Dear Mr. Shao,
Since there was no appeal to or suspension by the City Council, the March 18, 2002 Planning Commission
approval of your application for a design review amendment became effective March 18, 2002. This application
was to allow for the coristruction of a new, two-story house at 1433 Bernal Avenue, zoned R-l.
The March 11, 2002 minutes of the Planning Commission state your application was approved with the following
amended conditions:
that the project shall be built as shown on the revised plans submitted to the Planning Department date
stamped February 25, 2002, sheets A1 through A3, and the site and landscape plan submitted to the
Planning Department and date stamped May 22, 2001, sheet A1, and that any chang�� �� the footprint or
floor area of the building shall require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the
roof height or pitch, shall be subject to design review;
3. that the height of the foundation and roof ridge shall be surveyed by a licensed surveyor and shall be
reported to the Chief Building Official before a foundation and framing inspections are completed; if the
height of the foundation and/or the roof ridge is not consistent with the approved plans, the applicant shall
correct the height to comply or immediately stop all work on the site and apply for a design review
amendment;
4. that the three island date palm trees at the rear of the property shall be replaced with 3 tree species,
selected from the city's official tree list, and that the Japanese boxwood shrubs along the right side of
the house shall be replaced with the same species as the existing shrub's along the right side property line;

5. that the conditions of the City Engineer's, Fire Marshal's, Chief Building Official's March 19, 2001,
memos and the Recycling Specialist's February 25, 2002 memo shall be met;
6. that the project shall comply with the proposed demolition and construction recycling ordinance recently
approved by the City Council; and
7. that the project shall meet a11 the requirements of the California Building Code and California Fire Code,
1998 edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department. T'his
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be cons'��� red by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

Reference staff report, 3.11.02, with attachments. CP Monroe presented the report, reviewed criteria and
staff comments. Five conditions were suggested for consideration. Commission asked would there be safety
hazard if water flowed at full capacity in the smooth concrete trench along the right side of the property; CE
Murtuza noted that there have been no problems reported with water capacity in similar trenches throughout
the city. Commissioner asked if, because the house was designed within inches of the maximum height
allowed, it would be appropriate to add a condition to survey the elevation of the first floor; CBO Cullum
suggested that the foundation and roof ridge be surveyed, can add this as a condition. There were no further
questions of staff.
Chairman Vistica opened the public hearing. James Chu, designer, 39 W. 43�d Avenue, San Mateo, was
available to answer questions. He noted that the proposed changes are an improvement to this project,
revised the floor plan layout and added more exterior details. Commission noted that the landscape plan
calls for Japanese boxwood along the right side of the property and three new Island Date palm trees at the
right rear corner of the property, suggest replacing palm trees with trees from the city's official tree list,
Japanese boxwood should be replaced with the same species as the existing shrubs along the right side
property line; designer noted that this landscape plan was previously approved and no changes are proposed,
but noted that these changes could be made; Commission asked why the entry porch was reduced in width
from 5' to 4' wide; designer noted that a narrower width was more in proportion with the front of the house.
There were no further comments and the public hearing was closed.
C. Keighran moved to approve the application, by resolution, with the following amended conditions, noting
that this is an improvement to the original design, the roof over the front bay window was changed from
composition shingle to copper, and arched vents and a lead glass window were added: 1) that the project
shall be built as shown on the revised plans submitted to the Planning Department date stamped February ?�
2002, sheets A 1 through A3, and the site and landscape plan submitted to the Planning Department and date
stamped May 22, 2001, sheet A1, and that any changes to the footprint or floor area of the building shall

Comment on the motion: this is a big improvement over the original design, noted a mistake in the staff
report, table indicates that the height will be 29'-11", plans show 29'-3" from average top of curb, height
should be confirmed and conected.
Chairman Vistica called for a voice vote on the motion to approve. The motion passed on a 6-0-1 (C.
Br wnrigg absent). Appeal procedures were advised. This item concluded at 7:30 p.m.

house will not be visible from t e treet, design review still looks at the overall desi .
Further discussion: Commission as ed where was the 500 SF eliminated when FAR r duced from 6,300 SF
to 5,700 SF; the architect noted that e overall room sizes were reduced; concerned ith the window trim,
foam stucco molding and wood trim own on the plans, drawings do not clearly show hat window trim is
intended; architect noted that the owner p s on using traditional wood stucco mold, b t it is not drawn as
such on the plans; concerned with the flat ro f at the middle of the house, there will be leaves falling on the
roof, creates a potential for leaking, have you 'ed to pitch the entire roof? The architect noted that an effort

Thanks for your e-mail. Staff checked. This project was one that was approved after we began requiring a
licensed surveyor document foundation location prior to pour. The required front setback by the Planning Commission
was 22'-6", and the foundation was surveyed at 22'-81/2"; the average setback on the block (at the time of submittal
March 2001) was 19'-10". (The survey was field checked by simple measurement by the buiding inspector and found to
be within the approved distance). The existng setback on the current foundation is greater than the average setback on
the block in March 2001. Commission approved this project in June 2001. Construction has just begun. There has been
a lot of construction on this particular block over the past two years. The subsequent setbacks approved could have
been greater. A problem of timing and change.

