RECOMMENDATION: The City Council should hold a public hearing and take action. The conditions should be considered at the public hearing. Affirmative action should be by resolution and should include findings. The reason for any action should be clearly stated for the record. Plannin� Commission Action At their meeting on May 8, 1995 the Planning Commission held a public hearing and voted 3-3-1 (C. Ellis, Galligan and Mink dissenting and C. Deal abstaining) on a motion to approve the special permit and two variances. A tie vote results in denial of a motion since it requires a majority of the Commission (4 votes) to pass a motion. The final morion to approve was preceded by a motion to deny, which also failed for lack of a majority. In their discussion on both motions the Commissioners noted: the trees in the rear yard which the applicant wishes to retain are not of a protected size; there are alternatives on the site where the garage could be placed which conform to all code requirements; if the garage were located in the rear 30% of the lot, no side setback variance would be required; there are no exceptional circumstances or hardship on this property to use as a basis for findings for the requests, the applicant June 5, 1995 APPEAL OF PLAIVNING COMIVIISSION DECISION ON A SPECIAL PERMIT AND TWO VARIANCES FOR A SECOND STORY ADDITION AT 1421 BERNAL AVENUE, ZONED R-1. page -2- wishes to change the character of the house but not change the "cottage" garage to match the new character of the house. Other commissioners noterl that the special circumstances are that the garage was there, it is useable, and does not present a hardship to anyone in the neighborhood. BACKGROUND: Bob and Candace Savoie, the property owners, are requesting a special permit and two variances in order to make a 1,089 SF second floor addition and 71 SF first floor addition to the existing 1250 SF house at 1421 Bernal Avenue, zoned R-1. The extent of the remodel qualifies this house as new construction. The applicants wish the retain the existing 14'-4" x 18'-4" garage where a 10'-0" x 20'-0" garage is required. Retaining the garage causes two variances. The first variance is for side setback, 1'-6" provided, 4'-0" required, because the gazage is not locateti within the rear 30% of the lot. The second variance is for the depth of the garage, 18'-4" provided, 20'-0" required. One covered and one uncovered parking spaces are required for this new four bedroom house. Since the addition extends the rear of the house the project also needs a special permit for separation between structures, 2'-9" is provided from the corner of the house to the corner of the garage where 4'- 0" is required. If the eaves are not counted, the separation between the walls of the two structures is 5'- 9". The Commission received two letters regarding the project. One was from the residents directly to the south at 1417 Bernal. They stated that they were in support of the project. They opposed the cutting of trees which increase the privacy of their yard to move the garage to the rear at 1421. They were opposed to extending the length of the driveway because it would increase the noise on their property. They prefer the garage next to their house because it insures an open feeling to their back yard. Philip Alper owner of the property to the rear at 1424 Vancouver wrote in opposition. He notes that the rear view is the only view of value from his house. They do not wish to have it obstructed in any way; and therefore are opposed to any exception from the zoning on the property at 1421 Bernal. Following their request for an appeal of the Planning Commission's decision, the applicant has also submitted an additional letter (May 21, 1995) in support. The applicants chose to have this item set for the 7une 5, 1995 meeting understanding that a full Council would not be seaterl. In her letter Mrs. Savoie notes that the trees at the rear of the yard are 70 year old flowering plum trees. These trees provide privacy to both the neighbors at the sides as well as at the rear of their property. Their objective is to retain the recreation space in the rear yard. The cost of a new garage is relatively small given the cost of the remodel to the house. If the action is a variance, use permit, hillside area construction permit, fence exception or sign exception, the Council must make the findings as required by the code. Findings must be particular to the given property and request. Actions on use permits should be by resolution. A majority of the council members seated during the public hearing must agree in order to pass an affirmative motion. 2. City Council may deny an applicant�s request. The reasons for denial should be clearly stated for the record. 3. �City Council may deny a request without prejudice. Three conditions were suggested for consideration. CP Monroe read a letter into the record from Philip R. and Jeanne B. Alber, 1424 Vancouver Avenue, in opposition to the project. C. Deal noted he has a business relationship with the applicant and therefore he will abstain from the discussion and vote. C. Jacobs opened the public hearing. Bob Savoie, 1421 Bernal Avenue, the applicant, submitted a letter from a neighbor in support of his project. He explained their focus is to retain the style of the house and the character of the neighborhood, as well as to retain the large trees and play area in the rear yard. For these reasons they want to keep the existing garage. They park a car in it regularly. C. Galligan noted that the trees are not of a protected size and it is not unreasonable in this case since the lot allows it, to ask the applicant to conform to the code. He did not feel the request met the variance test since there are alternatives on the site which would comply with city regulations. He then moved to deny the special permit and parking variance portion and approve the side setback variance. Commission discussed the fact that if the garage were relocated to the rear 30% of the lot a side setback variance would not be needed. In addition there is a need for findings in order to approve any portion of this application. The motion died for lack of a second. -4- Burlingame Planning Commission Minutes May 8, 1995 C. First of all, during the May 8, 1995 Planning Commission meeting, the comment was made by one of the commissioners that trees don't matter unless they are one hundred year old redwoods. The trees that would be destroyed by moving the garage to the back of the lot are not ane hundred year old redwoods but they are seventy year old flowering plum trees. Besides the character and beauty they add to our immediate lot, the trees provide privacy for the neighbors to the south on Bernal(1417 Bernal) and for the neighbors directly behind us and to the left of them. I have not seen many houses that have these kind of trees and i feel that the situation is unusual and deserves special attention. Secondly, the issue is not one of cost. The price of building a garage is sma11 relative to the overall construction project. As stated in our original memo, we would very much like to preserve