Re: 1846 Rollins Road — Application for Conditional Use Permit
Dear Mr. Meisel,
Since there was no appeal to or suspension by the City Council, the March 9, 2015, Planning
Commission approval of your application for a Conditional Use Permit became effective March 19,
2015. This application was for retail sales of alcoholic beverages at 1846 Rollins Road, zoned RR.
The March 9, 2015, minutes of the Planning Commission state your application was approved with
the following conditions:

that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped February 10, 2015, site plan, parking plan, and floor plans;
that any changes in operation or the floor area used for retail sales shall be brought to the
Burlingame Planning Division for review and if needed, to the Planning Commission for
approval;
that the conditions of the Fire, Public Works, and Parks Divisions December 31, 2015
memos shall be met;
that the approved retail alcohol sales use shall not include tastings or samples;

no noise shall be audible beyond the area under the control of the licensee (s) as defined
on the ABC-257;
the petitioner shall be responsible for maintaining free of litter the area adjacent to the
premises over which they have control;

7. graffiti shall be removed from the premises and all parking lots under the control of the
licensee within seventy-two (72) hours of the application. If the graffiti occurs on a Friday or
weekend day, or on a holiday, the licensee shall remove the graffiti within seventy-two (72)
hours following the beginning of the next weekday;
8. the exterior of the premises shall be equipped with lighting of sufficient power to illuminate
and make easily discernible the appearance and conduct of all persons on or about the
premises. Additionally, the position of such lighting shall not disturb the normal privacy and
use of any neighboring residences; and
9. loitering (loitering is defined as "to stand idly about; linger aimlessly without lawful
business') is prohibited on any sidewalks or property adjacent to the /icensed premises
under the control of the licensee as depicted on the ABC-257.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do
so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.
