Project Summary:
Ken Ibarra, applicant, is requesting a parking variance to build an addition at 459 Cumberland
Road, zoned R-1. The existing 2579 SF two-story house has four bedrooms. There is also a
457 SF accessory structure in the rear yard. The City's last record of the existing accessory
structure showed it was a 240 SF (12' x 20') cabana. It is not known when the additiona1217
SF was added.
The proposed addition would extend the frst floor by 621 SF to provide a breakfast nook,
family room and laundry room. The existing 457 SF accessory structure (used for
storage/recreation) would be removed and replaced with a 280 SF building used solely for
storage. Additional property improvements include changes to the second floor and interior of
the garage, construction of a 595 SF deck and substantial landscaping in the rear yard. The total
floor area for both structures would increase by 444 SF (15%) from 3036 SF to 3480 SF.'
Floor area ratio requirements do not apply because the existing floor area would not increase
more than 50%.
The proposed family room is considered a bedroom for parking calculation purposes. This
increases the bedroom count to five, which requires three parking spaces, two of which must
be covereri. A parking variance is required because this proposal provides two parking spaces,

accessory structure. All existing and proposed deck areas excluded. If calculated from original
accessory structure size (240 SF), floor area is increasing by 661 SF (23.4%) from 2819 SF to
3480 SF. Floor area ratio requirements still would not apply. The structures would exceed
floor area requirements if proposed entirely as new.

The existing garage would be remodeled to provide an unobstructed interior length of 33' (x 10'
wide); the applicant notes that two vehicles could park in tandem in this area. He also notes that
two vehicles can be parked side-by-side both in the garage (15'-4" wide) and in the driveway.
The proposed 280 SF accessory building would be used for solely for storage. This is permitted
by code as long as the accessory structure size does not exceed 10% of the gross floor area
(GFA) of the main dwelling structure (CS 25.60.010-(1)). The proposed GFA of the main
structure would be 3200 SF, which would allow a 320 SF detached storage structure. The
proposed storage building is 8.8 % of the proposed GFA of the main dwelling. The applicant
notes that the accessory building provides storage space lost in providing garage length needed
to park two vehicles in tandem.

PARRING VARIANCE
459 CUMBERLAND ROAD
Required Findings for Variance:
In order to grant a variance the Planning Commission must find that the following conditions
exist on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or conditions applicable to the
property involved that do not apply generally to property in the same district;
(b) the granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety,
general welfare or convenience; and
(d) that the use of the property will be compatible with the aesthetics, mass, bulk and
character of existing and potential uses of properties in the general vicinity.
Planning Commission Action:
The Planning Commission should hold a public hearing. Affirmative action should include
findings made for the variance requested. Reasons for any action should be clearly stated. At
the public hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 27, 1994 sheets A.1, A.2, A.3, A.7 and landscaping plan;
2. that the 280 SF accessory structure shall be used solely for storage and that any use other
than storage shall require a special permit from the Planning Commission;
3. that the requirements of the Chief Building Official's memo (10/31/94) shall be met; and
4. that the project shall meet all the requirements of the Uniform Building Code and
Uniform Fire Code as amended by the City of Burlingame.

The following statements apply to the above mentioned variance application to allow an addition whicli
will result in the dwelling having iive bedrooms with one covered parking where two are required.

Cumberland Road lil:e many of the streets in the immediate area is made up of a mix of one and two-story homes, with at
least three bedrooms. The majority of the homes on Cumberland Road have two-car wide garages and driveways. About 20%
of the homes have one-car garages. The Nedwick's home is one of three on Cumberland Road which have garages which are
viewed as substandard for two cars and oversized for one car in width. The existing layout and width of these homes prevent
lhem from being expa�ided ro accommodate a standard two-car wide garage. However, it will be explained further below, that
the Nedwick property can accommodate two cars side-by-side in the existing gar�ge in addition to the room for two cars in
the driveway. The existing garage will be further cleared to even allow another car parked in the rear portion of the garage.
The other properties in the area with conforming two-car garages may have more space to park their two cars, but they do
not have the depth to park vehicles also in tandem. It has been the Planning Commission's experience in the past to allow
parking variances for properties with detached one-car garages and long side yard driveways for a[ least two open spaces in
tandem - with the exceptional circumstance that a conforming two-car wide garage%arport would not be feasible. The
exceptional circumstances at 459 Cumberland Road, although infeasible to conform with the required dimensions, can
accommodate more off-street parking than most properties in the azea.

