Since there was no appeal to or suspension by the City Council, the March 27, 2006 Planning Commission
approval of your application for design review became effective April 6, 2006. This application was to allow the
construction of a new two-story single family dwelling with a detached garage at 1456 Bernal Avenue, zoned
R-1.
The March 27, 2006 minutes of the Planning Commission state your application was approved with the following
conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped
March 7, 2006, sheets A.1 through A.7, Ll and Boundary and Topographic Survey, and that the roof
material above the bay window in the living room shall be copper; and that any changes to the footprint or
floor area of the building shall require and amendment to this permit;
2. that the existing hedge and ivy between this property and the property at 1452 Bernal Avenue shall not be
disturbed or removed before, during or after construction; the existing hedge and ivy shall be adequately
protected during construction;
3. that any changes to the size or envelope of the first or second floors, which would include adding or
enlarging a dormer(s), moving or changing windows and architectural features or changing the roof
height or pitch, shall be subject to design review;
4. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional involved
in the project, the property owner or contractor shall provide the certification under penalty of perjury;
certifications shall be submitted to the Building Department;
5. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built according
to the approved Planning and Building plans; all windows shall be simulated true divided light windows
with three dimensional wood mullions and shall contain a stucco -mould trim;

The following is a mutual agreement between neighbors, Alex Chan

Hi Kevin,
I thank you for your response, however it does not contain anything I did not already know.
I would like to mention that the hedge I treasured was removed by a construction crew member during their
construction (using a bobcat). I was yelling at him to stop but he took it right out. Unbelievable!
I am friendly with my new neighbors but they never wanted the trees planted or anything else along the driveway. So
we were basically out of luck. That was when I wrote to your dept.
In the future, when I choose to sell my home, if the lack of privacy becomes an issue, that is when I will take action
against any parties that do not correct the problem that has existed since the onset of this build. That means if my
property value decreases due to this, I want to be compensated. No one in the Planning Dept. ever helped to correct
our concern whatsoever, eight years ago or to date. Your current response is really saying "Go handle it" via some
other means. This wasn't what I expected at all. I thought you would contact the owner and explain the situation to
them. It is obvious we lost our privacy.
It would be satisfactory if they planted some trees along the fence.

Commissioner DeMartini contacted me about a correspondence you've had with him regarding the
residence at 1456 Bernal Avenue. I've reviewed the file and wanted to report back to you.
The existing single family dwelling and detached garage was approved by the Planning Commission on
March 27, 2006, a building permit was issued on June 30, 2006, and the building permit was finaled on
March 13, 2007.
In reviewing the building permit site plan (attached) and the Planning Commission staff report
(attached), the plan shows that three 15-gallon evergreen privacy trees were required to be planted at
the rear of the driveway adjacent to the detached garage, alongside a 6-foot solid wood fence.
Furthermore, a Condition of Approval was added by the Planning Commission requiring "that the
existing hedge and ivy between this property and the property at 1452 Bernal Avenue shall not be
disturbed or removed before, during or after construction; the existing hedge and ivy shall be
adequately protected during construction." (copy of approval letter attached). Lastly, the plans show
that escapalier vines with 12-inch cutouts and irrigation were required to be installed alongside the
driveway between the ivy hedge and the new trees. All of these conditions would have been expected
to be fulfilled by the builder at time of construction.
I've also attached a copy of the meeting minutes from the March 27, 2006 Planning Commission
meeting. There is discussion of privacy concerns between your property and the new dwelling, with
specific mention of freestanding trellises. However in reviewing the minutes and the project file, I
cannot find further information on the trellises beyond the mention in the minutes.
I looked up the ownership information in the San Mateo County public records. The current owners are
listed as Chan Alex & Irlina Arcenal, 1456 Bernal Avenue. These are not the same owners as who owned
the property when the house was built.
Given that there appears to have been a change in ownership, it may be possible that the current
owners are not aware of the original conditions that were required for the side yard landscaping when
the home was constructed. You are welcome to share this information with them — it is all public record.
The original documents can be viewed at City Hall.
We would hope that this information could be helpful for productive engagement with your neighbors.
However should you find resistance but want to continue to pursue the matter, we suggest contacting
the Peninsula Conflict Resolution Center at www.percweb.org, 650-513-0330. Our experience has shown
that they can be very helpful in resolving issues between neighbors.

