History: On June 6, 2005 the property owner applied for a building permit for a 478 SF first floor
addition (over a crawl space with a maximum ceiling height of 5'-6") to the rear of the existing house.
On July 28, 2005, the Planning Department approved the single story addition with conditions, noting
that residential design review was not required because the crawl space below the addition had a
proposed ceiling height between 5'-1 '/z" and 5'-6", and that that this area would not be counted in the
floor area calculation. A building permit was issued for this project on August 5, 2005. In order to be
clear on what was approved, the following conditions of the approval were applied to the building
permit:
1. "Crawl space under master bedroom can be no taller than 5'-6" to bottom of master
bedroom".
2. "Crawl space shall not be developed as living space or any thing other than crawl space
without review by the Planning Department".
A code enforcement complaint was filed that the proposed addition was not being built according to
the approved plans and the Building Department sent out an inspector in January of 2006 to measure
the plate height of the as-built "crawl space" area. After confirmation from both the Building Inspector
and the property owner that the "crawl space" area was, in fact, built with a plate height of 8'-1", a red
tag was issued on the project. Because of the change to the below-floor area to "habitable space", this
area would now be considered a"story" for zoning code purposes, and the addition above would be
considered a second story. It was then determined by both the Planning and Building Departments that
in order to move forward with the project, the property owner would need to either:
l. Apply for design review for a first and second story addition; or
2. Fill, with concrete, the entire new lower level addition area off the rear of the house so that
it has a maximum ceiling height/plate height of 5'-11" and therefore will not be counted as
habitable living space.
The property owner then decided to fill, with conerete, the entire new lower level addition area to a
ceiling height of 5'-11". This decision was based on the fact that if all of the new lower level addition
were counted as living space, the addition would exceed the maximum allowable FAR and a variance
would have been required. A Building Permit was issued for the concrete fill in February, 2006.
On September 29, 2006, the Building Department sent a letter to the property owner indicating that a
code enforcement complaint was made regarding work in progress without permits. An inspector
visited the site, observed that work was being done without permits and another red tag was issued on
the project.
On October 11, 2006, the Building Department sent a letter to the property owner stating that during a
site visit, it was observed that the approved concrete fill had been removed and replaced with a raised

plywood floor which was covered with linoleum. It was also noted that the work done had been
performed without the benefit of building permits or Planning Department review. The Building
Department gave the property owner two options which needed to be resolved by October 23, 2006:
1. Submit a building permit application and three sets of plans that describe how you will
remove the raised wood floor and install reinfarced concrete that will limit the ceiling
height to 5'-11 "; or
2. Apply to the Planning Commission for review of the underfloor area as new conditioned
floor space (this would trigger the need for design review).
On October 16, 2006, the property owner submitted another application to fill the entire "crawl space"
area with both concrete and rebar to a point that the crawl space would have a maximum ceiling height
of 5'-11" and therefore would no longer count towards the floor area calculation or count as a"story".
The Planning Department included a condition of approval on this project stating that all concrete and
rebar fill may not be removed from the crawl space area of the house without an approval for design
review and a variance for floor area ratio. A Building Permit for this concrete and rebar fill was issued
on November 21, 2006.
On October 30, 2006 the property owner submitted an application for design review to the Planning
Department to pursue the option to use that space as a"media room". With this application the
property owner proposed to fill in a portion of the "media room" with concrete to a ceiling height of 5'-
11 ", so that it would not count towards the floor area calculation, and a floor area ratio variance was no
longer required. The summary below reflects this latest submittal by the property owner.
Summary: The original two-story house, with an attached garage (11'-11" x 17' clear interior
dimensions), contained 2,279 SF (0.38 FAR) of floor area and had three bedrooms. The applicant has
added on to the first floor and built a second story addition. The first floor addition includes a family
room, media room and storage. The second story addition includes a master bedroom suite. The
second floor addition totals approximately 500 SF. With the first and second story additions as-built,
the floor area increased from 2,279 SF (0.38 FAR) to 2,999 SF (0.50 FAR) where 3,020 SF (0.50 FAR)
is the maximum allowed. The proposed project is 21 SF below the maximum allowed FAR.
With this project, the number of potential bedrooms increased from 3 to 4. Two parking spaces, one
covered (10' x 20') and one uncovered (9' x 20'), are required for the four bedroom house. The
original attached one-car garage (11'-11" x 17', clear interior dimensions) was expanded at the rear to
meet the covered parking requirement (11'-11" x 20', clear interior dimensions). One uncovered
parking space (9' x 20') is provided in the driveway. All other zoning code requirements have been
met. The following application is required:

Staff Comments: See attached. Staff would note that the plans included with the staff report are
reduced from the original and are therefore not to scale, but that the plans that were reviewed by the
Planning Department during the plan check were to scale and the information from those plans is
reflected in the calculations above.
Staff would note that the applicant is seeking approval of this design review proj ect as to avoid having
to fill the existing "media room" area of the house with rebar and concrete to a point where the ceiling
height would be exactly 5'-11" and therefare would not be considered to be habitable space and would
not count in the floor area calculation.

