This application was to allow the addition of two signs which will exceed the amount of signage and number of permitted signs at 101 California Drive. The February 14, 1983 minutes of the Planning Commission state this Sign Exception was approved on a 5-1-1 roll call vote. Erection of the signs will require separate application to ihe Building Department. The applicant was commended on his present leasing operation; concern was expressed about another car rental agency taking over use of this property in the future and in that context was car rental an appropriate use in M-1. App'icant explairred hzs long term leasing business and plans for short term rental, 1��•30 day periods; in short term rental, maintenance and insurance are provided �v the rental.agency. Mr. Booth further advised they do not re-lease their automobiles, but usually sell them; that they would like additional signage to identify the new com�any activity but that would be a separate application; that �hey had approximateTy 1,000 units rer year under lease, rentals would be a maximum of 30 vehicles per day and incidental to their general operation. A fourth condition of approval was suggested regarding maintenance and washing of cars on-site. It was pointed out that the original permit covered concerns about maintenance of landscaping. C. Graham moved to approve this special permit amendment to allow auto rentals in conjunction with auto leasing with the following conditions: (1) that the car rental fleet operated from this site be limited to a maximum of 30 vehicles and operated between the hours of 8:00 A.M. to 5:00 P.M., Monday through Friday; (2) that no off- loading or on-loading of vehicles from trucks take place on the streat or public right- of-way; (3) that no parking of leased or rental vehicles be allowed on-street at any time; and (4) that there be no maintenance or washing of vehicles on the site until the drainage facilities meet the requirements of the City Engineer. Discussion: Sign C on the California Drive frontage; if the application were approved it would in essence approve a total signage program on this property. C. Schwalm found that this was not an unreasonable request nor a grant of special privilege in that the applicant is taking on a new dealership to sell Peugeot automobiles and needs this identification. Pa ge 5 Burlingame Planning Commission Minutes February 14, 1983 CP discussed the April, 1980 approved condominium permit; the final subdivision map which shows half the required spaces outside the gate, the other half and storage area inside the gate; recent installation of a gate which encloses all the required off-street parking; the impact of this gate on the size of one parkin� space; applicant's reasons for his request; answers to study meeting questions; CE'� suggestions regardinc the gate. One condition for consideration was suggested in the staff report with regard to providing an unobstructed 9' width for the parking space immediately adjacent to the gate. Zev Ben-Simon, the applicant, was present. He advised that the previous gate was installed and in place until a series of vandalism incidents caused it to be mo�ied, and that the substandard parking space could be easily used by a compact car. �hm. Mink opened the public hearing. There were no audience corr�nents and the hearing was closed. Discussion: the grade on the driveway into the garage is approximately 15�; there are three on-street parking spaces in front of this building and 30+ on-street spaces in the area, most in the adjacent R-1 zone. Applicant commented on the incidents of vandalism which occurred after occupancy of the building when open off-strE�et guest parking was available including ripping out overhead lights, theft from cars and gathering of children in the daytime; and that the current gate is operated from residents' cars. Further Commission discussion: service companies are provided a key to gain entrance; most incidents of vandalism occur at night; the difficulty of moving the gate to an alternate position between parking spaces 5 and 6 because of the overhead sewer plumhing. Commissioners could not find exceptional circumstances with regard to the gate as installed: there is visibility into this garage; the three on-stree� spaces available are not enough for guest parkii�g; suggest post sign indicating guest parking inside; this street is badly congested with parking now; concern that installation without city permits had occurred twice recently; suggest the deve7oper return with a new plan to provide more accessible guest parking. There were no audience comments and the hearing was closed. � Y� � P.C. 2/14/83 Item #8 MEMO T0: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: SIGN EXCEPTION FOR TNE NUMBER AND SQUARE FEET OF SIGNS ON PRIMARY AND SECONDARY FRONTAGE AT 101 CALIFORNIA DRIVE The applicant, Robert Knezevich, is requesting a sign exception to allow an addition of 70 SF and one sign to an existing non-conforming signage situation on his primary frontage at California Drive and an addition of 24 SF to his secondary frontage (Bayswater). The signage of the secondary frontage conforms to the standards laid out in Code Sec. 22.16.030 for Auto Row. However, the request for the additional 70 SF on the primary frontage causes the total signage on the primary frontage to exceed the standards established for Auto Row in Code Sec. 22.16.040 by 544 SF. Existing signage on the site's frontage exceeds Auto Row standards by 474 SF. The number of permitted signs on the primary frontage is also exceeded (Code Sec. 22.16.050). Currently the number of signs is exceeded by two. The request, if granted, would cause the number of signs on the primary frontage to be exceeded by three. City staff reviewed the request. The City Engineer (memo of January 17, 1983) and Fire Marshal (memo of January 17, 1983) had no comments. The Chief Building Inspector (memo of January 28, 1983) had no comments except to note building permits would be required for sign installation. The applicant's request (Sign Exception January 13, 1983) points out that adjacent auto dealers all have signage and the residential areas nearby don't need it. He also states that the additional signage is requested because they are adding a Peugeot dealership and are required by the manufacturer and California Department of Motor Vehicles to have signs indicating the new dealership. Without the signs he feels he would not be able to sell Peugeot automobiles. The table comparing existing signage on Auto Row to code standards shows that without this request this site has the largest amount of signage of any auto dealer surveyed. The average signage per dealer's site is 480 SF. In reviewing this application it should also be noted that the largest single sign is the 482 SF wall/fence sign around the outdoor lot. In addition this request also includes a change of copy on the "Burlingame Ford" wall sign (lA) to "Burlingame Ford Peugeot". The change of copy would not affect the s i ze of the s i g�� . In granting a sign exception the Commission should address the following items (Code Sec. 22.06.110): (a) Any exception granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situate; and (b) �>ecause of special circumstances applicable to the subject property, including size, shape, topography, street frontage, location or surrounding land use; the size or height of the building on which the sign is to be located; the classification of the street or highway on which the sign is located or designed primarily to be viewed from, the strict application of zoning regulations is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. -2- As stated by the applicant, he is required to provide signage on this site for the Peugeot dealership. He is also located in the Auto Row area of Burlingame.
