Dear Mr. and Mrs. Ehlers,
Since there was no appeal to or suspension by the City Council, the February 11, 2002 Pianning Commission
approval of your application for a design review amendment effective February 20, �00�. This application was to
allow changes to the plans approved by the Pianning Commission at the July 23, 2002 rneeting, for a first and
second story addition at 1504 Bernal Avenue, zoned R-1.
The February 11, 2002 minutes of the Planning Commission state that your application was approved with the
following conditions:
1. that the project shall b.e;built as shown on the originai plans submitted to the �'ianning Department date

All site improvements and construction work will require separate application to the Building Deparkment. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

Reference staff report 02.11.02, with attachments. CP Monroe presented the report, reviewed criteria and
staff comments. Four conditions were suggested for consideration.
Chairman Vistica opened the public hearing. Barry Ehlers, property owner and applicant, was present to
answer questions. The Commission thanked the applicant for asking for a design review amendment
before the project was under construction, rather than waiting for the changes to be found during
inspection. There were no further comments and the public hearing was closed.
Commission commented that the modifications proposed enhanced the project. C. Bojues moved to approve
the application, by resolution, with the following conditions: 1) that the project shall be built as shown on
the original plans submitted to the Planning Department date stamped July 16, 2001 and approved by the
Planning Commission on July 23, 2001, Sheets A1.0 through A5.2, site plan, floor plans and building
elevations, as modified by the plans submitted to the Planning Department date stamped January 25, 2001,
Sheet A.A and A.B, floor plans and building elevations, including (a)removing the living room,
transom/ribbon window on the right side of the iront elevation on the first floor; (b) changing two windows
to one window in the front dormer in the master bathroom, on the second floor front elevation; (c)removing
the living room, transom/ribbon windows above the windows on each side of the fire place along the south

Chairman Vistica re-opened the public hearing. The applicant asked if it would be possible to make the
windows for the project Marvin windows that were wood with aluminum cladding, rather than all wood
windows. The Commission noted that this change did not contradict the proposed plans and the
substitution is acceptable. There were no further comments and the public hearing was closed.
Chairman Vistica called for a voice vote on the motion to approve. The motion passed on a 5-0-2 voice vote
(Cers. Keele and Osterling absent). Appeal procedures were advised. This item concluded at 7:25 p.m.

provided the addition will not result in an increase of more than 50% of the floor area of the structures before the
addition.
History: At the July 23, 2001 Planning Commission meeting, the Commission voted 6-0-1(Cmr. Bojues absent)
to approve a design review and special permit for declining height envelope for first and second-story addition at 1504
Bernal Avenue, zoned R-1. The applicants have not yet applied for a building permit for this project, but in preparing
the working drawings they have found that a few changes that need to be made to the design that was approved by
the Planning Commission.
The applicant is requesting the following changes to the approved design:
Front Elevation
1) remove the living room, transom/ribbon window on the right side of the front elevation on the first floor;
2) change the two windows to one window in the front dormer in the master bathroom, on the second floor;
South Elevation (right side)
3) remove the living room, transom/ribbon windows above the windows on each side of the fire place;
4) reduce the size of the two windows in bathroom number two on the second floor, which is the cantilevered
portion with a cooper roof along the south;
North Elevation
5) change 2' x 24' portion of first floor roof from a flat roof to a shed roof, with "fire free" quarry slate tiles
to match the main roof; and
6) remove one of the two north elevations windows in the master bathroom, and slightly increase the size of
the remaining window.
The provided plans show both the approved and proposed elevations, with the changes clouded on the proposed
elevations. List below is the original project summary table. All of the proposed changes are design changes on
the elevations, therefore no dimensions have changed and the summary remains the same. The approved proj ect
includes reducing the first floor by approximately 140 SF. The proposed 1,223 SF second floor addition would include
the relocation of the existing bedrooms that are now on the first floor. There are 2 rooms labeled study, one on the first and
one on the second floor, however both rooms are considered bedrooms under the Zoning Code. The addition would increase
the floor area of the remodeled house to 3,405 SF (0.56 FAR), where 3,420 SF (0.57 FAR) is the maximum allowed. The
existing attached two-car garage would be retained and meets the on-site parking requirement. This project was not referred
to a design reviewer during the original review process.

