Applicant: Howard Engineering Property Owner: Johnson Lee & Huang Li-Chen Lot Area: 4480 SF; 0.11 Acre General Plan: Industrial, Industrial & Ofiice Use Adjacent Development: Warehouse and Industrial Uses APN: 025-272-160 Zoning: M-1 CEQA Status: Article 19. Categorically Exempt per Section: 15301 - Existing facilities, Class 1, operation, repair, maintenance, or minor alteration of existing public or private facilities involving negligible or no expansion of use beyond that previously existing. Previous Use: Outdoor uncovered truck and equipment storage Proposed Use: Outdoor uncovered truck and equipment storage Allowable Use: Outdoor uncovered truck and equipment storage requires a special permit. History: In 1994, a special permit for outdoor truck storage was granted to the former owner of the site. On May 18, 1998, the City Council revoked this special permit because the applicant had failed to comply with the conditions of approval by adding a number of structures on the site. The property has since been sold, and Howard Engineering has now applied for a special permit to store construction vehicles and equipment on the site. Summary: The applicant, Joseph Howard, Howard Engineering, is requesting a special permit to allow storage of construction vehicles and equipment at 970 David Road, zoned M-1. The 4480 SF site is now partially paved with a gravel surface between the driveway and the storage area. The site is surrounded by a chain link fence with a wrought iron gate across the front. The applicant intends to store equipment and vehicles from his construction business at this site when the equipment is not in use on job sites. This application is being reviewed as a commercial use similar to a conditional use permitted in the M-1 zone (C.S. 25.44.030 (23)). The similar conditional use is outdoor storage of materials which are not an accessory use (C.S. 25.44.030 (13)). The criteria for this use are: limited to the front, sides and rear of any building located south of Mills Creek, except that there shall be no such storage or treatment of materials in the front of those buildings having frontage on Rollins Road between Mills Creek and Broadway; 2. limited to sides and rear of any building located north of Mills Creek, and those buildings having frontage on Rollins Road between Mills Creek and Easton Creek; R 4 J' SpecialPermit for Outdoor Storage of Construction Equipment and Vehicles 970 David Road 3. the storage area shall be paved, not located in required parking, aisles, driveway or landscaping and fully enclosed by either an opaque or solid fence or wall eight (8) feet in height or by a wall of the building itself; and 4. if the storage azea is located at the sides or rear of any building south of Mills Creek and not visible from the street, the eight foot fence or wall may be of open design. This proposal does not meet these design criteria of the outdoor storage use because the use is not associated with any building, the site is not fully paved and it has an opaque fence (chain link with wood slats) on only one side. The area where the equipment is to be stored is paved, but the remaining access area is covered with gravel. The storage site will be accessed by no more than two employees during the hours of 8:00 a. m. and 5:00 p.m. Monday through Saturday. The applicant anticipates that no more than 2 people will be on site at any one time, and any employee vehicles will be parked on site inside the gate. Employees will only be on the site to pick up or drop off equipment and vehicles. The applicant states that primarily, the construction equipment is stored on a construction site for 2-3 months at a time, and would only be stored on this site between jobs. The applicant has a total of 7 pieces of equipment (including construction vehicles), and expects that generally there will be no more than 3 or 4 pieces of equipment on site at any one time, but occasionally he may store all of the equipment on site if he is between jobs. There will be no customers/visitors coming to the site. Proposed Existing Allowed/Req'd. This project meets all other zoning code requirements. Staff Comments: The City Engineer states (July 13, 1998 memo) that the applicant shall show if the site is asphalt paved or any paving is proposed for the parldng area. The applicant states that the portion of the site where the equipment is to be stored is already paved, and no additional paving is proposed. The Chief Building Inspector and the Fire Marshal had no comments on this project. The application was proposed to be scheduled for the Planning Commission's August 10, 1998 study meeting. However, the Planning Commission limits the number of items on its agenda to 16, and there are already 16 items submitted before your application which are scheduled on the August lOth agenda. Therefore, it is necessary to schedule your application for study on August 24, 1998 and for action by the Planning Commission on September 14, 1998.
