Dear Mr. Thomas,
Since there was no appeal to or suspension by the City Council, the July 10, 2000 Planning Commission
approval of your design review application became effective August 7, 2000. This application was to allow
a new two-story single family residence at 1420 Bernal Avenue, zoned R-1.
The July 10, 2000 minutes of the Planning Commission state your application was approved with the
following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department We stamped
June 7, 2000, Sheets A 1.1. , A 1.2, A3 and T 1; and date stamped June 30, 2000, sheets A2, A4 and
A5, and that any changes to the footprint or floor area of the building shall require an amendment to
this permit;
2. that any changes to the size or envelope of the first or second floors, which would include adding or
enlarging a dormer(s), moving or changing windows and architectural features or changing the roof
height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's June 3, 2000 memo and the City Engineer's May
30, 2000 memo shall be met; and
4. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition,
as amended by the City of Burlingame.
Reimbursement of the unspent portion of your design review deposit has been processed and will be mailed
to you under separate cover.

All site improvements and construction work will require separate application to the Building Department.
This approval is valid for one year during which time a building permit must be issued. One extension of up
to one year may be considered by the Planning Commission if application is made before the end of the first
year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90
days of the date of the decision unless a shorter time is required pursuant to state or federal law.

This project meets all zoning code requirements; the proposed garage meets all accessory structure requirements per
C.S. 25.60.

Design Review 1420 Bernal Avenue
Staff Comments: The City Engineer notes (May 30, 2000 memo) that 1) a property survey by a licensed surveyor
is required and all property corners shall be set; 2) a sewer lateral test is required in accordance with city standards;
and 3) the roof drainage, site drainage and foundation drainage shall be to the city's storm drain or the frontage
street. The Chief Building Inspector notes (June 3, 2000 memo) that 1) garage is to have one hour construction with
no openings along property lines; 2) the skylight is to have ICBO number; and 3) show more detail on windows at
mechanical pit regarding exiting. Planning staff would note that details of the mechanical pit have been provided,
and that a survey is included in the plans submitted. The Fire Marshal had no comments on the project.
Preliminary Design Review Study Meeting: On June 26, 2000, the Planning Commission reviewed this project
for preliminary design review (see attached June 26, 2000, P.C. Minutes). The Planning Commission noted that the
design guidelines were used to advantage, simple but elegant touch in design, but are concerned that the entry is not
pedestrian friendly. The commission noted that they are concerned about the 10 foot plate height and the large entry,
another window could be added on the second floor in the front bedroom, the front of the structure has a closed
feeling.
The commission recommended that this item be placed on the consent calendar for action with the direction that the
front of the house be modified as directed by the Planning Commission. The applicant has submitted revised Sheets
A-2, A-4 and A-4, floor plans and elevations date stamped June 30, 2000, and submitted a letter of explanation date
stamped June 30, 2000. The following changes were made to the design: 1) the overall height of the house has been
reduced by 12"; the plate height at the second floor has been reduced from 10' to 9'; the plate height at the single
story living room has been reduced from 12' to 11'; the plate height at the entry and second story stair has been
reduced from 14' to 13'; the windows at the front facade of the building have been reduced in size in proportion to
the reduced height of the living room; and windows have been added at the front facade along the second story and
at the covered entry.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council
on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
Landscaping and its proportion to mass and bulk of structural components.
Findings: Based on the findings stated in the attached minutes of the Planning Commission's June 26, 2000,
preliminary study meeting and on the changes made in response to Planning Commission's comments, the project
is found to be compatible with the requirements of the City's five design review guidelines.

Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should
be by resolution and include findings, and the reasons for any action should be clearly stated. At the public hearing
the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped June
7, 2000, Sheets Al. I., A1.2, A3 and T1; and date stamped June 30, 2000, sheets A2, A4 and A5, and that
any changes to the footprint or floor area of the building shall require an amendment to this. permit;

