The Planning Depariment has evidence that this unit existed before 1954 and the property is therefore considered existing and non-conforming. While the second unit on site does not necessarily render the property illegal, it does present a liability in terms of future additions. The second unit makes the gives the property a non- conforming status. I was hoping you could bring to the attention of prospective buyers the possibility of applying for the City's 2°d Unit Amnesty program. With this program, the property owner can permit and legalize the 2°d unit on site. The process is not difficult and not expensive. Thank you for your assistance. As we discussed on April 6, there is an appraisal report in the city's files from the Assessor's Office of San Mateo County dated October 21, 1953. This report states that Building Permit No. 385 was issued on October 15, 1952 for the 1512 Bernal Avenue garage addition and conversion to a living unit. This is the permit which is now missing from the city's files. Thank you for informing me about the amnesty program for second units that may be discussed at future Planning Commission/City Council meetings. We are interested in participating in this program, and would like to receive more information about it. Bernal Avenue is located in the R-1, single family residential zoning district, where only one dwelling unit is allowed on a parcel. You indicated that the unit has a full bath and a kitchen with a stove, sink and refrigerator. As we discussed, there is an appraisal report from 1953 which indicates that the garage was converted to living area in 1953. I have researched the Planning file for 1512 Bernal Avenue and the Building Department microfilm files and was not able to locate a building pernut for the conversion of the garage to a living unit. I have attached a copy of the permits that the city has retained regarding 1512 Bernal Avenue (they are difficult to read, and you are welcome to inspect the microfilm files for clarification). In order to determine that the rear unit was constructed legally, the Planning Department would request to see a copy of the building permit for its conversion. If it is not possible to demonstrate that the conversion was done with a permit, the city would consider the structure to be illegal. As I mentioned to you on the phone, the city may develop an amnesty program for second units. It is anticipated that the program will be part of the work program for 1998. I anticipate that this topic will be discussed at the joint Planning Commission/City Council meeting in late April. If the program is developed, and if your unit meets the criteria for amnesty, you may be able to "legalize" the second unit on the property through the amnesty program. Please be advised that if the unit is granted amnesty under the program, it will have to meet the minimum requirements of the Housing Code. You may want to have a qualified professional inspect the unit and give you information regarding what changes would be necessary to meet the minimum requirements of the Housing Code (sometimes the changes which would be required are more expensive than originally anticipated). There may be other items that you may have to comply with which will be defined in the amnesty program. You may also want to send the Planning Department self- addressed stamped envelopes for future Planning Commission agendas in order to keep abreast of the developments with the amnesty program. �,�a,,,�,�� �.?
