Following conclusion of the public hearing, and after consideration of all public testimony, the information contained in the staff report regarding the appeal, and the record of the Planning Commission's proceedings regarding your requests; the City Councit, on a vote of 4-1 (with Council Member Nagel dissenting), voted to grant the appeal and reversed the Planning Commission's approval of the project; denying the requests without prejudice. A denial without prejudice provides the opportunity for you to reapply to the Planning Cammission for consideration of a revised project without payment of new application fees, within a reasonable timeframe (e.g. three months, or as determined by Planning Division staf�. The decision of the Gouncil is a final administrative decision pursuant to Code of Civil Procedure Section 1084.6. If you wish to challenge the decision in a caurt of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to State or Federal law.
