AND SPECIAL PERMIT FOR A RETAIL HOBBY SHOP AT 100 CALIFORNIA
DRIVE, ZONED C-2, SUB AREA D
RECOMMENDATION:
City Council should hold a public hearing on the negative declaration
and special permit request and take action. The first action should be
on the negative declaration. Affirmative action on both the negative
declaration and special permit should be taken by resolution.
Conditions recommended by Planning Commission:
1. that the site shall be remodeled as shown on the plans submitted
to the Planning Department and date stamped January 26, 1989;
2. that the condition of the Fire Marshal�s February 6, 1989 memo
shall be met and the project shall be designed to meet all
building code and fire code requirements;
3. that the conditions of the City Engineer's January 30, 1989 memo
shall be met which shall include the marking of 53 parking spaces
to be used by the hobby shop as well as providing signage
reviewed by city staff to direct customers to the parking area;
4. that all the employees of the hobby shop shall be allowed to park
on the property and nine parking spaces shall be clearly marked
for employees only;
5. that this business shall operate seven days a week 9:00 A.M. to
9:00 P.M. with a maximum of nine employees on the site and a
maximum of 60 customers between 9:00 A.M. and 5:00 P.M. and an
additional 60 customers between 5:00 P.M. and 9:00 P.M.;
6. that the working scale racetrack shall be used for practices and
the testing of cars being purchased, with a maximum of eight
people using the track at any one time; this race track shall not
be used for organized races without prior amendment of this
permit;
7. that the applicant shall obtain a building permit within a year
of this permit being issued, otherwise this permit will become
void;

8. that this use shall be reviewed in one year�s time (March, 1990)
and yearly thereafter or upon receipt of complaints; and
9. that food and drink sales shall be limited to vending machines.
Action Alternatives:
1. City Council can uphold the Planning Commission and approve the
negative declaration and special permit for this change in use
from auto retail to retail in Sub Area D, Auto Row. Affirmative
action should be by resolution with the first action on the
negative declaration. In acting on the negative declaration
Council must simply find that based on the Initial Study and
public comments there is no substantial evidence that the project
will have a significant effect on the environment.
2. The City Council can reverse the Planning Commission and deny the
negative declaration and special permit request for retail use at
this location. If the negative declaration itself is
unacceptable the document must be corrected before any action can
be taken on the project.
3. The City Council can deny without prejudice the special permit
request. If this alternative is pursued the Council should give
the applicant, staff and Planning Commission clear direction
about what additional information is needed or the kinds of
alterations to the project which might be expected.
BACKGROUND:
David James Arata is proposing to convert the auto showroom/service
building at 100 California Drive into a 20,000 SF retail hobby shop.
The shop would include 7,900 SF of retail sales area, a 4,400 SF radio
control car test track, a 2,400 SF office area and a 5,900 SF storage
area. The proposed building to be used is one of the three on a large
parcel. The other two, Honda showroom and service area and parking
garage, would remain in their present use. The auto display area in
front of the parking garage will be leased to a used car operation.
Thirty-five spaces inside the parking garage would be set aside and
marked for the use of the hobby shop customers; a total of 53 parking
spaces would be provided on site. No parking variance is required.
Honda will continue to use 28 of the remaining 271 parking spaces in the
parking garage. The used car operation will only use the at grade area
at the front of the parking garage, no spaces within the garage will be
assigned to the used car operation.
The hobby shop will employ nine people and be open seven days a week
from 9:00 A.M. to 9:00 P.M. Sixty customers a day are expected between
9:00 A.M. and 5:00 P.M. and 60 after 5:00 P.M. each day. The test track
for the radio controlled cars will be open from 4:00 P.M. to 9:00 P.M.
and is expected to be a main attraction. The occupancy of the track
area is about 35 to 40 people and would be limited. Only eight people

