Dear Mr. and Mrs. Ehlers,
Since there was no appeal to or suspension by the City Council, the July 23, 2001 Planning Commission approval
of your application for design review and special permit for declining height envelope became effective August
20, 2001. This application was to allow a first and second story addition at 1504 Bernal Avenue, zoned R-1.
The July 23, 2001 minutes of the Planning Commission state that your application was approved with the
following conditions:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
July 16, 2001, Sheets A1.0 through A5.2, site plan, floor plans and building elevations;
2. that any changes to the size or envelope of the second floor, which would include adding or enlarging
a dormer(s) or changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the City Engineer's and Recycling Specialist's April 16, 2001 memos shall be met;
and
4. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition,
as amended by the City of Burlingame.
Reimbursement of your design review deposit has been processed and will be mailed to you under separate
cover. �
All site improvements and construction work will require sepazate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.

Summary (revised plans dated stamped 7/16/O1): The applicant is requesting design review and a special permit for
declining height envelope for a first and second-story addition at 1504 Bernal Avenue, zoned R-1. The existing one-story
house now contains 2,492 SF of floor area (0.41 FAR), including a detached two-car garage with the removal and
reconstruction of the rear portion. The square footage of the first floor would be reduced by approximately 140 SF. The
proposed 1,223 SF second floor addition would include the relocation of the existing bedrooms that are now on the first floor.
There are 2 rooms labeled study, one on the first and one on the second floor, however both rooms are considered bedrooms
under the Zoning Code. The addition would increase the floor area of the remodeled house to 3,405 SF (0.56 FAR), where
3,420 SF (0.57 FAR) is the maximum allowed. The existing attached two-car garage would be retained and meets the on-site
parking requirement.

July 9, 2001 Design Review Study Meeting: On July 9, 2001, the Planning Commission reviewed this project for
design review (see attached 7/9/O1 Planning Commission minutes). Concerns expressed by the Planning
Commission included the following:
• Entryway on west elevation is a large item on the house, address its scale;
• Living room window is a candidate for a transom; '
• Proportion of windows on east elevation is good, look at those as an example for the sides of the house;
• Two windows in master bath on front elevation are small, look at making them larger;
• South elevation lacks sensitivity in window patterns, look at the window pattern from the interior;
• North elevation roof forms do not have the articulation that is seen on the front and the rear;
• Fireplace on the outside wall should be expressed on wall as a vertical component to add articulation;
• Special permit for declining height envelope on the north elevation might bee justified if it enhances the
architecture, could provide a pop out, north elevation is not balanced, needs more windows; and
• Need more information on the windows, what is the trim package proposed, will it be traditional stucco mold.
Current Project Revisions (July 16, 2001 plans): After the July 9, 2001, Planning Commission design review
study meeting, the applicant submitted revised plans (date stamped July 16, 2001). The following revisions
were made:
• Entryway scale reduced and light fixtures added to each side of entryway;
• Transom added above living room window;
• Increased size of master bathroom windows on front elevation;
• Window patterns revised on the south side;
• Roof forms articulated on north elevation with the addition of a pop out in the study off of the master
bedroom- requires a special permit for declining height envelope on the left side (1'-0" X 12'-10"=
12.83 SF);
• Chimney on south elevation is on outside of wall as a vertical component to add articulation; and
• Information on the windows was added to the plans to show wood Marvin windows with a 3/4" radius stucco
bead bordering the window reveal.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on Apri120, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2

2. Respect for the parking and garage patterns in the neighborhood;
Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
Landscaping and its proportion to mass and bulk of structural components.

Findings for a Special Permit: In order to grant a Special Permit for garage length the Planning Commission must
find that the following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistent with the city's reforestation requirements, and the mitigation for the removal that is proposed is
appropriate.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should
be made by resolution and should include findings. The reasons for any action should be clearly stated. At the
public hearing the following conditions should be considered:
l. that the project shall be built as shown on the plans submitted to the Planning Department date stamped July
16, 2001, Sheets A1.0 through A5.2, site plan, floor plans and building elevations;
2. that any changes to the size or envelope of the second floor, which would include adding or enlarging a
dormer(s) or changing the roof height or pitch, shall be subject to design review;
that the conditions of the City Engineer's and Recycling Specialist's April 16, 2001 memos shall be met;
and
4. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as

The mass and scale of this addition is totally consistent with the existing houses on this and many adjacent
blocks. There are numerous 2-story houses including the one immediately to the North and several across the
street. Other than this request for a small exception to the declining height envelope, the entire structure is
well within the envelope requirement thus creating the necessary air and light separations between structures.

This established neighborhood of Burlingame has many different styles of houses. In designing the addition to
this house, a 2-story cottage style is the guiding theme. The facade's scale is visually reduced by introducing
various gable roofs without overly complicating the building mass. The light taupe color exterior walls with
white painted trims and flower boxes continues this cottage theme which is quite prevalent in this
neighborhood.

1. The cottage style is very common in this neighborhood.
2. The garage is detached and located to the rear of the property which is also very common.
3. The Architectural style is consistent with the neighborhood; the mass and bulk ere well within tha guidelines.
4. The size of the proposed addition will render the house similar in width and height to the North adjacent building. Windows facing this
neighbor is kept to the minimum without neeatively affecting the appearance of our building. The neighbor to the South is separeted
by the 10-ft driveway plus their side yard setback. Even though it is e 1-story building, the adherence to the declining height envelope
guideline, on our part, preserves the air space between the two buildings.
5. Landscaping is not altered in this addition.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for design
review and special permit for declining height envelope for a first and second story addition at 1504 Bernal
Avenue, zoned R-1, Barry A. and Monica H. Ehlers, property owner, APN• 026-033-130;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on J�
23, 2001, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received
and addressed by this commission, it is hereby found that there is no substantial evidence that the project set
forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article
19. Categorically Exempt per Section: 15303 - Class 1-(e) additions to existing structures provided the
addition will not result in an increase of more than 50 % of the floor area of the structures before the
