Allowable Use: Outdoor uncovered truck and equipment storage requires a special permit.
History: In 1994, a special permit for outdoor truck storage was granted to the former owner of the site.
On May 18, 1998, the City Council revoked this special permit because the applicant had failed to
comply with the conditions of approval by adding a number of structures on the site. The property has
since been sold, and Howard Engineering has now applied for a special permit to store construction
vehicles and equipment on the site.
Summary: The applicant, Joseph Howard, Howard Engineering, is requesting a special permit to allow
storage of construction vehicles and equipment at 970 David Road, zoned M-1. The 4480 SF site is
now partially paved with a gravel surface between the driveway and the storage area. The site is
surrounded by a chain link fence with a wrought iron gate across the front. The applicant intends to
store equipment and vehicles from his construction business at this site when the equipment is not in use
on job sites.
This application is being reviewed as a commercial use similar to a conditional use permitted in the M-1
zone (C.S. 25.44.030 (23)). The similar conditional use is outdoor storage of materials which are not
an accessory use (C.S. 25.44.030 (13)). The criteria for this use are:
1. limited to the front, sides and rear of any building located south of Mills Creek, except that there
shall be no such storage or treatment of materials in the front of those buildings having frontage
on Rollins Road between Mills Creek and Broadway;
2. limited to sides and rear of any building located north of Mills Creek, and those buildings having
frontage on Rollins Road between Mills Creek and Easton Creek;

3. the storage area shall be paved, not located in required parking, aisles, driveway or landscaping
and fully enclosed by either an opaque or solid fence or wa11 eight (8) feet in height or by a wall
of the building itself; and
4. if the storage area is located at the sides or rear of any building south of Mills Creek and not
visible from the street, the eight foot fence or wall may be of open design.
This proposal does not meet these design criteria of the outdoor storage use because the use is not
associated with any building, the site is not fully pavecl and it has an opaque fence (chain link with wood
slats) on only one side. The area where the equipment is to be stored is paved, but the remaining access
area is covered with gravel.
The storage site will be accessed by no more than two employees during the hours of 8:00 a.m. and
5:00 p.m. Monday through Saturday. The applicant anticipates that no more than 2 people will be on
site at any one time, and any employee vehicles will be parked on site inside the gate. Employees will
only be on the site to pick up or drop off equipment and vehicles. The applicant states that primarily,
the construction equipment is stored on a construction site for 2-3 months at a time, and would only be
stored on this site between jobs. The applicant has a total of 7 pieces of equipment (including
construction vehicles), and expects that generally there will be no more than 3 or 4 pieces of equipment
on site at any one time, but occasionally he may store all of the equipment on site if he is between jobs.
There will be no customers/visitors coming to the site.

This project meets all other zoning code requirements.
Staff Comments: The City Engineer states (July 13, 1998 memo) that the applicant shall show if the
site is asphalt paved or any paving is proposed for the parking area. The applicant states that the portion
of the site where the equipment is to be stored is already paved, and no additional paving is proposed.
The Chief Building Inspector and the Fire Marshal had no comments on this project.
Study Meeting: At the August 24, 1998 Planning Commission study meeting, the Commissioners asked
the applicant to define the 7 pieces of equipment to be stored on the site, do they include an ofiice
trailer, and asked for photos of the equipment to be stored. The applicant has responded in the attached
letter date stamped September 2, 1998, and has provided photos of the 7 pieces of equipment to be
stored on the site. There will be no office trailer kept at the site and no work of any nature will be
performed on the site.

The Planning Commission requested that the applicant provide a proper site plan to scale which shows
property line dimensions, sidewalks, gates and fences. The applicant has provided a revised site plan
to scale date stamped September 2, 1998. The commission noted that there is equipment parked on the
site and asked why. The applicant states that he has entered in to a lease agreement with the property
owners pending City approval, and have temporarily parked a few pieces of equipment there. The
Commission also asked that staff provide a map showing the location of Mills and Easton Creeks relative
to the site; the attached map provides this information.
Findings for a Special Permit: In order to grant a Special Permit the Planning Commission must find
that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame
general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on
adjoining properties in the general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include findings. The reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
Conditions:
1. that the project shall operate on the plans submitted to the Planning Department and date stamped
September 2, 1998, Site Plan;
2. that the construction equipment and vehicle storage facility may not be open for equipment
removal or parking except during the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday;
3. that a maximum of two employees shall be on site only to drop off or pick up equipment, and
no work shall be performed at the site and no structures on or off foundations shall be permitted
on the site, and there s11a11 be no utilities extended to the site;
4. that all employees shall park on site, there shall be no visitors to the site;

5. that all equipment shall be washed and/or maintained off the site and in no case shall equipment
be washed or maintained within the public or railroad right-of-ways or any adjacent privately
owned parcel; and
6. that the use and any improvements for the use shall meet all California Building and Fire Codes,
1995 Edition as amended by the City of Burlingame.

define the 7 pieces of equipment which would be stored on the site, do they include an office
trailer; would like a photo of each piece of equipment to be stored; need a proper site plan
showing the sidewalk, property line dimensions, gates and fences to scale, if going to approve
on the basis of the site plan we need to be able to read it and know it is accurate; could staff
include a map showing the location of Mills and Easton Creeks relative to this site; when made
site visit there was equipment parked on this site, why. There were no further questions on this
item and it was set for public hearing on September 14, 1998, assuming that revised plans and
other information was available in time.

Also enclosed is a scaled drawing prepared by Dave Howell of Peninsula Building Design.
Howard Engineering has entered into a Lease Agreement (pending City Permit) with
Li-Chen Huang Lee and Johnson Lee, the owner of the captioned site, and have temporarily
parked a few pieces of equipment pending approval.

RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND SPECIAL PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a
s� ial p rmi for storage of con tr c ion vehicl � anrl P���men+ at 970 David Road� zoned M-1,
J�hnson and Li- hen H�an .�P,_��er y owners, APN: 025-272-160;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
Se�tember 14, 1998 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
CEQA Article 19, Section 15301, existing facilities, Class 1, operation, repair, maintenance, or minor
alteration of existing public or private facilities involving negligible or no expansion of use beyond that
previously existing is hereby approved.
2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval Categorical Exemption and Special Permit
970 David Road
effective SEPTEMBER 23, 1998
1. that the project shall operate on the plans submitted to the Planning Department and date
stamped September 2, 1998, Site Plan;
2. that the construction equipment and vehicle storage facility may not be open for equipment
removal or parking except during the hours of 8:00 a. m. to 5:00 p. m. Monday through
Friday;
3. that a maximum of two employees shall be on site only to drop off or pick up equipment,
and no work shall be performed at the site and no structures on or off foundations shall be
permitted on the site, and there shall be no utilities extended to the site;
4. that all employees shall park on site, there shall be no visitors to the site;
5. that all equipment shall be washed and/or maintained off the site and in no case shall
equipment be washed or maintained within the public or railroad right-of-ways or any
adjacent privately owned parcel; and
6. that the use and any improvements for the use shall meet all California Building and Fire
Codes, 1995 Edition as amended by the City of Burlingame.