can test cars at one time on the track because of the nature of the
radio controls. There will be fixed seating for about 30 who wish to
watch the tests. Radio controlled car racing is a sport, but
competitions will not be held at this location. Of the 53 parking
spaces required 35 will be provided in the adjacent parking structure
and 18 in the area by the shop, under the canopy and at grade.
A use permit is required because the Sub Area D designation places a
priority on auto sales and service uses in this area on California Drive
between Peninsula and Burlingame Avenues.
Necrative Declaration
Staff prepared Negative Declaration ND-420P for this project. The
negative declaration addresses the 24 environmental effects anticipated
from the change in use from auto sales and service to hobby retail sales
at this location. If Council, on looking over the initial study and
response to comments made before the Planning Commission, finds that
there is no substantial evidence that the project will have a
significant (negative) effect on the physical environment, then the
Council should adopt the resolution approving the negative declaration.
The monitoring program for the negative declaration is contained in the
conditions on the project and will be accomplished by the implementation
of the conditions as part of the zoning implementation.
Policy Implications
The negative declaration does not address the policy issue of
preservation of the auto row area. The general plan designates this
area as service and special sales. The base zoning of C-2 implies an
emphasis on "heavier" commercial uses such as retail auto repairs, body
shops, machine shops, laundries and warehousing. However all the uses
permitted in the C-1 zone (shopping and service) are also permitted in
C-2. However, in 1982 the city established three overlay zones within
the Burlingame Avenue Commercial Area. The intention of these overlay
zones was to encourage or focus specific activities in each of the three
areas. Sub Area A's emphasis was on pedestrian oriented retail. Sub
Area B's focus was on support activities to the pedestrian oriented
retail such as banks, office uses, dry cleaning plants. Sub Area D was
designated to encourage and collect auto row and auto related uses
together. This proposal is the first request for a change in use of a
large parcel central to this sub area, therefore it raises a policy
issue of possible change in focus of the use in this area.
Plannina Commission Action
At their meeting on February 27, 1989 the Planning Commission voted 6-0
(Commissioner S.Graham absent) to recommend the negative declaration to
City Council, finding that it identified no significant environmental
effects. Subsequently the Commission voted 6-0 (Commissioner S.Graham
absent) to approve the use permit for a hobby shop at 100 California
Drive. The Commission found in its action that the proposed use would

have no additional traffic impact, the use would be less intensive than
auto sales and service, that the proposed use is in accord with the
general plan since it can be viewed (because of its size and intensity)
as an interim non-auto use within the auto row area, not a harbinger of
a major shift in use for the entire area; and no negative environmental
impacts were identified.

10. NEGATIVE DECLARATION AND SPECIAL PERMIT FOR A RETAIL HOBBY
SHOP AT 100 CALIFORNIA DRIVE, ZONED C-2, SUB AREA D
� Reference staff report, 2/27/89, with attachments. PLR Garefalos
reviewed details of the request, staff review, preparation of the
negative declaration, applicant�s letter, study meeting questions,
on-site parking provided. Eight conditions were suggested for
consideration at the public hearing. Discussion: 53 parking spaces
are required for this use, two handicapped spaces are part of the
53.
Chm. Jacobs opened the public hearing. David James Arata,
applicant, was present. He discussed parking provided and
responded to Commission questions about the racetrack: cars are
radio controlled models, this 22,000 SF building will give plenty
of room, there are fixed seats for 30 people, occupancy load of the
racetrack area is limited to 49 people, they plan to have one of

the largest hobby shops in the Bay Area, biggest he has seen is
12,000 SF so they thought they would have the space for the
racetrack in the back, it will be an offroad dirt track, people can
time themselves but with a limit of 49 people, they do not want to
attract thousands of people, this is a retail shop, not an
amusement area, they will not have organized races, the test track
is for practice and to test cars before purchase.
If use of the test track becomes constant they may want to charge a
fee, probably $4.00 per 1/2 hour, it could become a game situation,
logging times, with a set pattern track. There is a wall which
divides the track from the retail area, object is not to sell track
time but to make money by retail sales. If the track becomes very
popular they will get another building and put a track in it.
Forty-nine people is the total allowed in the track area, Fire
Department has required designated seating for 30, in this way the
occupancy can be controlled. Commission thought it would be an
attractive entertainment facility, applicant said it would be up to
him to limit the total watchers to 49. The track will be an
inducement to get people into the store to buy the products.
Applicant stated they would not sell beer or wine. There were no
audience comments and the public hearing was closed.
Commission discussion/comment: there was a hobby shop on Burlingame
Avenue 15-20 years ago, with shop upstairs and model car track
downstairs, they had to charge for track time because there was so
much interest and they needed to limit the number of people in the
basement; it is a pastime enjoyed by adults as well as children.
C. Giomi found the conditions suggested in the staff report would
reasonably satisfy city concerns, especially one year review or
upon complaint; she was comfortable in letting the applicant give
this business a try. C. Giomi moved to recommend the negative
declaration to City Council for approval with the finding there
would be no significant (negative) impacts from this use. Motion
was seconded by C. H.Graham.
Comment on the motion: does this use compromise the integrity of
auto row zoning since the site is located at the center of auto
row; auto row has shifted some; don�t see this as a permanent use,
auto use will replace it; such a use could only go here or at the
Plaza, they are the two places in the city which have parking; the
other end of Sub Area D by the train station has a wide variety of
uses.
Motion to recommend the negative declaration to Council was
approved on a 6-0 roll call vote, C. S.Graham absent.