Dear Mr. Melamed:
Thank you for allowing the City access to the above-referenced property that you own. During the site visit
yesterday City staff inspected the underfloor area and observed that the concrete that was poured to reduce
the ceiling height to 5' 11" has been removed and has been replaced with a raised plywood floor. which is
covered with linoleum. This work has been performed without the benefit of building permits or Planning
Department review.
After discussing this matter with Planning Department staff it has been determined that you have two
options:
1) Submit a building pernut application and three sets of plans that describe how you will remove the
raised wood floor and install reinforced concrete that will limit the ceiling height to 5' 11", or
2) Apply to the Planning Commission for review of the underfloor area as new conditioned floor
space. If you obtain approval from the Planning Commission you will then need to submit a
building pernut application and plans for the work approved by the Planning Commission. If you
have questions regarding the Planning Commission application process please contact Erica
Strohmeier in the Planning Deparhnent at 650-558-7250.
Please submit your building permit application to remove the work performed without a building perniit or
provide or Planning Commission application by October 23, 2006. Note: Your gas and electrical meter
releases will not be issued until this issue has been resolved.

To the City of Burlingame Planning Department:
My wife and I are resident owners of 1509 Drake Avenue, next door to the ongoing
"Addition/Remodel" of 1511 Drake Avenue.
We have been in contact with your office since January of this year when we discovered that the
work on 1511 Drake was not meeting the plans approved by the City. We provided photograplhs
to you (and before we go on any further, we want to thank you for being extremely helpful,
responsive and informative) when we first noticed the build out of the second floor of 1511
Drake.
You provided us with a copy of the Plan Review Comments and let us know that (a) the height
of the addition was within the approved plans, and (b) that the addition was only a one story
addition with a 5'6" crawl space (the Approved Plans state "The crawl space below is 5'6" +0
5' 11/2", and is not counted as a floor ... in the floor area". We also wonder whether there is
enough backyard left to meet code requirements, but are not raising that question here).
After informing you that the "crawl space" was actually closer to nine (9') feet high and one of
your inspectors visited the site and noted this gross deviation from the filed plans. Even thoug�
the builder and owner were notified of the "red tag" they continued work (until the neighbors r�n
the block united to inform the Burlingame Police that the red tag was being violated).
In our conversation on February 6, 2006, you let us know that rather then submit to Design
Review for a two story addition, the builder would be filing an amended plan where the builder
would pour cement into the foundation of the addition to have the first floor space meet the
parameters of a crawl space under the city regulations.

In a follow-up conversation on March 2, 2006, you informed us that the builder had indeed fil�ed
an amended permit where cement would be poured to get the first floor within the definition of a
"crawl space" (although during that conversation, you mentioned a permissible height of 5' 11" —
not the 5'6" stated in the original approved plan). While noting that (1) the builder appears to
have done everything possible to avoid a planning review while skirting the building code, and
(2) all the sides of the house were now enclosed and that it will be very difficult to pour concr��te
into the space, I asked what would happen if the builder once again ignored the approved as
amended plan?
Your response was twofold: The City would not issue "approvals" of electrical or plumbing
work for the addition unless and until the cement has been poured, and if the builder just ignoi•es
the requirements to pour the additional cement it becomes a"legal issue".
At this point in the process, we would like to reiterate comments we have made during all of t�e
conversations regarding 1511 Drake: it would be waste of time and money for the builder to pour

1) Note: This project was submitted as the result of a stop work order.
2) Provide plans that detail only the proposed work. Remove all details, drawings, and notes that
do not apply to this proposed project. Note: The architect who drew the plans owns these
plans and is the only person who can revise the plans.
3) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements.
4) Provide fully dimensioned plans.
5) Provide existing and proposed elevations.
6) Provide a complete demolition plan that indicates the existing walls, walls to be demolished,
new walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building
Permit is issued for the project.
7) Comply with the new, 2005 California Energy Efficiency Standards for low-rise residential
buildings. Go to http://www.energy.ca.qov/title24 for publications and details.
8) Rooms that can be used for sleeping purposes must have at least one window or door that
complies with the egress requirements. Note: The proposed room can be used for sleeping
purposes and must comply with this requirement.
9) Provide a second means of egress from the basement area.
10) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details
if your project entails landings more than 30" in height.
11) Provide handrails at all stairs where there are four or more risers.
12) Provide lighting at all exterior landings.
13) NOTE: Plans that specifically address items 8 and 9 must be re-submitted before this
project can move forward for Planning Commission action.
