Since there was no appeal to or suspension by the City Council, the April 11, 2016, Planning
Commission approval of your application for a Conditionai Use Permit Amendment and Conditional
Use Permits became effective April 21, 2016. This application for changes to a previously approved
application for accessory living quarters and a toilet and shower in an existing accessory structure
and for a new window and skylight in an existing accessory structure at 1430 Drake Avenue, zoned
R-1.
The April 11, 2016, minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division
and date stamped March 14, 2016, sheets 1 through 7;

that the accessory structure shall only include a garage, home office and au pair room
(accessory living quarter) with a toilet and shower, as shown on the plan date stamped
March 14, 2016;
that if the accessory structure is demolished or the envelope changed at a later date the
Conditional Use Permits as well as any other exceptions to the code granted here will
become void;
4. that the conditions of the Building Division's October 7, 2015 and September 10, 2015
memos, the Park Division's September 17, 2015 memo, the Fire Division's October 7,
2015 memo, the Fire Division's September 23, 2015 memo and the Stormwater Division's
September 14, 2015 memo shall be met;
5. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management
District;

6. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit; and
7. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2013 Edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department.
This approval is valid for one year during which time a building permit must be issued. An extension of
up to one year may be considered by the Planning Commission if application is made before the end of
the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If yau wish to cha►lenge the decision in a court of competent jurisdiction, you must do so within
90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
