Date: September 25, 2009 �,i� , Wi liam Meeker, ommunity Development Director RESOLUTION APPROVING CATEGORICAL EXEMPTION AND DESIGN REVIEW AMENDMENT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made far Design Review Amendment for proposed changes to a previously approved new, two-story sinqle famiiy dwelling with an attached qaraqe at 1452 Drake Avenue, zoned R-1, Ginkqo Burlinqame LLC, property owner, APN: 026-042-140; WHEREAS, said rnatters were heard by the Planning Commission of the City of Burlingame on Seqtember 14, 2009, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NQW, THEREFORE, it is RESOLVEQ and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section: 15303 (a), which states that construction of a limited number of new, small facilities or structures including one single family residence or a second dwelling unit in a residential zone is exempt from environmentai review. In urbanized areas, up to three single-family residences maybe constructed or converted under this exemption, is exempt from environmental review. 2. Said Design Review Amendment is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Design Review Amendment are set forth in the staff report, minutes, and recording of said meeting. 3.