CP Monroe briefly presented the staff report with staff comments attached. There were no questions about the project
from the commission.
Chairman Luzuriaga opened the public comment. Mark Thomas, architect 440 Spear Street, San Francisco, represented
the project. This is a new two story, 3400 SF house designed for the owners with consideration of the architectural
design and detail of the neighborhood, as well as the architecture in the city as whole. Commissioners asked: what
treatment do you intend for the post in the porch at the rear, what about gutter detail and roof, have you considered
dressing these up. Applicant noted no special treatment is intended, it could use a carved post with scale and detail the
match the wood lentils. Rafter extensions are not shown in all the elevations; applicant noted drawing are not
completed, applicant noted the rhythm is not the same on all elevations but they work on each element. Could add
another window on the second floor at the front in the front bedroom; not enough room between the flashing of the roof
over the living room and the plate height; could it be made smaller, applicant is not interested. The front of the structure
has a closed feeling: number of planes without openings, applicant noted can provide something as an option.
Mary Packard, 1441 Bernal, spoke noting that the letter she submitted referred to the second project on this street in
the packet 1445 Bernal. There were no other comments from the floor and the public comment was closed.
C. Keighran noted used the design guidelines to advantage, simple but elegant touch in design, concerned about the
entry not being pedestrian friendly. She then made a motion to place the project at 1420 Bernal on the consent calendar
at the next meeting with the direction that the front of the house be modified as directed by the Planning Commission.
The motion was seconded by C. Osterling.
On the motion: See this project in the opposite, do not feel it is in scale with the neighborhood, the front window is
bigger than the garage door, it has a 10 foot plate and a large entry, there is nothing like this in the neighborhood except
those houses recently built which have more embellishment, this looks as if it would be appropriate on Easton, cannot
support the motion. Missed the garage door, scale with itself looks good , agree the 9 foot plate on the first floor
actually 10 feet from ground and the 12 foot plate on the second floor are a wake up; differ on the window, my house
has big windows at the front and a porch on the side and it works well; there are large houses across the street, good
submittal, restrained not too much embellishment, could be more open to the street, drawings are clear, can support it
as it is; feel it is compatible, could use shrubs to soften and its a good thing to remove the Acacia at the rear.
Chairman Luzuriaga called for a roll call vote on the motion to refer this item to the consent calendar. The motion
passed on a 4-3 (Cers. Deal, Dreiling, Bojues dissenting) vote. The commission's action is advisory and is not subject
to appeal. The item ended at 9:30 p.m

As you requested I have inspected the trees on your property at 1420 Bernal Avenue, Burlingame,
CA 94010. 1 have listed the trees, diameters, location, condition and have included
recommendations.
I. Citrus — 8" DBH - Center of backyard, good condition. This is a viable tree, needs some
thinning, can stay or be removed depending on plans for yard,
2. 4 Italian Cypress — 4" DBH — North side of backyard, good condition. These trees are
generally used for a privacy barrier, but are planted too far apart to provide privacy at this
point.
3. Privet — 14"DBH — North east corner of backyard, fair to poor condition. This tree is
covered in ivy and has grown quite large for it's spot. Remove and replant.
4. Walnut — 18"DBH — North side of backyard, poor condition. The bark is falling off the
trunk, little live growth. Remove
5. Pear — 4"DBH — South side of backyard, poor condition. Improperly pruned over the years.
Remove
b. Black Acacia — 40"DBH — in easement, fair condition. Tree is weighted and unbalanced
over your yard, there is die back of branches in crown. Severe pruning would be needed to
balance and safety prune this tree. Compaction of soil during construction, root damage and
loss of oxygen due to hardscaping will put this tree in further decline. Remove this tree
before construction begins.
7. Coast Live Oak — 20"DBH - North side frontyard, good condition.
S. Sycamore — 28" DBH — Street (city) tree, good condition. No recommendations at this time.

RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND DESIGN REVIEW
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for sign
review for new two-story single family residence with detached garaee at 1420 Bernal Avenue, zoned
R-1, Todd and Christine Dow, property owners, APN• 026-053-150;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
July 10, 2000 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial -evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15303, Class 3, construction and location of limited numbers of new, small
facilities or structures including (a) single-family residences not in conjunction with the building of two or
more such units is hereby approved.
2. Said design review is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such design review are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped June 7, 2000, Sheets A1.1., A1.2, A3 and T1; and date stamped June 30,
2000, sheets A2, A4 and A5, and that any changes to the footprint or floor area of the
building shall require an amendment to this permit;
2. that any changes to the size or envelope of the first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or
changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's June 3, 2000 memo and the City
Engineer's May 30, 2000 memo shall be met; and
4. that the project shall meet all the requirements of the California Building and Fire Codes,
1998 edition, as amended by the City of Burlingame.