The variance request will allow construction of a much needed family space which for today's lifestyles is necessary for any
four bcdroom home. The Nedwicks have invested a lot of time and energy to improve their home, both inside and outside,
and have formulated the proposed design in order to provide a kitchen / family room which takes full advantage of accessing
and viewing the backyard which, in addition, will be redone with a large deck area and new landscaping. Designing a family
room with a larger opening to the kitchen would adversely affect the views from the kitchen area. In addition, problems in
locating the laundry room would develop. One major reason for locating the laundry facilities within the addition was to
free-up the space in the garage for the purpose of storing vehicles in a tandem layout.
The underlying issue appears ro be the notion that the proposed family room can be viewed as potential bedroom, based on
the zoning ordinance definition. This thought is unreasonable due to the following: (a) the proximity of the family room to
the kitchen/nook and, (bj the proposal of a half-bath / launclry room. Surely, it is possible to construe that the family room
can be used as a large master bedroom, however, it would imply that the half-bath / laundry room would be illegally
converied to a larger bathroom / closet area. This home already has four substantial bedrooms, which is more than adequate
for the present owners - a��d should be the same for any future owners. What is sorely needed for this home is a family room
located adjacent to the kitchen and backyard, regardless of whether or not it can be defined as a bedroom. Ironically, the
existing living and dining rooms can both qualify as bedrooms under the same definition, however, according to the
planning staff, these rooms are exempt from such consideration. I feel it is time to give the same consideration to a space
which is clearly going to be used as a family room.

According to the Zoning Ordinance, the presence of five or bedrooms shall be supported with three off-street parking spaces,
of which two must be covered. The existing garage is 15 feet wide and 18 feet deep to a partition which separates a 14 foot
deep area for a toilet room; furnace, water heater and laundry facilities. The Nedwicks can currendy use the garage to park
two cars side-by-side. The drawings show the remaining depth of the utility/storage area to be opened fully to the garage in
order to park facilitate parking of an additional car. This would make the garage 33 feet deep, adequate to store at least two
vehicles in any configuration. In addition, the existing driveway is 18 feet wide by 22 feet deep, which is more than adequate
for [wo vehicles. Although the Nedwicks do not have five vehicles, it could be proven that five standard cazs can be stored
on the property.
C) Explain why the proposed z�se at the proposed locatial will not be detrimental or• ir:jurioits to p��operry
or improvemertts iri the viciniry and will not be detriniental to the public health, safety, gerier•al welfure or
co�:ve�:iefice.
The proposed project is a common occurrence for many properties area-wide. The expanded kitchen/nook, new family room
and accessory storage building will be one-story - preserving the privacy of adjacent properties, and will be replacing an
existing detached accessory structure (457 s.f.), in the same area of the property. These improvements along with the
landscaping master plan will only strengthen the values of the properties in the vicinity.
D) How will the proposed �roject be conipatible with the aesthetics, mass, bulk und char•ucter• of existing
und potential uses of properties in the general viciniry.
As n►entioned previously, the proposed project will al( be one-story and replace existing structures of similar size. The
design matches all of the characteristics of the existing traditional style in proportion and materials. The fact that it is one
story is thc best type of application and least imposing to the adjacent properties. The proposed project will almost be
unnoticeable.

The proposed accessory building which is shown on the submitted plans will be strictly used for storage
and not for habitable or recreational use. The existing detached accessory building, which is planned to
be demolished, includes 247 s.f. of recreation area and a separate 210 s.f. area used for storage of
gardening equipment, seasonal goods and family heirlooms. The proposed detached accessory building
(280 s.f.), will replace the existing storage area, and store the same items. The proposed "clearing-out"
of the existing utility/storage area for parking purposes, can account for the increase in size of the
proposed accessory building storage.

