Dear Mr. Baldwin,
Since there was no appeal to or suspension by the City Council, the June 25, 2001 Planning Commission
approval of your design review amendment application became effective July 2, 2001. This application was to
allow for an amendment to the approved detached garage at 1420 Bernal Avenue, zoned R-1.
The June 25, 2001 minutes of the Planning Commission state your application was approved with the following
conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped
June 7, 2000, sheets A1.1, A1.2, A3 and T1; date stamped June 30, 2000, sheets A2, A4 and A5; and that
the detached garage shall be built as shown on the plans submitted to the Planning Department date
stamped June 14, 2001, sheets A1 and A2, with removal of all four of the barge rafters, and that any
changes to the footprint or floor area of any buildings on site shall require an amendment to this permit;
2. that any changes to the size or envelope of the first or second floors, which would include adding or
enlarging a dormer(s), moving or changing windows and architectural features or changing the roof
height or pitch, shall be subject to design review;
that the Chief Building Official's June 3, 2000 memo and the City Engineer's May 30, 2000 and June
18, 2001 memos shall be met;
4. that if the detached two-car garage is ever demolished, damaged exceeding 50% of its value or destroyed
in which case it is required to be rebuilt, it shall be rebuilt only in compliance with the current code in
affect at that time, and a survey shall be required and property lines established to ensure that the entire
detached garage will be built on this property and that no portion of the garage will extend over any
property line;

5. that the special encroachment permit for the garage to extend 3 3/4" into the public right-of-way at the rear
of the property shall become void if the detached garage is ever enlarged, rebuilt, demolished or
destroyed; and
6. that the project shall meet all the requirements of the California Building Code and California Fire Code,
1998 edition, as amended by the City of Burlingame. The motion was seconded by C. Bojues.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

CEQA Status: Article 19. Categorically Exempt per Section: 15303 - Class 3- construction and location of
limited numbers of new, small facilities or structures including (a) single-family residences not in conjunction
with the building of two or more such units. In urbanized areas, up to three single-family residences may be
constructed or converted under this exemption.
Summary: In July 2000, the Planning Commission approved a design review application for a new two-story
single family dwelling and detached two-car garage at 1420 Bernal Avenue, zoned R-1 (approved by consent
calendar).
In September 2000, a building permit was issued for the construction of the new house and detached garage.
On a recent site inspection to confirm property corners, the Engineering Department noted that a portion of the
detached garage encroached 8 3/4" into the city easement located behind the subject property. At the time the
encroachment was noticed, the garage had already been built. The applicant was notified of the encroachment
and submitted revised plans documenting the amount of encroachment. The plans date stamped June 14,
2001, show how the detached garage was built (proposed), including floor plans and building elevations. Also
included in the staff report for review is a copy of the garage building elevations as originally approved by the
Commission (11" x 17" sheet). The applicant, John Miller of City Building Inc., also submitted a written
letter, dated June 14, 2001, explaining how the encroachment occurred. He notes that the form board for the
garage foundation was accidentally set to the wrong side of the property line at the southeast corner of the
garage and was overlooked at the time of framing. The applicant indicates that the foundation does not
encroach into the easement, but that a portion of the cement plaster and roof tile on the rear wall of the garage
extend over the rear property line. The garage was built at a slight angle in relationship to the rear property
line, which caused the south end of the face of the cement plaster to encroach 2%2 inches and the roof tile to
encroach 8'/4 inches into the easement at the rear right corner of the lot.
In order to reduce the encroachment of the roof tile into the easement, the applicant is proposing to eliminate
the roof eave along the rear wall of the structure (see attached roof details, 8'/Z"xl l" sheet), which would
reduce the encroachment by 5 inches, from 8 3/4 inches to 3 3/4 inches. The 1 x 6 trim would be removed and
the roof tile would be installed flush with the 2 x 10 barge board.
Planning staff would note that the garage was built with barge rafters, which extend about 18" across the side
property line into the neighbor's property on the right side (not shown on the plans). The applicant has agreed
to remove all barge rafters so that they don't extend over the property line. There were no barge rafters shown
on the originally approved plans. The detached garage was built without decorative clay pipe screened vents
and outriggers on the rear wall. Planning staff would also note that an application has been submitted to the
Public Works Department for a special encroachment permit for the 3 3/a" encroachment of the cement plaster
and roof tile into the easement. The applicant submitted a$10,800 bond to cover the cost of relocating the
rear wall of the garage completely onto private property, if the Commission required it. This was done so that

the contractor could obtain a temporary occupancy permit for the house, since the owners are anxious to move
in. This change to the garage is being brought to your attention since condition #1 of the approved project
requires any revisions to the plans approved by the Planning Commission to be reviewed.
Staff Comments: See attached. Planning staff would note that because of the nature of the request to amend
an approved design review project, it was determined that it could be brought forward directly to the action
calendar. If the Commission feels there is a need for more study, this item may be so directed.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on Apri120, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be by resolution and include findings made for design review, and the reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
June 7, 2000, sheets A1.1, A1.2, A3 and T1; date stamped June 30, 2000, sheets A2, A4 and A5; and that
the detached garage shall be built as shown on the plans submitted to the Planning Deparhnent date
stamped June 14, 2001, sheets A1 and A2, and that any changes to the footprint or floor area of any

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
DESIGN REVIEW AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for desi�n
review amendment for a to an approved new sin�le familv dwelling and detached garage at 1420 Bernal
Avenue, zoned R-1 Todd Dow propertv owner APN• 026-053-150;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on June
25, 2001, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19. Categorically Exempt per Section: 15303 - Class 3- construction and location of limited
numbers of new, small facilities or structures including (a) single-family residences not in conjunction with
the building of two or more such units. In urbanized areas, up to three single-family residences may be
constructed or converted under this exemption, is hereby approved.
2. Said design review amendment is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such design review amendment are as set forth in the minutes and recording of
said meeting.
3.
It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval for categorical exemption and design review amendment.

effective July 2, 2001
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped June 7, 2000, sheets A 1.1, A 1.2, A3 and T 1; date stamped June 30, 2000, sheets
A2, A4 and A5; and that the detached garage shall be built as shown on the plans submitted
to the Planning Department date stamped June 14, 2001, sheets A1 and A2, and that any
changes to the footprint or floor area of any buildings on site shall require an amendment to
this permit;
2. that any changes to the size or envelope of the iirst or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or
changing the roof height or pitch, shall be subject to design review;
3. that the Chief Building Official's June 3, 2000 memo and the City Engineer's May 30, 2000
and June 18, 2001 memos shall be met;
4. that if the detached two-car garage is ever demolished, damaged exceeding 50 % of its value
or destroyed in which case it is required to be rebuilt, it shall be rebuilt only in compliance
with the current code in affect at that time, and a survey shall be required and property lines
established to ensure that the entire detached garage will be built on this property and that no
portion of the garage will extend over any property line;
5. that the special encroachment permit for the garage to extend 3 3/a " into the public right-of-
way at the rear of the property shall become void if the detached garage is ever enlarged,
rebuilt, demolished or destroyed; and
6. that the project shall meet all the requirements of the California Building Code and California
Fire Code, 1998 edition, as amended by the City of Burlingame.
