Since there was no appeal to or suspension by the City Council, the October 28, 2002 Planning Commission
approval of your application for conditional use permits became effective November 4, 2002. This application
was to allow for construction of a new detached patio shelter/lanai at 1562 Cypress Avenue, zoned R-1.
The October 28, 2002 minutes of the Planning Commission state your application was approved with the
following conditions:
l. that the project shall be built as shown on the plans submitted to the Planning Deparhnent and date
stamped September 5, 2002, sheets A-1 and A-2, and that the patio shelter/lanai shall not exceed 180 SF
in area (7'-6"W x 24'-0'D) and shall not exceed an overall height of 10'-0" measured from adjacent grade
to the roof ridge, and a maximum plate height of 8'-0" measure from adjacent grade;
2. that the patio shelter/lanai shall have a stucco finish (painted gray) ai�u �hall contain blue ceramic tile for
roofing;
3. that the accessory structure shall only be used as a patio shelter/lanai and shall never be used for any kind
of storage, accessory living, or sleeping purposes; shall never include a kitchen, and shall not include
additional utility services and/or a toilet without an amendment to this conditional use permit;
4. that the property owner shall provide a survey of the existing portion of the accessory structure and the
property line, and it shall be accepted by the City Engineer before any building permits are issued; if any
part of the parlly completed structure is found to be across the property line it shall be removed;

that the accessory structure shall have three walls with the opening facing the rear yard; an amendment to
this permit shall be required if the accessory structure is to be enclosed on all four sides;
that the conditions of the City Engineer's September 9, 2002 memo, the Fire Marshal's September 10,
2002 memo, and the Recycling Specialist's September 9, 2002, memo shall be met; and

7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1998
Edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department. A
building permit for the detached patio/lanai must be issued within 60 days of this approval, or no later
than Fridav, January 3, 200�3
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.
