MEMO TO: PLANNING COMMISSION

SUBJECT: SPECIAL PERMIT AMENDMENT TO REMOVE A CONDITION FOR
AN EXISTING 11' DIAMETER ANTENNA; AND A SPECIAL
PERMIT TO INSTALL A NEW 11' DIAMETER METAL SATEL-
LITE DISH ON THE ROOF OF AN EXISTING OFFICE BUILD-
ING AT 411 AIRPORT BOULEVARD. ZONED C-4
Applicant Robert Beggs, Comtel Video Services, Inc. and property
owner, Communication Workers of America are requesting a special
permit amendment to remove a condition of approval for an approved
il' diameter satellite dish antenna; and a special permit to
install a new 11' diameter metal satellite dish on the roof of an
existing office building at 411 Airport Boulevard, zoned C-4. The
proposed dish has a 2' base and will stand 13' above the roof to
the east of the existing satellite dish. The existing dish was
approved with a special permit in March, 1988 (Monroe letter of
March 8, 1988 with conditions of approval).
The applicant is requesting removal of one condition of approval
for the existing satellite dish. He has had difficulty screening
the dish. The original screen was destroyed in a storm and if the
second dish must also be screened a new larger screen will be
required which will create an excessive load on the roof (Robert
Beggs letter of August 27, 1991). He would like to delete
condition #5 of the 1988 permit "that three sides of the dish shall
be screened to a height equal to the height of the dish angled to
the highest elevation above the surface of the roof, this screening
to be painted a nonreflective color to match the air conditioning
equipment enclosure".
The new and existing satellite dishes are located on the side of
the building away from Airport Boulevard, 15' from the rear edge of
the building. The dishes will face toward the parking lot of the
adjacent office building (433 Airport Blvd.). The new dish will be
placed 15' from the rear wall of the building and 30' from the side
of the structure next to the driveway serving the Bay Park office
complex.
Staff Review
City staff have reviewed this application and had no comments.
Applicant's Letter
The applicant notes in his September 16, 1991 letter that they
require the second antenna to record programming from two sources
simultaneously. Without the second antenna they could not serve
their clients and would be forced to move from their current
offices.

They would also like to remove the requirement for screening the
original dish antenna. They built a screen that was damaged in a
storm. A new, larger, replacement screen designed by a structural
engineer, would place a tremendous weight on the roof. The
proposed screen would be 768 SF in area to screen an 11' diameter
dish antenna. No complaints have been made about the existing dish
antenna from the neighbors since the screen was destroyed by the
storm. The screen would be a greater visual object than the dish
itself .
Study Meetincx
At the October 28, 1991 study meeting the Planninq Commission had
a number of questions for the applicant. The commission asked how
visible the dish antennas will be from the area across the freeway.
The applicant has supplied photographs labeled A and B showing the
existing dish on the roof and the vegetation that obscures it from
view (November 4, 1991 letter from Robert Beggs with photos).
The commission also asked for more technical data on the use of the
second antenna. The applicant notes in his November 4, 1991 letter
that the second dish will receive and record network programming
for affiliate television stations in the Pacific that cannot
receive from the satellites directly. The stations are typically
affiliated with more than one network and the two antennas will
allow two different satellites to receive and record programs at
once. Without the second antenna many stations would have no
proqrams at all.
Findings for a Special Permit
In order to grant a Special Permit the Planning Commission must
find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of
this title;
(c) the Planning Commission may impose such reasonable conditions
or restrictions as it deems necessary to secure the purposes
of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.

Planninq Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and reasons for any action
clearly stated. At the public hearing the following conditions
should be considered:
1. that the second satellite dish shall be located on the roof as
shown on the plans submitted to the Planning Department and
date stamped September 18, 1991 Sheet One;
2. that the applicant or property owner shall be responsible for
an amendment to this use permit if future construction on any
adjacent property requires relocation of the dish antenna,
removal and reinstallation costs shall also be borne by the
applicant and/or property owner;
3. that the dish antenna shall be painted a nonreflective light
gray color and that this nonreflective surface shall be
maintained by the property owner;
4. that the project shall meet Uniform Building and Uniform Fire
Codes as amended by the City of Burlingame;
5. that this use permit shall include the satellite dish in-
stalled in 1988 and all the provisions of the March 8, 1988
use permit except that condition number 5, regarding a struc-
tural screen to be placed around the satellite dish, shall be
eliminated and no such screening shall be required for the
second satellite dish; and
6. that this use permit shall be reviewed for compliance with its
conditions in one year's time (November, 1992) and upon
complaint thereafter.