Staff Comments: See attached. Findings for the special permit for declining height envelope have been made under
the original approval. Since this amendment does not include changes to the exterior dimensions of the structure
as approved , the previous action covers this request.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on Apri120, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and

Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should
be made by resolution and should include findings. The reasons for any action should be clearly stated. At the

Chairman Vistica opened the public hearing. Barry and Monica Ehlers properiy owners, Anthony Ngai,
architect, represented the project. Feel addressed the 8 issues clearly on the revised plans, did pop out and
area 10 feet by 1 foot in depth on the north elevation to add articulation, this extends beyond the declining
height envelope; there were no questions from the commissioners or from the floor. The public hearing was
closed. .
C. Keighran commended the applicant on their responsiveness to the corrunission's concerns, feel that the
declining height exception on the north elevation benefits the design and moved approval of the revised
project by resolution with the following conditions: 1) that the project shall be built as shown on the plans
submitted to the Planning Department date stamped July 16, 2001, Sheets A1.0 through A5.2, site plan,
floor plans and building elevations; 2) that any changes to the size or envelope of the second floor, which
would include adding or enlarging a dormer(s) or changing the roof height or pitch, shall be subject to
design review; 3) that the conditions of the City Engineer's and Recycling Specialist's April 16, 2001
memos shall be met; and 4) that the project shall meet all the requirements of the California Building and

IX. DESIGN REVIEW STUDY ITEMS

CP Monroe briefly presented the project description. There were no questions of staff.
Chairman Vistica opened the public comment. Barry and Monica Ehlers, applicants and Tony Ngai,
architect, were available for questions.
Commissioners asked for clarification on front elevation, dormer on front is more than 7'-6" above
finished floor height, how will that work. The project architect noted that the living room has a sloping
roof, this would be clerestory to provide light well to sloping area of living room. Commissioner asked
why was galvanized metal chosen for the roof material over the cantilevered area on the south elevation.
The architect noted that the intent was to make it look like a bay window, and the hardi-slate material
used for the rest of the roof would not work for that small an area., this roof section will be copper.
There were no other comments from the floor and the public hearing was closed.
Commission discussion: there are a lot of little things that need adjustment on this plan, applicant has
understanding of issues, project should come back on regular action calendar.
C. Bojues made a motion to place this item on the regular action calendar when revisions have been
made. The motion was seconded by C. Keighran. The commission noted the following items to be
addressed:
➢ on west elevation, the entryway is a large item on the house, need to address its scale;
➢ the living room window is a candidate for a transom;
➢ proportion of windows on east elevation is good, look to that example for the sides;
➢ the two windows in master bath on the front elevation are small, might want to make them bigger;
➢ on south elevation, there is no sensitivity in window patterns, might want to look at the window
patterns from the interior.
➢ on the north elevation, don't see the level of articulation on roof forms seen on front and rear;
➢ the fireplace on the outside wall should be expressed on wall as a vertical component to add
articulation;
➢ special permit exception for declining height envelope on north elevation might be justified if it
enhances the architecture, could provide a pop out, it is not balanced, needs more windows;
➢ need more information on the windows, what is the trim package proposed, will it be traditional
stucco mold.
Comment on motion: if applicant wants to file an exception for declining height envelope, needs to add
that application with Planning Department, the item will be set for hearing when the submittal is
complete.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for design
review amendment to an application for design review and special permit for declining height envelope for
a first and second story addition at 1504 Bernal Avenue, zoned R-1, Barry A. and Monica H. Ehlers, property
owner, APN: 026-033-130;
WI�REAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 11, 2002, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received
and addressed by this commission, it is hereby found that there is no substantial evidence that the project set
forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article
19. Categorically Exempt per Section: 15303 - Class 1-(e) additions to existing structures provided the

second floor front elevation; 3)removing the living room, transom/ribbon windows above
the windows on each side of the fire place along the south elevation; 4) reducing the size of
the two windows in bathroom number two on the second floor along the south elevation;
5)changing 2' x 24' portion of first floor roof from a flat roof to a shed roof along the north
elevation, with "fire free" quarry slate tiles to match the main roof; and 6) removing one of
the two north elevation windows in the master bathroom, and slightly increase the size of the
remaining window.
2. that any changes to the size or envelope of the second floor, which would include adding or
enlarging a dormer(s) or changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the City Engineer's and Recycling Specialist's April 16, 2001 memos
shall be met; and
4. that the project shall meet all the requirements of the California Building and Fire Codes,
1998 edition, as amended by the City of Burlingame
