Applicants and Property Owners: Rich and Jenny Sargent Designer: same as applicant General Plan: Low Density Residential APN: 026-052-140 Lot Area: 6,000 SF Zoning: R-1 Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301 (a) which states that interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveniences are exempt from environmental review. History: On June 10, 2013 the Planning Commission approved an application for Conditional Use Permits to 1) convert an existing workshop in an accessory structure to a home office and 2) for a window located within 10'-0" of the rear property line at 1430 Drake Avenue, zoned R-1 (see attached June 10, 2013 Planning Commission Minutes). A building permit was issued for the conversion and the work was completed in August 2013. The applicant is now proposing to 1) relocate the existing home office into an existing storage room, 2) convert the previously approved home office to an accessory living quarter (au pair room) and 3) add a toilet and a shower in an accessory structure. Project Description: The existing property consists of a single family dwelling and an accessory structure which contains an oversized one-car garage (374 SF), storage room (136 SF) and home office (153 SF). The existing accessory structure measures 663 SF in area. With this application, the applicant is proposing to relocate the existing home office into an existing storage room in the accessory structure and to convert the existing home office to an au pair room (considered to be an accessory living quarter) (see existing and proposed floor plans on sheets 3 and 4, date stamped October 6, 2015). A bathroom containing a sink, toilet and shower is also proposed and would be accessible from both the au pair room and home office. The applicant is requesting approval of conditional use permits for the accessory living quarter use (au pair room) and toilet and shower within an accessory structure. Since a cooking unit is not proposed as part of this application, it is not considered to be a secondary dwelling unit. Other than installing a new exterior access door into the au pair room, there is no work proposed to the exterior of the existing garage. The applicant is requesting the following applications: ■ Conditional Use Permit to relocate the existing home office into an existing storage room in the accessory structure and to convert the existing home office to an au pair room (considered to be an accessory living quarter) (Code Section 25.60.010 (m)); and ■ Conditional Use Permit for a toilet and shower in an accessory structure (Code Section 25.60.010 (j)). Staff Comments: See attached memos from the Building, Parks, Fire and Stormwater Divisions. Planning staff would note that because of the nature of the request, it was determined that this application could be brought forward directly as a Regular Action Item. If the Commission feels there is a need for more study, this item may be placed on a subsequent action calendar for a second review with direction to the applicant. Conditional Use Permits 1430 Drake Avenue Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; (b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Suggested Conditional Use Permit Findings: That because the home office, au pair room and bathroom (containing a sink, toilet and shower) are located within an existing accessory structure and the uses are consistent with those found in a single family residential area, the use will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; and that the home office and accessory living quarter are uses that are consistent and compatible with uses found in a single family residential area and therefore will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title, the project is found to be compatible with the requirements for a Conditional Use Permit. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Division and date stamped October 6, 2015, sheets 1 through 7; 2. that the accessory structure shall only include a garage, home office and au pair room (accessory living quarter) with a toilet and shower, as shown on the plan date stamped October 6, 2015; 3. that if the accessory structure is demolished or the envelope changed at a later date the Conditional Use Permits as well as any other exceptions to the code granted here will become void; 4. that the conditions of the Building Division's October 7, 2015 and September 10, 2015 memos, the Park Division's September 17, 2015 memo, the Fire Division's October 7, 2015 memo, the Fire Division's September 23, 2015 memo and the Stormwater Division's September 14, 2015 memo shall be met; 5. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 6. