Date Submitted: This project was submitted to the Planning Department after October 23, 1998 and
was reviewed under the R-1 District Regulations now in effect.
Summary: The applicant, Robert Alfaro, is requesting a hillside area construction permit to add an
attached single-car carport (298 SF) and a detached 10' -6" high storage shed (220 SF) at the rear of the
lot at 1827 Hunt Drive, zoned R-l. The storage shed is partially constructed. There are no other
changes to the main building proposed.
The total floor area of the existing two-story, seven-bedroom house is 4333.5 SF (0.22 FAR). The
proposed 298 SF carport addition and new 220 SF storage shed would bring the total floor area of the
house and accessory structure to 4851.5 SF (.24 FAR) (including the attached garage and covered
porch), where the allowed FAR is 7468 SF (.38 FAR). The carport addition will add a covered parking
space 9'-0" x 18'-0". There is a 20'-0" x 20'-0" attached garage which provides the required 2 covered
pazking spaces for the seven-bedroom house. Since the new carport is not a required parking space, it
does not have to meet the 10'-0" x 20'-0" dimensional requirements for covered parking. The 220 SF
shed will be used for storage. The zoning code allows storage of up to 10% of the area of the house
(463 SF allowed) without requiring a conditional use permit. The proposed storage shed meets all
accessory structure requirements.
Lot covera,ge would be increased to 3,516 SF (17.6%), which includes covered porches and accessory
structures (7960 SF, 40% allowed). The proposed height of the carport is 13'-10" and is below the
e�cisting roof height (26' +/-) of their house. The 10' x 22' storage shed has a plate height of 8' -6" (9' -
0" allowed) and an overall height from grade of 10'9" (15'-0" allowed). All zoning code requirements
have been met.
The hillside area construction permit was called up for review by a neighbor within 100' of the property.
The zoning code states that review for hillside area construction permits shall be based upon the
obstruction by the construction of the existing distant views of nearby properties. Emphasis shall be
given to the obstruction of distant views from habitable areas within a dwelling unit.

setback requirements because it is in the rear 30% of the lot.

5taff Comments: The City Engineer, the Chief Building Official and the Fire Marshal had no
comments on the project.
Study Meeting: At the Apri126, 1999 Planning Commission study meeting, the commission asked the
applicant to clarify the neighbor's comment about storage, what does the applicant intend to store in the
accessory structure. The applicant has answered in the attached response date stamped May 3, 1999.
The applicant states that the shed will be used to store pool supplies, pet food, and household items such
as ice boxes and camping supplies.
The commission also asked if the construction vehicles observed on the site because of construction or
were they being stored. The applicant notes that various trucks and construction equipment were being
used during 1998 because of extensive remodeling going on inside and outside the house. Remodeling
was completed in October of 1988, except for the storage shed and carport which are the subject of this
application. The commission asked it a building permit was issued for the storage shed. The applicant
notes that the storage shed was installed without a building permit because they were not aware such a
shed required a City permit. As it turned out, the structure exceeds 120 SF in area and requires a
building permit.

Hillside Area Construction Permit 1827 Hunt Drive
The commission asked for a copy of the municipal code section addressing limitations on parking trucks
on residential sites. Copies of C.S. 13.36.0065, parking of commercial vehicles prohibited in
residential districts, and C.S. 25.70.030 (3), parldng limitations for single family dwellings are atta.ched.
C.S.. 13.36.065 prohibits pazking of a tow truck, a dump truck or a commercial vehicle with gross
vehicle weight greater than 10,000 pounds on private property in a residential district. There is an
exemption of up to 30 days for vehicles used during construction. C.S. 25.70.030 (3) states that
vehicles shall not be parked between a structure and the front or side property line except in a garage,
driveway or other approved parking, and that inoperative vehicles, vehicle parts, boats and campers
shall not be stored or parked in driveways or between a structure and front or side property line.
Required Findings for Hillside Area Construction Permit: Review of a hillside area construction
permit by the Planning Commission shall be based upon obstruction by construction of the existing
distant views of nearby properties. Emphasis shall be given to the obstruction of distant views from
habitable azeas within a dwelling unit (Code Sec. 25.61.060).
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include findings. The reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department date
sta.mped March 19, 1999, sheets 1 through 3;
2, that any changes to the footprint, building height, window placement or building envelope shall
require an amendment to this Hillside Area Construction Permit; and
3. that the project shall meet all the requirements of the California Building and Fire Codes, 1995
edition, as amended by the City of Burlingame.