C. Giomi found the proposed use will not be detrimental to existing
uses in the area nor to surrounding properties, there will be no
undue traffic impact, this is a less intensive use, it is in
accordance with the general plan since it could be considered an
interim commercial use within the auto row area, not necessarily a
change for the entire area; it meets its parking requirements,
there will be no negative environmental impact. C. Giomi moved for
approval of the special permit and for adoption of Commission
Resolution Approving Special Permit with the following conditions:
(1) that the site shall be remodeled as shown on the plans

RETAIL HOBBY SHOP AT 100 CALIFORNIA DRIVE, ZONED
C-2, SUB AREA D
David James Arata is requesting a Special Permit in order to
operate a retail hobby shop at 100 California Drive, zoned C-2,
Sub Area D. A special permit is required for all non-auto
related uses in this area (Code Section 25.38.031-2). The
proposed hobby shop would sell model trains, automobiles, planes,
kites, and craft materials and wil.l include a working scale radio
controled model car racetrack. This is planned to be one of the
largest hobby shops in the Bay Area. The store would be open
Monday - Sunday from 9 AM to 9 PM with a maximum of 9 employees
on the site. The model racetrack would operate from 4 PM to 9
PM. It is expected that from 9 AM to 5 PM the business would
generate up to 60 customers with an additional 60 customers
between 5 PM and 9 PM.
A total of 53 parking spaces on this property will be reserved
for the hobby shop use. Thirty-eight of these spaces will be in
the parking garage. On the other end of the property is the Honda
auto dealership which uses a portion of the parking garage for
vehicle storage. There are approximately 30�0 parking spaces in
the garage which would result in 262 spaces available for the
Honda dealership's use and 38 spaces for the hobby shop.
Staff Review
City staff have reviewed this request. The City Engineer
(January 30, 1989 memo) explains that his concern is parking. The
applicant will need to mark the parking and provide signs
identifying the parking area. Since the parking is being shared
with the auto dealership on the other end of the property, it is
critical that the hobby shop parking be clearly identified. He
also notes that handicapped access and parking will have to be
provided. In addition, he notes that the parking should be
available at all times of the day. The Chief Building Inspector
(January 26, 1989 memo) notes that he does not have any comments
since the hobby shop is a less hazardous use than the previous
auto dealership on this property. The Fire Marshal (February 6,
1989 memo) states that two exits will be required from the
retail sales area.
Neaative Declaration
Staff have reviewed this project for potential environmental
effects and determined that the project as designed should not
create any significant environmental effects. Negative
Declaration 420P was prepared for this project. This negative

