HomeMy WebLinkAbout411 Airport Boulevard - Staff Report+ +, � j�� P.C. 2/22/88 Item #5 MEMO T0: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: SPECIAL USE PERMIT FOR A ROOFTOP 11' DIAMETER SATELLITE DISH ANTENNA 13' ABOVE THE ROOF AT 411 AIRPORT BOULEVARD, ZONED C-4 Robert Beggs, representing Comtel Video Services, is requesting a special use permit in order to install an 11� diameter satellite dish on a 2� base on the top of the office building at 411 Airport Boulevard, zoned C-4 (Code Sec. 18.18.020-2). The proposed dish will stand 13' above the roof and will be placed behind the 6' high rooftop air conditioning equipment enclosure on the side of the building away from Airport Boulevard 30' from the rear edge of the building. The dish will face toward the parking lot of the office building behind. The dish will be placed 30' from the rear wall of the building and 40' from the side of the structure next to the driveway serving the Bay Park office complex. Staff Review City staff have reviewed this request. The Fire Marshal (February 1, 1988 memo) and City Engineer (February 1, 1988 memo) had no comments. The Chief Building Inspector (February 8, 1988 memo) comments that engineering and calculations on the roof of the building done by a licensed engineer will be required before a building permit can be issued. Planning staff would point out that the city has approved two additional buildings with heights of about 86' and a parking structure in the office complex behind 411 Airport Boulevard. These buildings will be placed in the area which is now at grade parking and may obstruct the reception of this antenna. (Note: Staff attempted to reach the applicant to discuss this matter but was unable to reach him.) Since the buildings as Phase II of the project have been approved, it would be the responsibility of this applicant to amend his use permit, if granted, and to relocate this satellite dish if future construction affects the reception of the satellite dish antenna. Applicant's Letter In his letter of January 20, 1988 Robert Beggs notes that Comtel's business is video taping television information for corporate clients who buy this service. He notes the antenna is a small one by satellite standards, 11� in diameter. Further he discusses the method of attachment to the roof. He comments an engineering report will not be required. (Note: See Chief Building Inspector�s memo under staff review stating that such engineering and calculations will be required.) a He feels that a rooftop installation is necessary for two reasons: the lack of space on the ground around the site and for protection from vandalism and theft. His installers indicate that people with ground mounted antennas make regular calls for repair from vandalism and to replace stolen items, even when the antenna is enclosed by security fencing. He notes that having his equipment out of operation would seriously affect his service. He feels the building location is "somewhat remote and infrequently patrolled by security services late at night and in the early morning." Since the building is in a commercially zoned area next door to a drive-in theater he does not think that the antenna will be offensive to the aesthetics of the area. (Note: The entire area is zoned C-4 Waterfront Commercial except the Drive-In site and Beach-Lang Roads which retain their original M-1 zoning.) Study Ouestions The Planning Commission reviewed this request at study on February 8, 1988 (Planning Commission Minutes, February 8, 1988). A number of questions regarding the proposed satellite dish antenna were raised and the applicant submitted two letters, February 6 and February 9, 1988, addressing them. The television antenna now on the rooftop extends 9' above the surface of the roof. This antenna is mounted toward the front (Airport Boulevard) side of the building. The dish antenna (13' in height) is proposed to be placed toward the rear of the building. The existing 6' mechanical enclosure will help to block the view of the antenna, it will not hide the dish antenna. No taller enclosure of the dish antenna is proposed. The applicant reviews the existing adjacent land uses addressing the fact that they all are sufficiently removed that the dish should not affect their views or aesthetics. The applicant proposes that he would not object to a requirement to place a screening around the dish antenna. He attached a sketch showing an enclosure around three sides of the dish, leaving the fourth facing the rear open so that the antenna can receive signals. The screen can be any height that the Commission would require. It would be made out of 2x4�s and plywood bolted to the roof . The dish antenna enclosure can be painted the same color as the mechanical equipment enclosure so that it will blend into the structures on the roof. Addressing placing the antenna on the ground, particularly in the patio area, the applicant states that the reception orientation is not appropriate from the patio area; other space at ground level is very limited on this site. Security is a primary concern to the applicant. This may not be a problem with a hotel where there is a fair level of activity all the time, but this site is quiet and dark late at night. He is concerned that since his is a small 3 company he cannot afford the losses and his insurance company will not be willing to pay for losses repeatedly. The applicant would like Planning Commission approval with the understanding that he would work out the screening after the fact. He has only one client at the moment and that client is anxious for him to begin to deliver service. Plannina Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 1. that the conditions of the Chief Building Inspector�s February 8, 1988 memo shall be met and that, if required, the engineering and calculations shall include the visual screen placed on three sides of the dish antenna; 2. that the receive only satellite dish antenna shall be located on the roof as shown in the plans submitted to the Planning Department and dated January 28, 1988; 3. that the applicant or property owner shall be responsible for an amendment to this use permit if future construction on any adjacent property requires relocation of the dish antenna, removal and reinstallation costs shall also be borne by the applicant