the recreation space in the back yard. Also, the garage functions perfectly as is. We plan on raising our family in Burlingame, sending our children to the City's fine schools and remaining active in the city as it progresses into the future. As residents of this Burlingame neighborhood for the past ten years, we support preservation of the character of the neighborhood. In fact, our own remodeling completed in 1990 preserved the architectural style of our house. We support the Savoie's attempt to avoid demolition of the existing garage that borders on our property. Construction of a new garage further back in the lot would require cutting down trees that provide shade and privacy to our yard. A longer driveway would only create more concrete and more noise as cars would go further along the edge of our property. The back (west) wall of the e�sting garage is about in the same position as the back wall of our house. Moving the garage back would create a boxy feeling in our yard with another side closed in by structure. The new addition creates 1,089 SF on the second floor and adds 71 SF to the first floor. With four bedrooms proposed, two parking stalls are required, one covered (10' X 20') and one uncovered (9' X 20'). The applicant proposes to retain the existing garage for the one covered parking stall (14'-4" X 18'-4"). A. A special permit is required for a 2'-9" separation between the new house and the existing garage, where 4'-0" is required. The new house will have 1'-6" and 2'-0" eaves and the existing garage has a 1'-0" eave. From eave to eave the separation between the two structures is 2'-9" from the corner of the house to the corner of the garage. From the face of the structures, without eaves, the separation is 5'-9". B. The existing garage is located outside the rear 30% of the length of the lot (120', 30% is 36'; garage is 48' from rear property line). In this case the garage must meet side and rear setback requirements. Since the existing garage has a 1'-6" side setback on the east side, where 4'-0" is required, a side setback variance is needed. The difference between the required amount for the setback and the existing side setback is 2'-6". C. The depth of the existing garage is 18'-4" where the code requires 20'-0" for one covered parking stall. A parking variance for garage depth is required for 1'-8", the difference between 18'-4" and 20'-0". One uncovered parking stall (9' X 20') is provided in the driveway in front of the garage. K. none Separation of Structures: *2'-9" 10'-0" (eave to eave) � SPECIAL PERMIT AND V.ARIANCES 1421 Bernal Avenue Study Meeting: At the April 24, 1995 Planning Commission study meeting the commission asked for plans that show the 2'-9" from eave to eave. The applicant has provided an 8'/a" X 11" plan dated April 28, 1995 showing the 2'-9" dimension between the eaves. The commission asked for clarification on the supplemental special permit and variance forms outlining the 'unnecessary hardship'. In his April 28, 1995 letter the applicant states three reasons for the 'hardship' to his property. First, the driveway would have to be lengthened adding more paving and removing landscaping on the property. This will not create any more parking area for the applicants' number of cars which currently park in the 72' long driveway. Secondly, relocating the garage would remove another 15' of rear yard which the family would rather use for recreational purposes. Finally moving the garage would mean removal of a tree and possible damage to the roots of another tree, reducing the amount of landscaping in the rear yard. The commission asked why the garage could not be moved to the rear 33 % of the lot. The applicant indicates that the zoning ordinance affecting the garage location was adopted many years after the garage was built. The existing garage is nonconforming and is currently located quite close to the house. Moving the garage would not affect the 'mass and bulk' appearance of the house and garage. To move the garage would cause the loss of one tree and damage to another tree the applicant would like to retain. Also 15' of rear yard would be eliminated and covered with driveway. This removes additional recreational space for the family. Could the eaves be trimmed at the corners to eliminate the need for a special permit? The applicant indicates that in order to have a 4'-0" separation the eaves from the garage and house would have to be reduced or removed. He feels the 'actual' separation is 4'-8" from the second floor wall to the garage eave, since the garage eave is 8 feet above grade and the house eave is 19 feet above grade. In this position the house will not appear 'too close' to the garage. Removing the eaves will affect the character of the house since it will no longer have matching eaves. The mass and bulk of the house and garage will not be affected. The distance between eaves is 2'-9". Can the eaves be reduced in length so there is at least a 4'-0" separation between eaves? In order to have 4'-0" of separation between the second floor eave and the garage eave it would require removing the eaves completely from the garage and reducing the eave along the Master Bath wall to 1'-0". � Our goal has always been to keep '"the addition in character with the original house. It would be architecturally incorrect to remove the eaves at the garage and to reduce so dramatically the eaves at the addition. Further, the eaves are not on the�same plane in that the garage eaves are approx, 8 feet above grade and the second floor eave is approx. 19 feet above grade. The proposed second floor wall is 4'-8" away �from the garage eave. It is our feeling that the garage will not appear "too close" to the house. Could you clarify the unnecessary hardships or property loss? Relocation of the gaiage which would result in an "unreasonable property loss" � for the following reasons. , • a. It would have us lengthen an already very long driveway adding more concrete instead of landscaping. A longer driveway serves us no purpose whatsoever since we can already park all our cars off the street. ' � � � b. It �would remove another �15' of year yard which we would use and cherish much more thatn a longer driveway. This is a , " substantial loss of recreational space we des�re for our family. c. Because of these "existing" conditions we feel there are extraordinary circumstances and conditions regarding our property that wanant the variance. Denial of the variance would result in additional length of driveway, loss of recreation space while not changing the "mass or bulk" of the garage. We could move it back 15 feet and be within the rear 30% resulting in unchanged "mass or bulk" while creating detrimental conditions to our property. . • 5. Our garage is an existing detached building which has been there since the house was built. b. We have used the existing garage to park one of our cars out of the elements since we bought the house. It has served that purpose well in the past and to simply tear it down to build another garage a few feet away and slightly longer would create an unnecessary hardship.