declaration compares the proposed hobby shop use to the previous
auto dealership use. It is noted that compared to the auto
dealership use, the proposed hobby shop may result in an
increase in pre-teens using the facilities as well as more
activity in the area in the evenings (up to 9 PM) and on
weekends. It is not expected that either of these changes would
have any negative effects on the area, in particular since
weekend traffic is lighter than on other days and sufficient
parking will be provided on the property for this use.
Applicant's Letter
In his letter of January 11, 1989 Mr. Arata explains that the
Arata Pontiac dealership will be going out of business in the
near future. He has not been able to rent the site to another
auto dealership or related business therefore he has decided to
open a retail store at this location. He plans to make this one
of the largest hobby stores in the Bay Area and include in it a
working radio controlled model car racetrack.
Study Ouestions
The Planning Commission reviewed this project at study on
February 14, 1989 ( P.C. minutes 2/14/89). In his letter date
stamped February 17, 1989 the applicant answers the Planning
Commission questions. He notes that the business will operate as
a retail store with the primary purpose being the selling of
hobby and craft items, with over 90� of the revenue coming from
the retail portion of the business. He explains that the
racetrack will not be used as an amusement area for large groups
of people. Since the Fire Code limits the number of people in
the race track area to only 49, they will not be able to have any
type of organized racing. The track will be used for practice
only and as a test track to try out cars people may be thinking
about purchasing. No loud noise will result from this use since
the cars have electric motors which are not noisy. No more than
8 people will use the track at any one time. More people than
that would create problems with radio frequencies. There will be
no pinball or electronic games and food will be offered in
vending machines.
Thirty-eight parking spaces on the ground floor of the parking
structure will be designated for this tise. In addition 11 spaces
on the south side of the ground floor will also be used. In
addition there are 4 spaces under the canopy at the northwest
corner of the building and 4 diagonal spaces just north of the
canopy which will also be reserved for this use. A minimum of 53
parking spaces are proposed to be reserved for this use.
The parking in the structure will end at the sheer wall where a
gate can be installed to provide security. All parking inside
the parking structure will be marked and clearly signed. The
structure is currently lit 24 hours a day, therefore no
additional lighting is required. Combined with the existing
outdoor lighting currently available on the property, there is
sufficient lighting to allow the safe passage of people from the
hobby shop to the parking structure.

Findinas for a Special Permit
In order to grant a Special Permit the Planning Commission must
find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner
in accord with the Burlingame general plan and the purposes
of this title;
(c) the Planning Commission may impose such reasonable
conditions or restrictions as it deems necessary to secure
the purposes of this title and to assure operation of the
use in a manner compatible with the aesthetics, mass, bulk
and character of existing and potential uses on adjoining
properties in the general vicinity.
Planninv Commission Action
The Planning Commission should hold a public hearing on this
project and negative declaration. Recommendation to Council
should be made on the negative declaration first and then action
should be taken on the project. Affirmative action on the
special permit should include findings. Affirmative action on
both the negative declaration and special permit should be made
by resolution. The reasons for any action should be clearly
stated. At the public hearing the following conditions should be
considered:

100 CALIFORNIA DRIVE - PROPOSED HOBBY SHOP
This project involves the conversion of an existing auto
dealership with auto repair to a retail hobby shop which would
sell model automobiles, trains and planes as well as kites and
crafts. In addition, this hobby shop would include a working
scale model racetrack which would operate daily from 4 P.M. to 9
P.M. It is expected that this racetrack will be one of the main
attractions of the store. The property is located in the Auto
Row area of the City. Adjacent uses consist of a variety of auto
dealership operations. To the rear of the property (east side)
is the Southern Pacific right-of-way which separates the property
from residential uses approximately 300' away from the site.
The proposed hobby shop use will be completely contained within
the existing building on the property, therefore there should not
be any substantial increase in noise in the area. In addition,
there are no changes proposed to the exterior of the building,
therefore there should not be any significant changes in the
appearance of the property. The retail nature of the business
should be compatable with the other retail auto dealership uses
in the area.
It is expected that the hobby shop customers would fall into two
major age categories, pre-teens and those 28-45 years old. One
major difference between the auto dealership and the proposed
hobby shop would be an increase in the number of younger, pre-
teen customers coming to the area. No significant environmental
effects are expected to result from this change.
In terms of traffic impacts, it is expected that the proposed
hobby shop will be similar to the existing auto dealership use on
the property, except that the hobby shop will involve more
activity in the evening hours and on weekends. The auto
dealership operates Monday - Friday from 7 A.M. to 9 P.M. and
Saturday and Sunday from 9 A.M. to 6 P.M.. The proposed hobby
shop will be open from 9 A.M. to 9 P.M. Monday - Sunday. Compared
to the auto dealership use, the hobby shop will begin operating
later in the day and will remain open later on weekends.
On a regular weekday the auto dealership has 36 employees on the
property from 7 am to 9 pm and approximately 65-70 customers
between the hours of 8 A.M. to 5 P.M., and an additional 10
customers between 5 P.M. and 9 P.M.. Therefore, this use has
approximately 116 geople coming and going from the site. On
weekends the auto dealership has 16 employees on the premises and
approximately 50 customers, for a total activity of approximately
66 people coming and going from the site. The proposed hobby
shop, both weekdays and weekends, is expected to have up to 9
employees on the premises and approximately 60 customers between
9 am to 5 pm and an additional 60 customers between 5 pm and 9
pm. On weekdays, the traffic generated by the two uses should be
very similar ( 116 vehicle trips for the auto dealership versus
129 vehicle trips for the proposed hobby shop). Weekend
activity, however, will be greater for the hobby shop (129
vehicle trips for the hobby shop versus 66 vehicle trips for the
auto dealership). This increase in weekend activity should not