The photo labeled "A" was taken from Airport Boulevard from
the front of the building. As you can see, since our
original application, trees have just about obscured the view
of the dish. The photo labeled "B" was taken from the rear
of the building. As you can see, nature seems to be helping
us here, too.
You asked the location of the new dish. Please note the plan
view of the building which I submitted with my original
application. The new dish will be installed next to the
existing unit at the rear of the building.
The reason for our needing this second unit is that our
business is to record network programming for network
affiliate television stations in the Pacific that cannot
receive the satellites directly. As the stations for whom we
record are affiliated with more than one network, we need to
be able to receive and record programming from two different
satellites at once as programs are being sent. Without our
being able to do so, these stations would have no programs.
Please call on me at any time that I can answer any further
questions. Naturally, I will attend the Commission meeting
on November 12th and will be happy to answer any questions
personally.

STAFF REVIEW OF APPLICATION TO THE PLANNING COMMISSION

Dear Mr. Beggs:
Since there was no appeal to or suspension by �he City Council,
the February 22, 1988 Planning Commission approval,: of your
Special Permit application became effective March 8, 1988--.
The application was to allow a rooftop satellite dish antenna at
411 Airport Boulevard, zoned�C-4. The February 22, 1988 minutes
of the Planning Commission state your special permit was approved
with the following conditions:
1. that the conditions of the Chief Building Inspector�s
February 8, 1988 memo sha11 be met and that, if required,
the engineering and calculations shall include the visual
screen placed on three sides of the dish antenna; ,
2. that the "receive only" satellite dish antenna shall be
located on the roof as shown in the plans submitted to the
Planning Department and date stamped January 28, 1988;
3. that the applicant or property owner shall be responsible
for an amendment to this use permit if future construction
on any adjacent property requires relocation of the dish
antenna, removal and reinstallation costs shall also be
borne by the applicant and/or property owner;
4. that this dish antenna shall be painted a nonreflective

Installation of the antenna will require separate application to
the Building Department. This approval is valid for one year
during which time a building permit must be issued. One
extension of up to one year may be considered by the Planning
Commission if application is made before the end of the first
year.

Comtel Video currently records television programming for use
by television stations on Pacific Islands. In order to
continue to serve these clients we must erect a second small
satellite dish so that we may record programming from two
sources simultaneously.
We respectfully request the help of The Planninq Commission
for approval to install this second dish. For, without this
additional program source we would be unable to serve
our clients, forcing us to move our facility out of
Burlingame, something we would seriously regret.
We also ask your consideration to remove our original
requirement for a screen to cover three sides of this
installation. When I originally applied for approval to
install our dish I, not being a Civil Engineer, suggested to
the Commission that, if desired, we could screen the dish.
That was included in the permit. The building of a screen
has turned out to be a mammoth undertaking. One screen was
erected and damaged by a severe storm. The design was re-
engineered and result would be a huge structure which will
put many times the load on the roof than the dish itself.
We would be building an object having an area of 768 square
feet to screen a dish only 11 feet in diameteZ.
No complaints have ever been filed about our installation as
it stands. People have said they thought the small dish
looked much better on the roof than the huge screen. We are
hoping that you will agree.

The CITY OF BURLINGAME PLANNING COMMISSION announces the
following public hearing on Tuesday, the 12th day of November,
1991, at 7:30 P.M. in the City Hall Council Chambers located at 501
Primrose Road, Burlingame, California. A copy of the application

RESOLUTION APPROVING SPECIAL PERMIT AMENDMENT
AND SPECIAL PERMIT
RESOLVED by the Planning Commission of the City of Burlingame
that:
WHEREAS, application has been made for a snecial permit
amendment for an existinq antenna and special permit to install a new
satellite dish antenna on the roof of the existing office buildinct
at 411 Airport Boulevard (APN 026-363-290); Sproperty owner:
James W. Webb, TR, c/o Communication Workers of America, 1925 K Street
NW, Washington, DC 20006); and
WHEREAS, this Commission� held a public hearing on said
application on November 12, 1991 , at which time it reviewed and
considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Planning Commission that said special permit amendment and special
permit are approved, subject to the conditions set forth in Exhibit "A"
attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of San
Mateo.