Vistica.
Comment on the motion: opposed, not comfortable with a minimum width driveway for a 5 bedroom house,
need adequate access; height not too tall for this style, needs a pitched roof, at the joint meeting the City
Council and Planning Commission discussed height and other issues for design review, so will be discussing
this allowance more in the future; in this case need to do more work on the driveway to be sure it is
useable; the motion is based on a 9'-6" width from the face of the retaining wall, since the other side setback
is fixed, could affect the width of the house, so they may be back before the Commission.
Chair Auran called for a roll call vote on the motion to approve this project with the amended condition that
the property line retaining wall and vegetation it supports be protected and the driveway be a minimum of
9'-6" in width as measured from the face of the existing property line retaining wall. The motion passed on
a 4-1-0-2 (C. Brownrigg dissenting and C. Osterling and Terrones absent). Appeal procedures were advised.
This item concluded at 8:15 p.m.

AND PROPERTY OWNER; AND JAMES CHU, DESIGNER) (66 NOTICED) PROJECT PLANNER:

Reference staff report March 27, 2006, with attachments. Plr Hurin presented the report, reviewed criteria
and staff comments. Fifteen conditions were suggested for consideration. CP Monroe received clarification
from the designer noting that the roof over the bay window at the living room will be copper, condition 41
will be amended to reflect this clarification.
Chair Auran opened the public hearing. Tony Leung, applicant and property owner, was available to answer
questions.
Mary Frances Nappi, 1452 Bernal Avenue, noted that she met with the applicant to discuss the issues listed
in her letter dated March 27, 2006, feel that the issues about retaining and protecting the existing hedge and
ivy at the property line can be worked out with the applicant; there is no agreement about the proposed
balcony at the rear of the house, would like to see a decorative wrought iron balcony off the master bedroom
instead of a full balcony, feel privacy will be lost with a full balcony, will leave it up to the Commission for
direction on the balcony. Applicant noted that he would like to have the balcony as proposed since it will
add value to the property. Commission noted that the freestanding trellises, as requested by the neighbor,
would help to provide privacy to the neighbor's rear yard and pool. There were no further comments and the
public hearing was closed.
Commission discussion: Commission should not get involved with the trellises, this should be worked out
between the applicant and neighbor, concern about drainage will be addressed by the Public Works
Department at time of building permit submittal, should add a condition for protection of the existing hedge
and ivy in the neighbor's yard.
C. Deal moved to approve the application, by resolution, with the following amended conditions: 1) that
the project shall be built as shown on the plans submitted to the Planning Department date stamped March 7,
2006, sheets A. l through A.7, L 1 and Boundary and Topographic Survey, and that the roof material above

floor elevation of the new structure(s) and the various surveys shall be accepted by the City Engineer; 10)
that during demolition of the existing residence, site preparation and construction of the new residence, the
applicant shall use all applicable "best management practices" as identified in Burlingame's Storm Water
Ordinance, to prevent erosion and off -site sedimentation of storm water runoff, 11) that the project is
subject to the state -mandated water conservation program, and a complete Irrigation Water Management
Plan must be submitted with landscape and irrigation plans at time of permit application; 12) that
demolition for removal of the existing structures and any grading or earth moving on the site shall not occur
until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District. 13) that the conditions of the Recycling
Specialist's December 28, 2005 memo, the City Engineer's and Chief Building Official's January 3, 2006
memos, the Fire Marshal's January 4, 2006 memo and the NPDES Coordinator's January 6, 2006 memo
shall be met; 14) that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste
Reduction Plan and meet recycling requirements; any partial or full demolition of a structure, interior or
exterior, shall require a demolition permit; 15) that the applicant shall comply with Ordinance 1503, the
City of Burlingame Storm Water Management and Discharge Control Ordinance; and 16) that the project

All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

10. The project shall file a parcel map with the Public Works Engineering
Division. The parcel map shall show all existing property lines, easements,
monuments, and new property and lot lines proposed by the map.