create any significant traffic impacts in the area since the
reduced activity of other businesses in the area reduces the
traffic on California Drive and many of the other streets in the
area. Weekday traffic may actually be reduced by the hobby shop
use since the added impacts of test driving of vehicles being
repaired as well as the delivery of cars to the site will be
elliminated. In addition, it is assumed that all the
individuals who use the hobby shop would drive to the site. In
reality, a significant number of the pre-teen customers may take
public transit to the site.
Parking for the hobby shop will be provided in the freestanding
parking structure on the property. 53 parking spaces will be
designated for the hobby shop. The auto dealership has been
using much of the parking structure for car storage. Once these
stored vehicles are removed, there should be plenty of parking
available in the structure. There are approximately 324 parking
spaces in the structure, 28 of which are reserved for the Honda
dealership at the north end of the property. Therefore, there
should be sufficient room on the property itself to accomodate
the parking demands of the proposed hobby shop.
INITIAL STUDY:

future. The Pontiac and G.M.C. franchises have been sold to
Putnam Buick. Putnam will operate all three franchises out of one
separate facility.
This causes the prolalem of a vacant building, my attempts to
rent to other automobile franchise holders or related businesses
have not been successful.
What I would like to do is reopen the building as a retail
store. The store would engage in selling items to the Hobbiest.
Trains, planes , automobiles, kites etc.

One of attractions of the store will be a working scale

and craft items. Over 90% of the revenues will be derived from
the sale of these items.
I would like to answer the questions proposed by the
commission:
Firstly, there seems to be a misconception as to the use of
the proposed racetrack. The track is not to be used as an
amusement area for r;lasses of people. The fire marshall brought
to my attention that only 49 people will be able to be in the
racing area at any given time. This would eliminate all organized
racing. The track would be used for practice, and as a test track
for the cars that we will be selling.
Secondly, the cars that will be tested will have electric
motors and emit no loud noises. The crowd will be limited to a
total of forty nine people with no more than 8 on the track
(because of radio frequencies) There should be no problem
with noise.
There will be no pinball or electronic games installed and
the vending machines will be limited to standard machines found
in most businesses (ie. coffee, soda, and candy bars).

City Flanner reviewed her memo of March 13 which recommended council
hold public hearing and tat:e action. David James Arata is proposing
to conver-t the auto showroom/service building at 10U California
Urive to a retail hobby �hop. The shop would include retail sales
��rea, a radio control car test track, office area and storage. The
building is one of three on a large parcel; the �ther two, a Honda
stiowroom and a park.ing gsrage are proposed to remain in their
present use. Thirty-five par�;ing spaces in the parking garage would
be set aside for the hobby shop customers; a total of 5:1 parking
spaces would be provided for this site. No park.ing v,�riance is
needed but a special permit is required for any use in Sub-Area D
that is not auto sales c,r service related. The F'lanning Commission
approved the negative declar-ation and special permit on February 27.
Counciiman Mangini e>:pressed some concern over the'par4:ing and
whether it would be suffi�ient.
Mayor r�mst,-up opened the public hearing.
David James Arata, applicant, spoke in f�vor, noting he realized
that co�mcil's concern was this non-auto related business on auto
row. He reflected on the current difficulties with auto franchise

Fublic Wor{;s' memo of Mar�h 2 recommended council approve an
agreement with James E. Russell f�r preparation of a report to
the State at a cost of ��2,625. In 1986 the State passed SH
547 which requires every city to prepare an inventory of
potentially hazardous unreinforced masonry buildings in its
jurisdiction, and to develop a program for reducing the dangers
of these buildings. The report must be submitted to the State
by January 1, 1990.

encroachment permit for an e>;isting carport and fence installed

Councilman Mangini moved adoption of ORDINANCE 1"88. Seconded by
Councilman Lembi.
Councilman Pagliaro wondered about provisions for a structure
destroyed by fire or a new structure. City Attorney will include
language to clarify replacement of atructures destroyed by accident,
and for new structures. Council concurred with this amendment.
