Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (a) which states that interior or exterior alterations involving
such things as interior partitions, plumbing, and electrical conveniences are exempt from environmental review.
History: On June 10, 2013 the Planning Commission approved an application for Conditional Use Permits to
1) convert an existing workshop in an accessory structure to a home office and 2) for a window located within 10'-0"
of the rear property line at 1430 Drake Avenue, zoned R-1 (see attached June 10, 2013 Planning Commission
Minutes). A building permit was issued for the conversion and the work was completed in August 2013.
On November 9, 2015, the Planning Commission approved an application for Conditional Use Permits to 1) relocate
the existing home office into an existing storage room, 2) convert the previously approved home office to an
accessory living quarter (au pair room), and 3) add a toilet and a shower in an accessory structure (see attached
June 10, 2013 Planning Commission Minutes). This work was not completed.
The applicant is now proposing the following changes to the existing accessory structure: 1) reduce its overall size,
2) reconfigure the previously approved floor plan, and 3) add a new window and skylight.
Project Description: The existing property consists of a single family dwelling and an accessory structure which
contains an oversized one-car garage (374 SF), storage room (136 SF) and home office (153 SF). The existing
accessory structure measures 663 SF in area.
As noted above, in November 2015 the Planning Commission approved Conditional Use Permits for home office
and accessory living quarter (au pair room) uses, as well as a toilet and shower within an existing accessory
structure. Planning staff notes that since a cooking unit is not proposed as part of this application, it is not
considered to be a secondary dwelling unit. With this application, the applicant is proposing the following changes
to that approval:
1. Reduce the overall size of the accessory structure by 248 SF (from 663 SF to 415 SF). This consists of
reducing the oversized one-car garage to the required minimum parking space (10' x 20') and reducing the
size of the office and au pair room from 289 SF to 203 SF. Lot coverage on the site will be reduced from
2,133 SF (35.5%) to 1,885 SF (31.4%) where 2,400 SF (40%) is the maximum allowed.
2. Reconfigure the previously approved floor plan layout (see revised Floor Plan, sheet 4, date stamped March
14, 2016).
3. Replace and relocate an existing window along the right side of the accessory structure and add a new
skylight; the newwindow and skylight are located in the office. Conditional use permits are required forthe
new window and skylight since they are located within 10'-0" of the right side property line. The applicant
notes that the proposed window along the right side of the accessory structure will be screened by existing
vegetation (see photograph attached to the Conditional Use Permit Application).
Conditional Use Permit Amendment and Conditional Use Permits
The applicant is requesting the following applications:

■ Conditional Use Permit Amendment for changes to a previously approved application for accessory living
quarters and a toilet and shower in an existing accessory structure;
• Conditiona� Use Permit for a window located within 10'-0" of a property line (existing window to be replaced
and relocated along right side property line is located at property line) (Code Section 25.60.010 (i)); and
■ Conditional Use Permit for a skylight located within 10'-0" of a property line (proposed skylight is located
3'-0" from the right side property line) (Code Section 25.60.010 (i)).
Staff Comments: Planning staff would note that because of the nature of the request, it was determined that this
application could be brought forward directiy as a Regular Action Item. If the Commission feels there is a need for
more study, this item may be placed on a subsequent action calendar for a second review with direction to the
applicant.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements
in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience;
(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to
secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Suggested Conditional Use Permit Findings: That because the home office, au pair room and bathroom
(containing a sink, toilet and shower) are located within an existing accessory structure, the uses are consistent with
those found in a single family residential area, the proposed window along the right side of the accessory structure
will be screened by existing vegetation, and the proposed skylight is on a flat roof, the use will not be detrimental or
injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general
welfare or convenience; and that the home office and accessory living quarter are uses that are consistent and
compatible with uses found in a single family residential area and therefore will be located and conducted in a
manner in accord with the Burlingame general plan and the purposes of this title, the project may be found to be
compatible with the requirements for a Conditional Use Permit.
Planning Commission Action:
The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division and date stamped
March 14, 2016, sheets 1 through 7;
2. that the accessory structure shall only include a garage, home office and au pair room (accessory living
quarter) with a toilet and shower, as shown on the plan date stamped March 14, 2016;

3. that if the accessory structure is demolished or the envelope changed at a later date the Conditional Use
Permits as well as any other exceptions to the code granted here will become void;
4. that the conditions of the Building Division's October 7, 2015 and September 10, 2015 memos, the Park
Division's September 17, 2015 memo, the Fire Division's October 7, 2015 memo, the Fire Division's
September 23, 2015 memo and the Stormwater Division's September 14, 2015 memo shall be met;
5. that demolition or remova� of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
6. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit; and
7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame.

Since the Planning Commission approved our project in November 2015 we have spent quite a bit of
time thinking about how we would use the space of our nanny room and home office as well as how the
accessory structure housing them interacts with the rest of our property.
One of the many demands of our two growing boys (aged two and five) is for outdoor play space. Our
lot is small, only 6,000 square feet, and the existing garage/office structure takes up 633 square feet of
it. We feel we can best meet the needs of our family for years to come by increasing the amount of
open space in our back yard while still maintaining adequate space for an au pair room and home office.
To this end, we feel we can reduce the overall size of the building by 20 percent while still preserving a
standard parking space and having adequately size accessory rooms.
An added benefit to this change is that the smaller building will have less of an impact on our neighbors.
Attached is a letter from the neighbor adjacent to our garage stating that they have no objection to the
proposed project.
There will be no change in off street parking on our property. The current garage, though oversized for
a one car garage, is not wide enough to fit two cars. Our proposed project revision retains the one code-
compliant covered parking space in the reconfigured garage as well as an uncovered parking space in
the driveway.

Planning Commission in making the decision as to whether the findings can be made for your

1. Explain why the proposed use at the proposed location will not be detrimental or injurious
to property or improvements in the vicinity or to public health, safety, general welfare or
convenience.
The proposed plan includes moving an existing window four feet closer to the rear property line.
As shown in the attached photo, the current window is not visible from neighboring properties
since it is shielded by a tree. This change will move it further behind the tree and further from the
house most potentially affected, 1420 Drake Avenue. This area of our property is heavily
wooded and adjacent to a utility easement which will further serve to shield the window and
skylight from neighboring properties. The new skylight is proposed in the ceiling of the office
which will be used primarily during the daytime, minimizing the amount of glare and light
emanating from it.
2. How will the proposed use be located and conducted in accordance with the Burlingarr�e
General Plan and Zoning Ordinance?
Both the window and skylight will increase the enjoyment of the previously approved home
office. A home office was approved in this location as part of a CUP in 2013 and there have
been no neighbor complaints.
3. How will the proposed project be compatible with the aesthetics, mass, bulk and eharacter of
the existing and potential uses on adjoining properties in the general vicinity?
There will be minimal if any impact on neighboring properties as discussed in answer #1. The
skylight will be flat in style for a low profile look and include an anti-reflective treatment to
reduce glare.

NOTE: A condition of this project approval is that the Demolition Permit will
not be issued and, and no work can begin (including the removal of �
building components), until a Building Permit has been issued for the
project. The property owner is responsible for assuring that no work is
authorized or performed.

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantiat evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA 15301 (a) which states that interior or exterior alterations involving such
things as interior partitions, plumbing, and electrical conveniences are exempt from
environmental review, is hereby approved.
2. Said Conditional Use Permit Amendment and Conditional Use Permits are approved subject to
the conditions set forth in Exhibit "A" attached hereto. Findings for such Conditional Use Permit
Amendment and Conditional Use Permits are set forth in the staff report, minutes, and recording