submitted to the Public Works Engineering Division with the parcel map
for reviews.
12. Map closure/lot closure calculations shall be submitted with the parcel
map.
13 The project shall submit a condominium map to the Engineering Divisions
in accordance with the requirements of the Subdivision Map Act.
14 �_ The project shall, at its own cost, design and construct frontage public
improvements including curb, gutter, sidewalk and other necessary
appurtenant work.
15 The project shall, at its own cost, design and construct frontage streetscape
improvements including sidewalk, curb, gutters, parking meters and poles,
trees, and streetlights in accordance with streetscape master plan.
16 By the preliminary review of plans, it appears that the project may cause
adverse impacts during construction to vehicular traffic, pedestrian traffic
and public on street parking. The project shall identify these impacts and
provide mitigation measure acceptable to the City.
17 The project shall submit hydrologic calculations from a registered civil
engineer for the proposed creek enclosure. The hydraulic calculations
must show that the proposed creek enclosure doesn't cause any adverse
impact to both upstream and downstream properties. The hydrologic
calculations shall accompany a site map showing the area of the 100-year
flood and existing improvements with proposed improvements.
18 Any work within the drainage area, creek, or creek banks requires a State
Department of Fish and Game Permit and Army Corps of Engineers
Permits.
19 No construction debris shall be allowed into the creek.
20 The project shall comply with the City's NPDES permit requirement to
prevent storm water pollution.
21 The project does not show the dimensions of existing driveways, re-
submit plans with driveway dimensions. Also clarify if the project is
proposing to widen the driveway. Any widening of the driveway is subject
to City Engineer's approval.

25. For commercial projects a designated garbage bin space and cleaning area
shall be located inside the building. A drain connecting the garbage area to

1) All construction must comply with the 2001 California Building Codes (CBC),
the Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
2) Provide fully dimensioned plans.
3) Comply with the new, 2005 California Energy Efficiency Standards for low-rise
residential buildings. Go to http://www.energy.ca.gov/title24 for publications
and details.
4) Obtain a survey of the property lines for any structure within one foot of the
property line.
5) Roof eaves must not project within two feet of the property line.
6) Exterior bearing walls less than three feet from the property line must be
constructed of one -hour fire -rated construction and no openings are allowed.
7) Rooms that can be used for sleeping purposes must have at least one window
or door that complies with the egress requirements.
8) Provide guardrails at all landings. NOTE: All landings more than 30" in height
at any point are considered in calculating the allowable floor area. Consult the
Planning Department for details if your project entails landings more than 30"
in height.
9) Provide handrails at all stairs where there are more than four risers.
10)Provide lighting at all exterior landings.
11)The fireplace chimney must terminate at least two feet above any roof surface
within ten feet.

1) Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not
limited to ensuring that all contractors implement construction Best Management
Practices (BMPs) and erosion and sediment control measures during ALL phases
of the construction project (including demolition). Include appropriate stormwater
BMPs as Project Notes. These BMPs include but are not limited to the following:
• Store, handle, and dispose of construction materials and wastes properly
to prevent contact and contamination of stormwater;
• Control and prevent the discharge of all potential pollutants, including
pavement cutting wastes, paints, concrete, petroleum products, chemicals,
wash water or sediments, and non-stormwater discharges to storm drains
and watercourses;
• Use sediment controls or filtration to remove sediment when dewatering
site and obtain all necessary permits;
• Avoid cleaning, fueling, or maintaining vehicles on -site except in a
designated area where wash water is contained and treated,
• Protect adjacent properties and undisturbed areas from construction
impacts using vegetative buffer strips, sediment barriers or filters, dikes,
mulching, or other measures as appropriate,
• Perform clearing and earth moving activities only during dry weather;
• Limit and time application of pesticides and fertilizers to prevent polluted
runoff;
• Limit construction access routes and stabilize designated access points;
• Avoid tracking dirt or other materials off -site; clean off -site paved areas
and sidewalks using dry sweeping method;
• The Contractor shall train and provide instruction to all employees and
subcontractors regarding the construction BMPs.
