Dear Mr. Chan,
Since there was no appeal to or suspension by the City Council, the June 11, 2001 Planning Commission
approval of your application for design review became effective June 18, 2001. This application was to allow
for the construction of a new, two-story house at 1433 Bernal Avenue, zoned R-1.
The June 11, 2001 minutes of the Planning Commission state your application was approved with the following
conditions:
l. that the project shall be built as shown on the plans submitted to the Planning Department date stamped
May 22, 2001, sheets A 1 through A3 , and that any changes to the footprint or floor area of the building
shall require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or changing
the roof height or pitch, shall be subject to design review;
3. that the conditions of the City Engineer's, Fire Marshal's, Chief Building Official's March 19, 2001,
memos shall be met;
4. that the project shall comply with the proposed demolition and construction recycling ordinance recently
approved by the City Council;
5. that the project shall meet all the requirements of the California Building Code and California Fire Code,
1998 edition, as amended by the City of Burlingame.

Reimbursement of a portion of your design review deposit has been processed and will be mailed the property
owner under separate cover.
All site iinprovements and constniction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is inade before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

Design Review Study Meeting: At the Planning Commission design review study meeting on April
23, 2001, the Commission requested the following changes (4/23/O1 PC minutes):
• reduce the second floor plate height;
• there are blank walls at the north and south sides; should utilize windows and deeper insets to add
articulation ;
• south side looks like a tower;
• design is front-loading the house; add more roof area and variation;
• second story bay window is out of proportion;
• pediment over front entrance does not fit with style of house;
• call out the window trim, which should not be 3 inch deep stucco mold; all other houses in
neighborhood have narrow molding; and
• add more landscaping to frame the proposed house.
The Commission moved to refer this item to a design reviewer.
Design Reviewer Comments: The design reviewer notes that substantial design revisions have been
made to make the project more acceptable. The Commission's concerns regarding the mass and front-
loading of the house have been addressed with the following revisions:

• the south and west elevations have been cantilevered over corbels;
• the stair at the north elevation has been set back from the plane of the elevation;
• windows have been added to the north and south sides;
• the bay window at the front has been limited to the first story;
• the front porch has been scaled to fit the neighborhood and the house;
• the plate height on the second floor has been reduced from 9'-0" to 8'-6";
• the roof lines at the front of the house have been stepped back from the first to the second floor;
and
• the overall height of the house has been reduced by 1'-1 ".
The Commission's concerns regarding the design elements have been addressed with the following
revisions:
• the pediment at the front entry has been eliminated; and
• the windows are proposed are wood mullion that match the surrounding neighborhood.
The Commission's concerns regarding the landscaping have been addressed by the following revisions:
• three white pine trees are proposed in the rear, right side of the property; and
• a row of Japanese Boxwood shrubs is proposed along the right side of the property, across the front
of the property, and along the left side of the driveway where possible.
Design Reviewer Recommendation: The design reviewer notes that the revisions have greatly
reduced the grandiose appearance of the proposed house, so that its scale and proposed design
elements fit in with the surrounding neighborhood. The design reviewer recommends that the
Planning Commission approve the Design Review for the proposed new house.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted
by the Council on April 20, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure; �
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.

Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for design review, and the reasons for any
action should be clearly stated. At the public hearing the following conditions should be considered:

CP Monroe briefly presented the project description. There were no questions of staff.
Chairman Luzuriaga opened the public comment. Wing Tim, property owner, and Jason Chan, architect,
represented the project. Commission points in discussion were:
- the 9 foot plate line on the first and second floors makes the project too massive, second floor plate
should be reduced to 8 feet;
- there is a disparity with the roof lines on the front of the building with the second floor gable and
then the two story bay which adds mass to the second floor;
- the north side is a big, massive blank wall, need to add articulation;
- the south side is also a big wall with massive windows which stands out from the architecture of the
whole and does not blend into the rest of the house, need to articulate walls with more than a 6 inch
off sets, needs shadow lines, present looks like a tower, should be changed;
- as front elevation demonstrates, this house is front loaded, need to increase the roof area, reduce the
plate height, add variation, the pediment over the entrance does not work with the style of the house;
- second story bay is out of proportion, find some other way to break up tall wall;
- front of house is not pedestrian friendly, too grandiose for style;
- the rear elevation is boxy, should change as sides are revised;
- window trim needs to be called out, need detail, do not want 3 inch deep stucco mold, should be
narrow like other houses in area;
- project needs more windows to break up long blank walls;