13.36.065 Parking of commercial vehicles
prohibited in residential districts.
(a) No person shall park or leave standing
on parking lot "H" between the hours of 6:00
p.m. and 8:00 a.m. or at any time on any street
or upon any private properly in a residential
district, a tow truck, a dump truck or a
commercial vehicle having a manufacturer's
gross vehicle weight rating of ten thousand
pounds or more.
(b) T'his section shall not apply to a
commercial vehicle parking or standing while
making pickups or deliveries of goods, wares or
merchandise, or for the purpose of delivering
materials to be used in the actual and bona fide
landscaping, grading, repair, alteration,
remodeling or construction of any building or
structure for which a building permit has been
obtained.
(c) This section shall not apply to parking
upon private property of such vehicles by a
licensed contractor, or of one such vehicle by an
owner-builder, for a period not to exceed thirty
continuous days, when such vehicle or vehicles
are used during the course of landscaping,
grading, repair, alteration, remodeling or
construction of any building or structure upon
such property for which a building permit has

25.70.030 Requirements for single-family
dwellings.
The following are parking requirements for
single family dwellings.
1. Parkingspace requirements. There shall be
at least one permanently maintained gazage or
covered carport available to park a car for each
single-family dwelling with the following further
requirements:
a. new construction with any number of
bedrooms shall provide two (2) covered off- street
parking spaces and one (1) uncovered off-street
parking space
b. existing single-family dwellings increased
in size to three or four bedrooms shall provide off-
street parking spaces to current code dimensions
for at least two (2) vehicles, one (1) of which must
be covered by a garage or carport;
c. a single-family dwelling hereafter increased
in size to five (5) or more bedrooms shall provide
off-street parking to current code dimensions for at
least three (3) vehicles, two (2) of which must be
covered by a garage or carport;
d. for the purposes of subsections b and c
above, an existing garage not less than eighteen
(18) feet wide and twenty (20) feet deep interior
dimension shall be considered to provide two (2)
covered off-street parking places.
2. Parking Aisles and driveways.
Covered parking spaces shall have a twenty-
four (24) foot back up area or be designed to be
entered or exited in no more than three (3)
maneuvers. All spaces must allow entry in three
(3) maneuvers in the forward direction.
3. Parking limitations:
a. a vehicle shall not be parked between a
structure and the front or side property line except
in a garage, driveway or other approved parking;
b. inoperative vehicles, vehicle parts, boats
and campers (as defined by section 243 of the
Vehicle Code) shall not be stored or parked in
driveways or between a structure and front or side
property line;
c. required covered pazking shall not be
provided in tandem configuration;
d. required uncovered spaces may be provided
in tandem configuration if such spaces are not
required for new construction and may extend:
(1) in areas with sidewalks, to the inner edge
of the sidewalk;
(2) in areas without sidewalks to five (5) feet
from the inner edge of the curb;
(3) in areas without either sidewalks or curbs,
to five (5) feet from the edge of pavement. (1941

This is in response to your notice regarding an application for a Hillside Area
Construction Permit to add an attached single car carport (298 square feet) and a detached
10'-6" high storage shed (220 square feet) at the rear of the lot at 1827 Hunt Drive, zoned
R-1. APN: 025-320-050.
Our property is located in close proximity to this proposed construction site. We object
to this proposal for the following reasons:
We believe that the construction is intended to accommodate heavy vehicles
and equipment used by the owner for large construction projects associated
with his business. Such vehicles were parked on Hunt Drive during the seven
month period of renovating the residential buildings and landscaping of the
property, prior to occupation. This heavy vehicle traffic disrupted the peace
and quiet of this residential neighborhood, especially when vehicles and
trailers were parked on the street overnight.
• My husband has recently undergone an operation for throat cancer and has a
permanent tracheotomy and cannot tolerate dust. He experienced discomfort
due to the dust during the construction period. We do not wish to forbear a
repetition of the occurrence during tne proposed construction.
• We do not feel that Commercial equipment and storage should be permitted to
be located in this R1 residential neighborhood.
I request that we be permitted to review full size plans of the proposal, as you suggested
in your notice. I feel thax our positions and objections in this matter are valid, and request
favorable consideration of the above.

RF.SOLVED, by the Planning Commission of the City of Burlingame that:

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
Ma,v 10� 1999 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1• On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15301, Class 1-(e) additions to existing structures provided the addition will
not result in an increase of more than 50 % of the floor area of the structures before the addition is hereby
approved.
2. Said hillside area construction permit is approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such hillside area construction permit are as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval categorical exemption and hillside area construction permit
1827 Hunt Drive
effective May 17, 1999
1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped March 19, 1999, sheets 1 through 3;
2. that any changes to the footprint, building height, window placement or building envelope
shall require an amendment to this Hillside Area Construction Permit; and
3. that the project shall meet all the requirements of the Califoznia Building and Fire Codes,
1995 edition, as amended by the City of Burlingame.
