alteration of existing private structures involving negligible or no expansion of use beyond that existing at the
time of the lead agency's determination.
Summary: The applicant is proposing to legalize an existing second dwelling unit located at the rear of the lot
at 1570 Cypress Avenue, zoned R-1. The existing second unit is 300 SF in size and the San Mateo County
Appraisal Report indicates that the second unit was built before August 16, 1932. The existing one-story main
dwelling is 1586 SF and there is a 486 SF detached garage on site. The total FAR for the lot is 2,372 SF
(.32 FAR) where 3,900 SF (.52 FAR) is the maximum allowed. The existing garage (18'-0" x 27'-0") provides
one code compliant covered parking space and the existing driveway is 10'-0" x 96'-0" and provides 2 code
compliant uncovered parking spaces.
On May 2, 2002, Fred Cullum, Chief Building Official, and staff from the Planning Department performed a site
inspection of the second unit. Upon inspection, staff found that the interior of the second unit had been gutted.
Mr. Cullum was able to determine that the unit had been built before 1954, and that if approved by the Planning
Department, the applicant would need to submit for a building permit to comply with all State Codes (See
attached inspection report received May 14, 2002).
As part of the second unit amnesty program, notices are mailed to property owners within 100 feet of the property
corners. Any noticed property owner may call this item up for review by the Planning Commission. The
Planning Department received an appeal letter (see attached letter dated May 27, 2002) asking that the Planning
Commission review this item.
All other zoning code requirements have been met. The applicant is requesting the following:
• Special permit to legalize an existing second dwelling unit (CS 25.59).

Staff Comments: See attached. Planning staff would note tliat because of the nature of the request it was
determined that this project could be brought forward directly to the action calendar. If the Commission feels
there is a need for more study, this item may be so directed.
Performance Standards: In order to grant a Special Permit to legalize an existing second unit, the Planning
Commission must find that the following performance standards exist on the property (Code Section 25.59.060
a-e):
(a) On-site parking shall be provided for the primary dwelling unit as required by this code, and additional
parking for the secondary dwelling unit shall be at least one uncovered parking space, which may be provided
in tandem to another existing parking space;
(b) No more than two (2) persons may occupy the secondary dwelling unit;
(c) An owner of the subject property shall reside in at least one of the dwelling units at all times;
(d) The floor area of the secondary dwelling unit shall not exceed 640 square feet; and
(e) The secondary dwelling unit shall conform to the requirements of the California Health and Safety Code,
Section 17920.3, and the Uniform Housing Code as adopted by Section 17922.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be by resolution and include findings made for design review, and the reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
that the second unit shall meet all the requirements of the California Building Code and California Fire
Code, 1998 edition, as amended by the City of Burlingame;
2. that all building permits required to bring the second unit into compliance with the California Building
Code and California Fire Code, 1998 edition, as amended by the City of Burlingame shall be applied for,
and all construction work completed by, June 30, 2003;
that any alterations or repairs to the second unit shall meet the requirements of the Burlingame Municipal
Code Section 25.29; and
4. that no permits for work to the main single family dwelling on site are approved with this special permit.

propose to legalize is directly behind my mother's property @ 1575
Newlands Ave. It is our understanding that this area is not zoned for
rentals. If rented, this would be right at my mother's garage and
property line. We are concerned about the possible adverse effect a
rental unit would have on my mother's property. Please keep us apprised

SECONDARY UNIT INSPECTION

Inspection Date: May 2, 2002
Note: Inspection was performed to check for compliance with the minimum requirements of
State Health and Safety Code. On inspection, however, it was noted that the entire structure had
been gutted, with all interior finish and fixtures removed. Since the Health and Safety Code only
applies to existing conditions, all work will need to comply with current State Codes for new
construction.
Brief Description of Unit:
Unit is a detached structure to the rear of the detached garage. The unit consists of a living
room/kitchen, bedroom and bath. The apartment is approximately 300 square feet in area
including a full kitchen and a bath with shower. The unit has adequate setbacks from the garage
and side and rear property lines. Existing natural light and ventilation is satisfactory.
Recommendations:
If approval of the secondary unit is approved the applicant must prepare plans demonstrating
compliance with all current codes including energy conservation. Three sets of plans and two sets
of energy calculations must be submitted to the Building Inspection Division and requisite
permits and inspections procured.

RESOLUTION APPROVING CATEGORICAL EXEMPTION,
SPECIAL PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a special
permit for an existing, secondary dwellin unit at 1570 Cypress Avenue, zoned R-1, Brian Roche, property
owner, APN: 028-295-120;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
June 24, 2002, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19. Categorically Exempt per Section: 15301 — Class 1 consists of the repair or minor alteration
of existing private structures involving negligible or no expansion of use beyond that existing at the time of
the lead agency's determination.
2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such special permit is as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.
