considerable
distances from the freeway (see pictures view from north and south)
but possibly hard to see from a car at grade. If the commission
determines this to be a freeway oriented sign, it is prohibited and
no further action on the application is necessary.
If the sign is determined not to be "primarily viewed" from the
freeway then the commission should consider the sign exceptions
requested. The first is an exception for size, 110 SF per face,
total 220 SF where the code allows 75 SF on a secondary frontage.
The second in an exception for height of 65' (sixth floor level on
this structure) where the code allows no signage above the third
floor (0 SF allowed, 220 SF requested).
The proposed sign will be a corporate logo for ATLAS ASIA PACIFIC,
a tenant in the building. The logo will be red and yellow with
interior lighting. The landlord has promised ATLAS ASIA PACIFIC
exclusive rights to exterior signage on the building if they will
stay on the premise. They note that the proposed signage is a part
of an established logo that cannot be varied under trademark
requirements.

Staff Comments: The Senior Building Inspector state in his
September 9, 1994 memo that there needs to be anchors on the sign
that can withstand 80 m.p.h. winds. The City Engineer and the Fire
Marshal had no comments.
