Date RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for a Conditional Use Permit to add retail sales of alcoholic beveraqes at 1846 Rollins Road zoned RR (Rollins Road); 1846 Rollins LLC, propertv owner, APN: 025 169-240; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March 9, 2015, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: It is hereby found that the project set forth above is Categorically Exempt from environmental review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. 2. Said Conditional Use Permit is approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Conditional Use Permit are set forth in the staff report, minutes, and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. �v��,�-� � �.- Chairman I, �%��W L'��n S , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 9th dav of March, 2015 by the following vote: 1846 ROLLINS RD. - RESO 12 -2015 AYES: Bandrapalli, DeMartini, Gum, Loftis Sargent, Terrones NOES: None ABSENT: Yie RECUSED: None Secretary EXHIBIT "A" Conditions of approval for Categorical Exemption and Conditional Use Permit 1846 Rollins Road Effective March 19, 2015 that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 10, 2015, site plan, parking plan, and floor plans; 2. that any changes in operation or the floor area used for retail sales shall be brought to the Burlingame Planning Division for review and if needed, to the Planning Commission for approval; 3. that the conditions of the Fire, Public Works, and Parks Divisions December 31, 2015 memos shall be met; 4. that the approved retail alcohol sales use shall not include tastings or samples; Conditions of Approval Suqqested by the Burlinqame Police Department: 5. no noise shall be audible beyond the area under the control of the licensee (s) as defined on the ABC-257; 6. the petitioner shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control; 7. graffiti shall be removed from the premises and all parking lots under the control of the licensee within seventy-two (72) hours of the application. !f the graffiti occurs on a Friday or weekend day, or on a holiday, the licensee shall remove the graffiti within seventy-two (72) hours following the beginning of the next weekday; 8. the exterior of the premises shall be equipped with lighting of sufficienf power to illuminate and make easily discernible the appearance and conduct of all persons on or about the premises. Additionally, the position of such lighting shall not disturb the normal privacy and use of any neighboring residences; and 9. loitering (loitering is defined as "to stand idly about; linger aimlessly without lawful business') is prohibited on any sidewalks or property adjacent to the licensed premises under the control of the licensee as depicted on the ABC-257.