and/or property owner; 4. that this dish antenna shall be painted a nonreflective light gray color and that this nonreflective surface shall be maintained by the property owner; and 5. that this use permit shall be reviewed for compliance with its conditions in one year's time (March, 1989) and upon complaint thereafter. a1� —��. Our being able ta recnrd transmissions directly from satellite feeds will be imperative if we are to serve specific clients who require this service. The antenna will be a small one by satellite standard.s <eleven feet in diameter). The base will be welded to the "I" beams an the roof of a steel frame two story building, so it will be affixed securely and safety will not be a problem. We understand from Ordinance No. 1327, Sectian 18.18.030, that, due the the size of this unit heing under 15 feet above th� roof and due to its weight being under 500 pounds, a complete engineering report will not be needed. We are requesting a raoftop installation for two reasons. One is a lack of ground space around th� building. Tlle otlzer is for rrotection against vandalism and theft. The engineering firm who will make the installation, should you approve our application, has many such installations which they service. They tell us that, on ground level instal.lations, even when enclosed by security fencing, they have to replace stolen and vandalized equipment regularly. Having this equipment out of operation would seriously affect our ability to maintain our clients who depend upon it. We are located in an area that is somewhat remote and infrequently patrolled by security services in the late-night, early morning hours. The television antenna already on the roof is approximately nine feet above the top of the roof. It is attached to the front of the air conditioning enclosure. This antenna was installed by the building owners, The Commun�cations Workers of America, befare we moved in. While this T.V, antenna is mounted toward the front of the building, the satellite dish will be mounted toward the rear of the building and will be less vfsible fram the street by being shie2ded by the roof. 2. I didn't mean to suggest that a six foot enclosure would hide an eleven foot antenna from view. I only meant that the structure would help to shield the antenna from view from the street. The antenna itself will not be completely concealed and I did not mean to suggest, in my appliration, that it wauld be. I simply feel that, due to our locatian <and due to its location on the roof), it should he reasonably we11 con.cealed and should not be offensive to the aesthetics of the area. The Burlin�ame Joint Venture Site is some distance off across Airport Boulevard; The Show Boat is also a distance away and has trees between us; I wouldn't expect the dr�ve-in to object to an antenna as tl�eir clients visit them by night; and itee Joon's and the 433 Airport Office Euilding face away from 411 Airport as we are an the end of their building. I believe that I correctly understand your concerns and will try ta address them by this letter. I will, of course, also attend your meeting on February 22nd and hope that I may then answer more fully any questians that you may have that have not been answered here. One of your main points of discussian revolved around �creening of the antenna from view. I guess when we submitted our application we taok the position that a satellite antenna was not an objectionable thing to see, especially on roof taps which generally house a variety of inechanical equipment anyway. We feel that professianal satellite antennas in commerciai areas �ake an area look mare dynamic and in tune with today`s technology. However, I suppose that we'll have to concede that not everyone shares that view. It is certainly our desire ta cooperate with your wishes and we have no objection to a permit based upon the stipulation that the antenna have screening built around it. The attached sketch shows the roof of the 411 building with the antenna's proposed location toward the rear of the building. The antenna will have to be able to "look" aut the back of the building <dotted lines), but we'll be happy to install a fence behind and to the ��ides o£ the unit, parallel with the roof across the back and sloping on the sides. The back can be built to any height you desire. We_suggest a framework of 2 x 4's bolted to the roof with paneling such a plywood filling it in. We can paint the enclosure the same color as the air conditioning hou.�ing so that it will not oe conspicuous. We investigated this before submitting our application and found that the ground space around this building is very limited. As you can see from the attached drawing, an antenna placed in the patio area would have to face right into the side of the building. A point was raised suggesting that security might not be a prablem on a ground based installatian. I'm not an authority on theft rates of satellite equipment, but we have been told that, in' many applications, replacement of equipment due to theft is a regular occurance. This may not always be a problem in some areas, such as major hotel� with a fair amount of activity at all hours. But, 411 Airport gets very quiet and dark late at night and would be a perfect target for theft. The electranics equipment which has to be mounted at a satellite antenna is quite expensive on a professional system, is quite easily removable and is very saleable. It would be like leaving a$2,000.00 car stereo in a car parked in a remote parking lot all the time. It wouldn't be lang before it would be missing. Comtel is a very small company and we cannot afford such losses. Although the equipment is insured, the insurance company would probably not replace such equipment more than once. The primary reason for the antenna at this time is to serve a specific client who requires t,his service. This client is mast anxious for us to begin service to him as he is losing money every day that he does nat receive our supply of pro$ramming. As his business is important to our success we would like not to lose this client by delay. We, therefore, request that our application be granted with the stipulation that we provide reasonabie fencing around the unit and that you allow us to work with the Planning Comrnission to see that what is provided meets your objectives.
