HomeMy WebLinkAbout980 David Road - Staff ReportP.C. 1/28/80 Item No. 2 MEP�10 T0: PLANN I P1G COMMI SS I ON FROM: CITY PLANNER SUBJECT: SPECIAL PERMIT TO OPERATE A SANDWICH DELI IN.THE M-1 DISTRICT AT 1530 ROLLINS ROAD On March 26, 1979 the Planning Commission reviewed a reques t to operate a sandwich deli at 1530 Rollins Road fo r Mr. Constantine Tsavalas (see attached minutes). The deli was approved by unanimous vote with five conditions, the first of which was that the permit be non-transferable. Mr. Tsavalas has recently decided to sell this deli and, consistent with the above condition, a new special permit application has been filed by Ted David Ajl'uni to allow him to take over this existing business. In his December 16, 1979 letter of application he states that he will not make any changes in the operation of the deli. Hours of operation, number of seats and type of inenu will be the same as approved in 1979. No complaints abcut the existing sandwich deli have b�en received by the City*. A number of firms and employees in the environs have expressed satisfaction about its convenient location and the superiority of its fdod t� the sandwiches sold by truck. Given the commitment by Mr. Ajluni to maintain the present deli, staff recommends that this application be approved. Recommended conditions for Commission review at the public hearing a re: 1. that the permit be approved to Mr. Ted David Ajluni, and be non-transferable; 2. that the size and location of the sandwich deli be consistent with that approved in March, 1979; � 3. that not more than 7 tables/44 seats be available for customer use; 4. that the hours of operation not exceed 7:00 A.M. to 3:30 P.M.; and 5. that on-site parking available for the deli's customers be reviewed in one year, and this permit be subject to possible modification at that time. Y s City Planner *For a short period of time an 'A-board' sign was placed on the roof of Mr. Tsavalas' car parked on Rollins Road. After several warnings, the sign was removed. Staff reconu�iended approval 4rith five conditions as listed in the staff report.
