Dear Mr. Meade:
Since there was no appeal to or suspension by the City Council, we wish to advise
the March 14, 1983 Planning Commission approval of your Sign Exception application
became effective March 22, 1983.
This application was to allow signage to exceed code requirements in the Auto Row
area at 100 California Drive. The March 14, 1983 minutes of the Planning Commission
state this sign exception was approved with the following condition:
1. that the signage program implemented shall be consistent with the
Chief Building Inspector's memo of March 7, 1983, with the plans date
stamped February 17, 1983 and the sign permit date stamped February 17,
1983.
Erection of the signs will require separate application to the Building Departrnent.

SUBJECT: SIGN EXCEPTION TO EXCEED THE NUMBER AND SQUARE FOOTAGE OF SIGNS
AT 100 CALIFORNIA DRIVE, BY WILLIAM MEADE FOR ARATA PONTIAC-GMC
Mr. Meade, for Arata Pontiac-GMC, is requesting a sign exception to allow li signs and
a total of 657.6 SF on the primary frontage (California Drive) and two signs and 39 SF
on the secondary frontage (Bayswater Avenue). Under Code Sec. 22.16.040 this property
is allowed eight signs on the primary frontage (699 linear feet) and a total area of
300 SF of signage. Thus the application exceeds the code requirements by three signs
and 357.6 SF. On the secondary frontage (Code Sec. 22.16.030) 100 SF of signage are
allowed and 39 SF are requested. M�aximum number of signs on the secondary frontage
are three; applicant is requesting two. The application conforms to the standards for
secondary frontage signage. Code Sec. 22.16.070 exempts pole signs in the Auto Row
area from the 20 foot maximum and establishes a 31 foot maximum. Pole signs in this
sign request are all 30 feet high.
City staff have reviewed the request. The Fire Marshal (February 22, 1983 memo) and
City Engineer (February 22, 1983 memo) had no comments. The Chief Building Inspector
(March 7, 1983 memo) points out the need for lateral wind load calculations on each
sign as well as building permits for each sign.
In the request for a sign exception (date stamped February 25, 1983) the applicant's
representative points out the mixed type of auto sales use at this site, the extremely
long street frontage, and the fact that the pole signs are being relocated from the
Arata Pontiac-GMC site to the north. The signs are needed to identify consolidation
of the activities of Arata Pontiac-GMC on this site; and his request is not different
than others in the area have requested. Three old Alcala Chevrolet signs would be
removed. Also under the franchise contract the dealership must follow the recommended
dealership signage identification program and agree to remove all signs not approved
by the dealership sign identification program.
Several months ago the Planning Department put together a table of estimated existing
and approved signage for the California Drive Auto Row and Rollins Row Auto Row sales
areas. This table addresses only primary frontage signage. Based on this survey
the applicant's request is similar in scale to recent approvals on Rollins Road, and
to the approval given to 101 California Drive. However, it exceeds substantially
several other existing California Drive Auto Row signage programs.
To grant a sign exception the Commission should agree the following conditions exist
on the site (Code Sec. 22.06.110):
(a) Any exception granted shall be subject to such conditions as will
assure that the adjustment thereby authorized shall not constitute a
grant of special privilege inconsistent with the limitations upon other
properties in the vicinity and district in which the subject property
is situate; and
(b) Because of special circumstances applicable to the subject property,
including size, shape, topography, street frontage, location or
surrounding land use; the size or height of the building on which the
sign is to be located; the classification of the street or highway on

which the sign is located or designed primarily to be viewed from,
the strict application of zoning regulations is found to deprive subject
property of privileges enjoyed by other properties in the vicinity and

Chm. Mink opened the public hearing. There were no audience comments and the hearing
was closed. During discussion Mr. Morales advised the shop would sell specialty
equipment, there would be no installation on site and that an installation company
would be recommended should the customer need its services. Further discussion:
staff's recommendation that this retail area not be further divided and no more than
seven businesses be allowed in future; this business would not generate as much traffic
as a donut shop; concern about substandard retail spaces. It was recommended
Condition #1 be amended to read: "that before the permit for occupancy be issued the
conditions of the .... be met."
C. Graham commented that this use would generate a minor amount of traffic, that it
was an auto related use and a proper site for this type of business. C. Graham then
moved to approve this special permit with the following conditions: (1) that before
the permit for occupancy be issued the conditions of the Fire Marshal's memo of
February 14, 1983 and the Chief Building Inspector's memo of February 22, 1983 be met;
(2) that this retail area not be further divided in the future and that no more than
seven businesses be allowed in this structure in the future; and (3) that this business
be operated on the basis described in the applicant's letter date stamped February 8,
1983 with the clarifying notes added by the Planning staff. Second C. Garcia; motion
approved on a 5-2 roll call vote, Cers Giomi and Leahy dissenting. Appeal procedures
were advised.

C. Graham found there were special circumstances applicable to this property in that
there are four businesses on the site: Arata Pontiac, GMC trucks, a service facility
and used car sales; that these signs are specific and necessary for each business;
that this is not a standard type of operation with a single business/single site;
and, therefore, approval would not constitute a grant of special privilege. Chm. Mink
added that this property is one of the longest lots in the zone. C. Graham then moved
to approve this sign exception with the following condition: (1) that the signage
program implemented shall be consistent with the Chief Building Inspector's memo of
March 7, 1983, with the plans date stamped February 17, 1983 and the sign permit date
stamped February 17, 1983. Second C. Cistulli; motion approved unanimously on roll
call vote. Appeal procedures were advised.

Concern was expressed about traffic generation. CP explained staff's method of
calculating traffic generation as well as parking space requirements for this building.
Arturo Morales, the applicant, was present. Chm. Mink opened the public hearing.
There were no audience corr�nents. Letter dated March 7, 1983 from W. Berry Hurley
Corp., Burlingame expressing concern about this proposal was noted for the record.
The Chair then declared the public hearing closed. Mr. Morales discussed parking
concerns, noting the busiest hours of the donut shop would be 6:00-10:00 A.M. and
6:00-10:00 P.M. when most of the establishments in the area would be closed. He
advised the shop would serve specialty donuts as well as other specialty products
such as pies and pastries.
Commission discussion: it was suggested the landlord of this building should attempt to
rent to auto related uses; several Commissioners expressed concern abaut traffic;
another concern was the 16 chair seating area which would tend to lengthen the time
customers would be using parking spaces. Further concern: division of this building
into small parcels which might set a precedent for substandard areas. It was suggested
Condition #1 be modified to read: "that before the permit for occupancy be issued the
conditions of . . . . be met."
C. Schwalm moved to continue this item for two weeks to the meeting of March 28, 1983.
Second C. Garcia; motion defeated on a 3-4 roll call vote, Cers Giomi, Graham, Leahy
and Mink dissenting.
C. Giomi then moved to deny this special permit. Second C. Leahy; application was
denied on a 6-1 roll call vote, C. Garcia dissenting. Appeal procedures were advised.
5. SPECIAL PERMIT TO ALLOW A RETAIL HOME AND AUTO STEREO SHOP IN SUB-AREA D OF THE

occupy the rear half of an approximate 1,000 SF area with the donut shop (Item #4).
