SUBJECT: FYI — REQUESTED CHANGES TO A PREVIOUSLY APPROVED DESIGN
REVIEW PROJECT AT 1244 JACKLING DRIVE, ZONED R-1.
Summary: An application for Design Review was approved by the Planning Commission on
October 14, 2008 for a second story addition at 1244 Jackling Drive (October 14, 2008 Planning
Commission Meeting Minutes attached). The Planning Commission also reviewed and approved an
FYI for window changes along the front elevation at their meeting on April 13, 2009. A building
permit was issued on May 29, 2009, and construction is currently underway.
On July 10, 2009, the applicant submitted an FYI to extend the roofline from the existing first floor
ridge to the new second floor ridge as seen from the rear and left side building elevations, to remove
a window from the new second story bathroom at the rear elevation, to add one new window in the
garage wall along the left side elevation and to add a skylight above the attic space off the master
bedroom addition. The applicant states that these changes were done to provide better drainage
from the roof along the second story bathroom wall, to create more storage space within the attic
area and to allow more daylight within the existing garage. Because of the added wall area along
the left side elevation and because of the addition of a skylight, an FYI is required for Planning
Commission review. There are no other changes proposed to the project. The proposed changes
are outlined in the attached letter from the applicant. Also attached are the originally approved and
proposed site plan, second level floor plan, rear elevation and left side elevation drawings, date
stamped July 10, 2009.
Planning staff would note that because of these minor revisions, it was determined that the project
could be reviewed by the Commission as an FYI item. If the Commission feels there is a need for
more study, this item may be placed on an action calendar for a second review and/or public hearing
with direction to the applicant.

Dear Members of the Planning Commission,
This letter is to inform you that there has been a change in the design for the previously approved
project for the Roepke residence at 1244 Jackling Drive. Planning Commission approval of the
Design Review application became effective on October 24, 2008. The application was for a
second story addition to an existing single family dwel�ing. Since the approval the following
changes occurred requiring planning commission review:
1. Extended the roofline from the existing ridge to the top of the new ridge to include part
of the new east bathroom wall.
2. Removed bathroom window from east wall.
3. Added one new window to the first floor north garage wall.
These changes were done to provide better drainage from the roof along the east bathroom wall,
to create more storage space within the attic, and to allow more daylight within the garage.
It is our belief that these changes maintain the overall appeal and design intent of the home.

Since there was no appeal to or suspension by the City Council, the October 14, 2008, Planning
Commission approval of your application for Design Review became effective October 24, 2008.
This application was for a second story addition to an existing single family dwelling at 1244 Jackling
Drive, zoned R-1.
The October 14, 2008 minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped July 28, 2008, sheets A1.1, A2.1, A2.2, A3.1 and L1.1, and date stamped August
13, 2008, sheets A3.2 and A3.3;

roof height or pitch, and ameunt or type of hardscape materials shall be s��ject to Planr:ng
Division or Planning Commission review (FYI or amendment to be determined by Planning

3. that any changes to the size or envelope of the basement, first or second floors, or garage,
which would include addirg or enlarging a dormer(s), shall require an amendment to this
permit;
4. that the conditions of the Chief Building Official's June 18, 2008 memo, the City Engineer's
June 25, 2008 memo, the Fire Marshal's June 23, 2008 memo, and the NPDES
Coordinator's June 22, 2008 memo shall be met;
5. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;

6. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall not
be modified or changed without the approval of the Planning Commission, or City Council
on appeal;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that
these venting details shall be included and approved in the construction plans before a
Building permit is issued;
8. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires afFected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
9. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2007 Edition, as amended by the City of Burfingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDfTION:
10. that prior to scheduling the framing inspection the project architect or residential designer,
or another architect or residential design professional, shall provide an architectural
cerfification that the architectural details shown in the approved design which should be
evident at framing, such as window locations and bays, are built as shown on the approved
plans; architectural certification documenting framing compliance with approved design
shall be submitted to the Building Division before the final framing inspection shall be
scheduled;
11. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height
of the roof ridge and provide certification of that height to the Building Department; and
12. that prior to final inspection, Planning Department staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has been
built according to the approved Planning and Building plans.
Reimbursement of the Design Review deposit will be processed and will be mailed to the property
owner under separate cover.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is
made before the end of the first year.

The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

Reference staff report dated October 14, 2008, with attachments. Senior Planner Hurin presented the
report, reviewed criteria and staff comments. Twelve (12) conditions were suggested for consideration.
Chair Cauchi opened the public hearing.

Commission comments:
Asked if there was there an aesthetic study of the change in the roofline (Skelton — no, applicant's
didn't want to make change).
Public comments:
None.
There were no further comments and the public hearing was closed.
Additional Commission comments:
■ Rotation of the gable would create a more visual impact upon the neighbors; would add to mass
along the Cockcroft's side of the properly; can support as designed; still some concern regarding
wrought-iron railing.
• Original proposal is the right way to go.
■ There was not a fair evaluation of the alternatives; the study that was done was not done in earnest.
■ No shadow evaluation of the rotated aable was performed; could havz a lesser impact upon the
neighbor; could be looked at a bit more closely.

The motion was seconded by CommissionerAuran.
Discussion of motion:
Commissioner Brownrigg agreed with Commissioner Vistica's comments regarding the lack of
analysis of the alternatives; not in favor of application at this time.
Chair Cauchi called for a voice vote on fhe motion and itpassed 5-2 (Commissioners Vistica and Brownrigg
dissenting). Appeal procedures were advised. This item concluded at 9:11 �.m,

Commissioner Yie recused herself from participating regarding Item 8 since she lives within 500-feet of fhe
property and is working with the applicant; she left the Council Chambers.
