Since there was no appeal to or suspension by the City Council, the November 13, 2018, Planning
Commission approval of your application for a Conditional Use Permit and a Conditional Use Permit
Amendment became effective November 26, 2018. This application was for non-retail service use with
supplemental parking in the drainage easement at 1846 and 1860 Road, zoned RR.
The November 13, 2018, minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped October 3, 2018, sheets A0.0 to C3.0 and sheet EXH; including two new
landscape trees on Rollins Road;
2. that the business owner shall apply for a Burlingame Business License prior to submitting to
the Building Division for the required Building permit;
3. that the total number of buses to be parked or stored on the site at 1860 Rollins Road shall
not exceed 92 buses and that all vehicles dispatched from and arriving to the site will utilize
the access to U.S. Route 101 at Millbrae Avenue; and that any changes in operation, floor
area, and/or use at either 1846 Rollins Road or 1860 Rollins Road shall require an
amendment to this application;
4. that upon submittal of the required building permit for both sites, the applicant shall provide
a complete lighting plan for the drainage easement area at 1860 Rollins Road, including
compliance with BMC Section 18.16.030; and that no buses or personal vehicles shall be
stored or parked on site at 1860 Rollins Road until a final inspection of the building permit is
completed and approved;
5. that no buses or personal vehicles associated with the business operations shall queue on
Rollins Road or block any portion of the public right-of-way at any time; and that
documented non-compliance with this condition will result in re-evaluation or revocation of
the approved Conditional Use Permits;

6. that the existing signage posted on site at 1860 Rollins Road denoting that the area is
subject to flooding shall remain in place;
7. that no fencing at 1860 Rollins Road shall obstruct existing flow of water into and through
the easement from the adjacent parcels;
8. that during any flood situations, that all the vehicles parked at 1860 Rollins Road shall be
relocated and shall be the responsibility and liability of the applicant and/or property owner;
9. that the applicant and property owner execute a separate hold-harmless and
indemnification agreement in regard to the proposed parking at 1860 Rollins Road, as
supplemental parking for the dispatch facility at 1846 Rollins Road, and that the agreement
shall be in a form approved by the City Attorney and executed prior to issuance of the
permit); this agreement shall be recorded by the City in the Official Records of the Recorder
of San Mateo County;
10. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;
11. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
12. that both 1846 Rollins Road and 1860 Rollins Road shall be maintained regularly and any
loose trash or litter removed from the property;
13. • that all runoff created during construction and future discharge from the site will be required
to meet National Pollution Discharge Elimination System (NPDES) standards;
14. that if the approved uses on the two sites, including a dispatch center at 1846 Rollins Road
and supplemental parking for the dispatch center at 1860 Rollins Road, are discontinued or
replaced the City of Burlingame Planning Division shall be notified by the business owner
and/or the property owner and the conditional use permits as well as any other exceptions
to the code granted here will require an amendment or may become void; and
15. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2016 Edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department.
This approval is valid for one year during which time a building permit must be issued. An extension of
up to one year may be considered by the Planning Commission if application is made before the end of
the first year.

The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within
90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.

Hello,
It has recently come to our attention that there is a possible discrepancy in the application processed at 1846 Rollins
Road and 1860 Rollins Road.
Please don't be alarmed as the issue does not appear to jeopardize the approval of the CUPs. However, the parcels
involved in the application do need clarification and possibly correction.
If you refer to the attachment, you will see that there were four �4) parcels processed as part of the application. These
parcels are designated in orange (1846 Rollins/ APN: 025-169-240) and in pink (1860 Rollins/ APNs: 025-169-300. -310, -
320.
This parcel information was taken from the application plans and forms and from the previous approvals in place for
1860 Rollins (including the 1997 approval for EI Rancho vehicle storage and the 2001 approval for the Pacific Bell
dispatch vehicle storage.
However, when the project plans are viewed it appear that a 5th parcel may have been included in the site
information? This parcel is highlighted in GREEN on the attached parcel map. The APN: 025-169-998. This parcel is not
owned by Rollins Partners LLC and does not appear to have been part of the history of use for 1860 Rollins Road. This
parcel could be similar to the 6th parcel, shown in blue on the attached map APN: 025-169-997 which is shown on the
project plans but labeled as Union Pacific Easement. This easement appears to also be shown on the plans as PART of
the 1860 Rollins Road property and appears to have been used for vehicle storage, however the parcel is not owned by
Rollins Partners LLC.
In light of these discrepancies, can you please clarify the following:
1. Please list all of the parcels that are part of the FB dispatch operations;
2. Please provide a site plan that clearly delineates all of the parcels for 1846 and 1860 Rollins and the
two parcels not owned by Rollins Partners LLC and indicated above (APNs: 025-169-997, and -998);
3. Please indicate on the site plan the property lines for the property owned by Rollins LLc (1846 Rollins
Road- which appear to be one parcel) and owned by Rollins Partners LLC (1860 Rollins- which appears
to only be 3 parcels);
4. Any easements- including PG& E and Union Pacific should be shown on the site plan- a licensed survey
may be necessary; and
5. Provide on the site plan the dimensions for all of the parcels involved in the project.
Thank you and once this information is clarified, I can tell you if it is necessary and how we can proceed to correct or
modify the approval that is recorded.

HOLD HARMLESS AGREEMENT
IN FAVOR OF THE CITY OF BURLINGAME
Facebook, Inc. [hereinafter Tenant], tenant of the property located at 1846 & 1860
Rollins Rd., City of Bu�•lingame, County of San Mat.eo, State of California. and as more
particularly described in Exhibit A hereto [hereinafter Property], on behalf of its heirs,
successors, beneficiaries, and assigns hereby agrees as follows:
WHEREAS, the Tenant warrants that it leases the Property; and
WHEREAS, improvements are to be constructed on the Property,
NOW, THEREFORE, IT IS AGREED:
I. Tenant hereby releases the City from any and all responsibility for the Improvement of
parkin� lot and entry driveways at property located at 1846 & 1860 Rollins Rd., City of
Burlingame. Tenant warrants and agrees that neither the City nor any of its officers, employees,
contractors, agents, or volunteers has played any role whatsoever in directing, instructing, or
advising Tenants' Improvement design, and these choices were made based solely on Tenant's
own design and evaluation after consulting as Tenant solely decided with Tenant's own retained
professionals. Tenant has not relied on City, its officers, employees, contractors, agents, or
volunteers in any way in deciding to proceed with the Improvements as part of and as necessary
with respect to, the construction on the Property or to execute this Agreement.

employees against, and will hold them and each of them harmless from any and all actions,
claims, damages to persons or properties, penalties, obligations, and liabilities, including any

the location, installation, operation, existence, and maintenance of the Improvements during
work. Provided, however, that this provision does not apply to claims, loss, liability, damage, or
expense arising from a) the sole negligence or willful misconduct of the City or its agents,
servants, or independent contractors who are directly responsible to the City. This provision is
inserted to comply with California Civil Code section 2782, and shall not affect the validin� of
any insurance contract, workers compensation, or agreement issued by an admitted insurer as
defined by the Insurance Code.