There was a lawsuit involving the property ownership. New owner/builder, Frank Walley, was
in to discuss project. He had plans for the ORIGINAL approval (plans by Jason Chan). The
building permit for these plans was issued in March 2002, within the Planning approval
deadline. The permit was then extended by the Building Dept. in 2003.
Mr. Walley was planning to make the following changes to the approved ORIGINAL plans:
1. chimney at left side to be eliminated (chimney at right to remain);
2. will be a 12" x 12" vent at the rear elevation, 2°d floor, for the fireplace on the left side
of the dwelling to vent;
3. window at left, rear elevation, 2°d floor was approved at 2'-6" width, will be made 3'-0"
wide to meet Building Code egress requirements;
4. window at rear, right bedroom to be 1 foot shorter (as seen from driveway side); and
5. stone veneer to be added along lower 2-3 feet of stucco.
These changes were reviewed by SP Brooks and myself and determined not to require FYI,
amendment or any additional Planning Commission review.

CEQA Status: Article 19. Categorically Exempt per Section: 15303, Class 3—(a) construction of a

second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences
maybe constructed or converted under this exemption.
History: On June 11, 2001 the Planning Commission approved a design review application for a new
two-story house at 1433 Bernal Avenue. The approved project included the demolition of an existing
two-story house and detached single-car garage. The approved new dwelling was two-stories with a
detached two-car garage. The existing two-story dwelling and detached single-car garage at 1433
Bernal Avenue has not been demolished and no construction has been done for the project approved by
the Commission on June 11, 2001.
Current Proposal: The property at 1433 Bernal Avenue has a new owner. The new owner is
proposing a design review amendment to the plans approved by the Commission on June 11, 2001.
The proposed changes include:
Interior Chan�es
• a half-bath has been added to the area just off the entrance on the first floor;
• a foyer has been created on the first floor; and
• a third bathroom has been added on the second floor between Bedroom #1 and Bedroom #2.
Exterior Changes
Garage:
• the garage height has been changed from 15'-0" to 14'-11 "; and
• the garage doors, exterior light fixtures and vent have been changed.
Front Elevation:
• the entry porch has been narrowed from a 5'-0" wide opening to a 4'-0" wide opening;
• the roof on the front bay window has been changed from composition shingle to copper; and
• the two windows to the right of the entrance on the first floor have been replaced with a single
diamond-paned window.
Rear Elevation:
• the chimneys at the right and left side elevations have been removed and replaced by a single
chimney at the rear elevation;

• the window on the left side of the lower first has been changed to a French door; and

Staff Comments: See attached. Planning staff would note that because of the nature of the request to
amend an approved design review project, it was determined that it could be brought forward directly

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted
by the Council on Apri120, 1998 are outlined as follows:

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
DESIGN REVIEW AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for desi�n
review amendment for a new, two-story house at 1433 Bernal Avenue, zoned R-1, Chi-Hwas Shao, propertv
owner, APN: 026-054 -010;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
March 11, 2002, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15303, Class 3, construction and location of limited numbers of new, small
facilities or structures including (a) single-family residences not in conjunction with the building of two or
more such units is hereby approved.
2. Said design review amendment is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such design review amendment are as set forth in the minutes and recording of
said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

1. that the project shall be built as shown on the revised plans submitted to the Planning
Department date stamped February 25, 2002, sheets A1 through A3, and the site and
landscape plan submitted to the Planning Department and date stamped May 22, 2001, sheet
A1, and that any changes to the footprint or floor area of the building shall require and
amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would
include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the Ciry Engineer's, Fire Marshal's, Chief Building OfFicial's March
19, 2001, memos and the Recycling Specialist's February 25, 2002 memo shall be met;
4. that the project shall comply with the proposed demolition and construction recycling
ordinance recently approved by the Ciry Council;
5. that the project shall meet all the requirements of the California Building Code and
Califomia Fire Code, 1998 edition, as amended by the City of Burlingame.