There were no further comments from the public and the public comment was closed.
C. Keighran moved to direct this project to a design reviewer with the direction given by commission. The
motion was seconded by C. Vistica.
Comment on the motion: there needs to be a general discussion about mass and bulk, how to achieve a
human scale of design by varying plate heights even some below 8 feet and letting other elements extend
up; the porch design is important especially the way the columns resolve into the lintel and roof; questions
the need for the octagonal bays on the front, is there another way? Side walls may be OK need more
windows.
Chairman Luzuriaga called for a voice vote on the motion to direct this project to a design reviewer. The
motion was approved on a 7-0 voice vote. The item is not appealable. This item concluded at 10:25 p.m.

that the time limit on the v' ce be removed. Commissi ers noted that perhaps the varian could be
revised to have the vari e expire if the tree or if the ouse is removed. CA noted that t ay with the

we did in 1990; to e out the redwood a tre emoval permit would be require . On the design the
commissioner co ented:

1. COMPATIBILITY OF THE ARCHITECTURAL STYLE WITH THAT OF
THE EXISTING CHARACTER OF THE NEIGHBORHOOD.
There are several two-story residences on the street, however, one of the single
story homes is to the immediate north of this proposed residence. Most of the
homes are of stucco with wood mullion windows. The roofs are of various slopes
with either composite shingle or Spanish tile. The designer for this newly
proposed residence took into consideration all of the aspects of the neighborhood
when designing this residence.
2. RESPECT FOR THE PARKING AND GARAGE PATTERNS IN THE
NEIGHBORHOOD.
This proposed residence follows the precedence set by the neighborhood
incorporating a detached garage at the rear of the property.
3. ARCHITECTURAL STYLE AND CONSISTENCY AND MASS AND
BULK OF STRUCTURES, INCLUDING ACCESSORY STRUCTURES.
The designer has revised this residence to incorporate more windows on the side
elevations, as recommended by the Planning Commission. He has broken up the
massiveness of the south elevation by cantilevering the second floor over corbels.
The north elevation places the stair set back from the plane of the elevation. The
hip roof reduces the scale of the roof.
The front elevation is proportioned nicely with the single-story bay, then stepping
back the first and second floors. The front porch is in scale with the
neighborhood and the house. All these elements reduce the original grandiose
style, which bring it nicely to the street. The overall height of the house was
reduced by 1'-1" from the originally proposed height.
The cantilevering over the corbels wraps around to the rear of the house breaking
the rear mass.

Throughout, there is a consistent pattern of wood mullion windows, which match
the neighborhood.
4. INTERFACE OF THE PROPOSED STRUCTURE WITH THE
STRUCTURES ON ADJACENT PROPERTIES.
The residence to the right, 1437 Bernal, is single story. The distance between the
residences from the driveway and canal removes them somewhat from each other.
There is proposed landscaping between the two residences. The new house is
downhill from the neighbor, therefore reducing the scale of the larger home.
The neighbor to the left, 1329 Bernal, has few windows facing the new residence,
and a driveway in between. There should be little impact from the new residence.
The rear yard is well landscaped, and should not impact the rear neighbors.
The articulation of the front elevation is sensitive to the streetscape.
5. LANDSCAPING AND ITS PROPORTION TO MASS AND BULK OF
STRUCTURAL COMPONENTS.
There is a street tree in the front yard, and the rear yard is heavily landscaped.
Currently, the neighbor to the left has some scraggly bushes. The biggest problem
is there is not much room for landscaping at the left side. The designer is
proposing new landscaping to the left front drive where possible. The right side
of the house is proposed to have a row of bushes along the canal. There are also
some small bushes proposed for the front yazd as well.
COMMENTS:
The designer has taken all the comments ma.de by the PC into consideration. He made
modifications prior to review by a design reviewer. We then met, and a few other
alterations were made to arrive at this design.
The massing works quite well, and the designer and owner incorporated elements from
the neighborhood; such as e�erior materials, window types, front porch and roof type.
I feel this proposed residence will work well in the neighborhood for the above reasons.

date stamped May 22, 2001, sheets A1 through A3 , and that any changes to the footprint or
floor area of the building shall require and amendment to this permit;

' include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