Galligan on Monday, November 28, 1994 at 7:30 P.M.

MINUTES - 1'he minutes of the November 14, 1994 meeting were amended to reflect the

Meeting, Saturday, Apri122, 1995, 9:00 A.M.
Also, Item #6, 459 Cumberland Road, p.4, paragraph 1, the text of Condition #4
adressing requirements for review of future bedroom additions is deleted because staff
misunderstood the motion and Condition #5 is renumbered #4. The minutes were
then approved.
AGENDA - Item #4, Pazking and Side Setback Variances at 1237 Balboa Avenue, zoned R-1, and
#5 Special Permit, Side and Rear Setback Variances at 1000 Vancouver Avenue,
Zoned R-1 are CONTINUED TO DECEMBER 12, 1994 PLANrTING
COMIVIISSION MEETING. The order of the agenda was then approved.
FROM THE FLOOR
Henrietta Clasmeyer, 2005 Carmelita Avenue, spoke about the thick grove of trees at the rear of 1001
Bernal and asked that the commission note the possibility of fire if more construction occurs. Commission
asked that she contact the applicant and if resolution is not possible, please come back to the commission
for the public hearing on December 12, 1994.

a variance. The house was already 3/4 torn down, just the'core of the existing house will remain and there
aze financial restraints which, is why the garage is being retained at its current location. There were no
other public comments and the �'ublic Hearing was``closed.

A letter expressing concern about�`the size and compatibility of new houses from Evelyn Thomas, 105
Dwight Way was read into the record:;;�Commissioners discussed the extension of the windows and stairs
into the setback. They also noted that'"if built as proposed this house would encroach on to the street much

� 6. PARKING VARIANCE FOR SINGLE STORY ADDITION AND ACCESSORY STRUCTURE AT
459 CUMBERLAND ROAD, ZONED R-1 (PETER AND PATRICIA NEDWICK, PROPERTY
OWNERS. AND KEN IBARRA APPLICANI�
Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria,
Planning Department comments, and study meeting questions. Four conditions were suggested for
consideration.
Commissioners discussed the code definition of a bedroom: i.e., four walls at least the window and a door.
Each dwelling is allowed a living room, dining room and kitchen. The number of parldng spaces is
determined by the number of potential bedrooms. Two covered and one uncovered parking space are
required for five or more bedrooms. The variance goes with the property. There was further discussion
of exceptions for family rooms. The City Attorney explained that code is written as it is because of the
problems caused by parking with large houses.
Chm. Galligan opened the public hearing. Ken Ibarra and Peter Nedwick stated that they want the addition
to fit into the existing house and to retain intact the front entrance and living areas adjacent to the garage.
Landscape drawings clarifying the new accessory structure in the rear yard were presented to the
commission. There were no other public comments and the Public Hearing was closed.

VEMBER 28, 1994
C. Jacobs noted this request is necessary for the preservation and property right of the applicant and is in
keeping with the general plan. She then moved approval of this application, by resolution, with the
following amended and added conditions: 1) that the project shall be built as shown on the plans submitted
•to the Planning Department and date stamped October 27, 1994 sheets A.1, A.2, A.3, A.7 and landscape
plan; 2) that the 280 SF accessory structure shall be used solely for storage that the only udlity to this
structure shall be electricity and that any use other than storage shall require a special permit from the
Planning Commission; 3) that the requirements of the Chief Building Officiai's memo (10/31/94) shall be
met; 4) that no other rooms meeting definition of bedroom shall be added without an amendment to this
variance; and 5) that the project shall meet all the requirements of the Uniform building code and Uniform
Fire Code as amended by the City of Burlingame.
There was further discussion on the practical reasons for the granting of a variance. This property now has
39.8 % lot coverage so there will not be much room for expansion without a variance and subsequent
review. The motion was then seconded by C. Ellis and passed on a 5-1-1 (C. Mink dissenting and C. Key
absent) roll call vote. Appeal procedures were advised.
The Commission adjourned for a 10 minute break at 8:55 P.M. and reconvened at 9:05 P.M.
