Re: Reclassification of lot, southeast corner of
Highland and Bayswater Avenues, R-4 to C-2.
A public hearing was held by the Planning Commission on April 250 1966,
on the application of Jones-Minto Company to reclassify a property,
50 feet by 100 feet in area, at the southeast corner of. Bayswater and
Highland Avenues from R-4 (apartment) to C-2 (service business).
Legal notice of the hearing was given by publication and by written
notice to property owners within 500 feet of the property. Following
the hearing, the Commission voted to recommend to the Council that the
property be reclassified.
In 1954, with the adoption of a new zoning ordinance, the entire block
of which this property is a part was zoned C-2, service business. It
was believed that expansion of the automobile business would require
all of the area. At that time, much of the Highland Avenue frontage
was vacant. Later, in 1961, when the expected business growth did not
materialize, a request was made that the Highland Avenue lots be made
available for apartment construction and the zoning was changed to
R-4.
The present application applies to a single lot on the corner of Bays-
water and Highland Avenues. Its long frontage is on Bayswater and the
balance of that block frontage is C-2. The Commission agrees with the
evidence of the petitioner that the automotive business is again grow-
ing and that the space limitation of properly zoned land is a problem.
The lot in question immediately adjoins C-2 land and can be joined
with it to provide more service area. Because of the nature of the
product, automobile business, both service and sales, requires consider-
able space and the provision of privately owned lots is preferable to
the illegal and annoying use of public streets for private business.
The Commission recognizes the difficulties faced by residential uses
immediately adjacent to corrercial uses. In this case, most of the

easterly side and the entire westerly side of Highland Avenue are
zoned R-4, the least restrictive of the city's residential zones.
Lacking any method of providing a transition zone, this condition
always exists where two dissimilar zones have a common boundary,
a condition not at all unusual in any zoning system.

The reason for this letter is to request a reclassification of
Lot Portion 6, Block 13, Subdivision Polo Field, Zone R-4.
As you are fully aware, this property was commercially
zoned at one time, and due to the fact that the anticipated growth
in the auto industry did not materialize soon enough, no one made
a request to utilize the property for commercial use and as a
result this property was rezoned back to residential.
However, in recent years the growth of the auto industry has
exceeded all expectations in both sales and service, therefore
the shortage of property has become more critical with all
auto dealers in this area, and they require more property to
properly service the customers in this community.
The intent for reclassifying this property to a C-2 Commercial
Zone is to alleviate parking that now exists on the street; this
would enable us to park our service cars on this property. We
feel that in doing this it would certainly be to the advantage of
all parties concerned, plus the fact that the two houses that now
exist on this property are no asset to the community.
We intend to make a service storage lot on this property for at
period of one to two years and it is our intent to, at a later date,
build a service facility on same property. This is the reason we
are requesting a reclassification, as you can well understand that
the investment in this property would be way out of line for just
a parking facility.