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; and 2 Conditiona/ Use Permits 1430 Drake Avenue 7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013 Edition, as amended by the City of Burlingame. Hurin noted that two letters from adjacent neighbors in support of the application were provided after preparation of the staff report in support of the project. Hurin presented the report, reviewed criteria and staff comments. Seven (7) conditions were suggested for consideration. Commissioner Yie noted that she had talked to the applicant and visited the property. She also saw Commissioner Terrones at the property. Commissioner Terrones noted that he visited the site prior to and was pointed to the area of the application but did not discuss the merits with the applicant. All other Commissioners had visited the subject property. Commission questions: Would they be allowed to include a toilet? (Hurin: They would need to request a Conditional Use Permit to add a toilet, bath or shower. The sink is allowed by right.) Are there limitations on the square footage, which is why the applicant did not include a toilet? (Hurin: No, this is what the applicant applied for.) Vice Chair Davis opened the public hearing. Jenny Sargent represented the applicant: ■ Wanted to make existing room in the current house for visiting family members, so wanted to move the home office/recreation room to the back of the garage. There is an existing room there now but it requires finishing. ■ Was not planning to put in a bathroom. Just wanted to have a sink for making coffee. ■ Did not want to make it bigger than proposed — did not want to reduce the size of the garage. Wanted to maintain the storage area for storage of bikes. Wanted to keep office small and continue to use the other room for storage. ■ Back yard is very private so does not think enlarging window is going to affect anyone. Even though it is close to the property line in the back, the back yard is elevated so people walking by in the alley would not be able to see over the fence. Nobody would see that there is a window there. Commission comments: Would encourage to put a door where the window is, and eliminate the need to go through the storage room to get to the office. Right now it is a workshop — when it says "home office" this would be normal office-type activities to support the business. So conceivably we're comparing a workshop that could have power tools, to passive office activities in terms of impacts to neighbors. Public comments: None. There were no further comments and the public hearing was cfosed. 0 CITY OF BURLINGAME PLANN/NG COMMISS/ON — Approved Minutes June 10, 2013 Commission comments: There does not appear to be any neighborhood impact. The easement is low, the lot is elevated. It is far enough removed fram anyone eise. It's a good use of the space too. The motion was seconded by Commissioner Terrones. Discussion of motion: lf he decides to take the suggestion to replace the window door, that could come back as an FYI. (Hurin: lt would not necessarily require him to come back since it is not necessarily a use issue.) The placement of the window is already within 10 feet. (Hurin: Even if the door has glazing it is still covered under the Conditional Use Permit.) Vice Chair Davis called for a voice vote on the motion to approve. The motion passed 6-0-1-0. (Commissioner Sargent recused). Appea/ procedures were advised. This item concluded at 7:47 p.m. Chair Sargent returned to the dais. Chair Sargent stated that in the lobby he spoke to a neighbor of 2600 Summit Avenue (ltem 6) and wanted to know if the neighbor could speak on the item even though the item has been continued. City Attorney Kane indicated that they will have an apportunity to speak when the item is reviewed at the next meeting, but that it is at the discretion of the Chair whether to allow comments in advance. Both my wife and I work full time and wish to engage an au pair to care for our two children as many of our neighbors have done. Our house is very small by neighborhood standards — only 1,470 square feet on a lot that is zoned for up to 3,000 square feet of living space. We felt that converting the one of the rooms off our garage into a sleeping space would have less of an impact on the neighborhood than adding on to our house or building a second story. Furthermore, our back yard is well shielded from our neighbors by thick trees and foliage and neighboring houses are situated in such a way that they have almost no view of the area affected by this permit. 2. How will the proposed use be located and conducted in accordance with the Burlingame General Plan and Zoning Ordinance? This is an existing structure in an R1 zone, and the Planning Commission granted a conditional use permit to use the rooms behind the garage for recreational purposes in 2013. This use permit was supported by the neighbors and there have been no complaints made to the city related to this use. The two uses requested in this application are specifically allowed by the zoning code with use permits, and if granted, the improvements on our property will still be significantly under the zoning limits for this size lot: 1,759 square feet of conditioned living space with 2.5 bathrooms where the maximum allowed is approximately 3,000 square feet that typically include 4 or 5 bathrooms. Additionally, this use is consistent with similar uses recently approved in our neighborhood: in 2014, the Planning Commission approved conditional use permits for a recreational use and full bathroom in an accessory structure. Adding a request for accessory living quarters to our application represents a small intensification of use compared to those in the neighborhood, but our au pair will be spending most of her waking hours with our family in the main house so this room will be mostly for sleeping and it will not contain any cooking facilities. 3. How will the proposed project be compatible with the aesthetics, mass, bulk and character of the existing and potential uses on adjoining properties in the general vicinity? This application proposes to work within the existing structures on the property.
