RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
amendment to desi�n review for chan eg s to aprevi�usly approved second story addition at 1625
Howard Avenue zoned R-1 Eileen M Stanley and Daniel Conwav propertv owners, APN: 028-
316-290;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 26, 2007, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of t�e Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19. Section: 15301 Class
1(e)(1) - additions to existing structures provided the addition will not result in an
increase of more than 50% of the floor area of the structures before the addition.
2. Said design review amendment is approved, subject to the conditions set forth in Exhibit
"A" attached hereto. Findings for design review amendment are as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

l. that the project shall be built as shown on the plans submitted to the Planning Deparhnent and
date stamped February 1, 2007 sheets A-1.0, A-2 and A-3, date stamped March 14, 2006,
sheets A-0 through A-6, and that any changes to building materials, exterior finishes, footprint
or floor area of the building shall require an amendment to this permit;
2. that the conditions of the Chief Building Official, City Engineer, Fire Marshal, Recycling
Specialist, and the NPDES Coordinator's March 14, 2006 memos shall be met;
3. that if the structure is demolished or if the building envelope is ever changed at a later date, the
parking variances shall become void and the side setback requirements in effect at the time of
demolition or additional remodel also shall be met;
4. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be required
to comply with all the regulations of the Bay Area Air Quality Management District;
5. that any changes to the size or envelope of the basement, first or second floors, or garage,
which would include adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to Planning
Commission review;
6. that prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification
that the architectural details shown in the approved design which should be evident at framing,
such as window locations and bays, are built as shown on the approved plans; architectural
certification documenting framing compliance with approved design shall be submitted to the
Building Division before the final framing inspection shall be scheduled;
7. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of
the roof ridge and provide certification of that height to the Building Department;
8. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans;
9. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
10. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2001 Edition, as amended by the City of Burlingame;
11. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to

1) All construction must comply with the 2001 California Buitding Codes (CBC),
the Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
2) Provide fully dimensioned plans.
3) Provide existing and proposed elevations.
4) Provide a legend that indicates the existing walls, walls to be demolished, and
new walls.
5) Comply with the new, 2005 California Energy Efficiency Standards for low-rise
residential buildings. Go to http�//www.enerqy.ca.qov/title24 for publications

6) Exterior bearing walls less than three feet from the property line must be
constructed of one-hour fire-rated construction and no openings are allowed.
NOTE: The existing garage appears to be constructed on the property line.
This structure must be constructed of one-hour fire-rated construction.
7) Provide guardrails at all landings. NOTE: All landings more than 30" in height
at any point are considered in calculating the allowable floor area. Consult the
Planning Department for details if your project entails landings more than 30"
in height.
8) Provide handrails at all stairs where there are more than four risers.

10)The fireplace chimney must terminate at least two feet above any roof surface
within ten feet.

While the project appears to not require sprinklers based upon proposed addition
and remodel, the project is close. Be advised where more than one (1) addition
and/or alteration for which building permits are required are made within a two (2)
year period and said alterations are made to the premises of the same occupant. In
such circumstances, the sum of these additions and/or alterations construction costs
during this two (2) year period shall be aggregated for the purpose of calculating the
replacement cost value formula. Final determination will be made and the plan
review phase of the project.
It is very important that you understand the threshold indicated by BMC §17.04.030.
Designer, contractor, and owner should communicate specifically the extent of
demolition and remodel. Keeping in mind any change orders and addendums
which increase the total amount of square footage added or remodeled after
plan review would be applied to the sprinkler ordinance.

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not limited
to ensuring that all contractors implement construction Best Management Practices
(BMPs). For guidance on what these BMPs are, please refer to the attached
brochure. Please include appropriate BMPs as plan notes.
Discharge from any construction activity is prohibited from accessing the storm drain
system.
The public right of way or easement is not allowed to be used as a construction
staging area and should not be used for any construction-related activity.
Brochures and literatures on stormwater pollution prevention and BMPs are available
at the Planning and Building departments. Distribute to all project proponents.

CEQA Status: Article 19. Categorically Exempt per Section: 15303, Class 3—(a) construction of a limited
number of new, small facilities or structures including (a) one single family residence or a second dwelling unit in
a residential zone. In urbanized areas, up to three single-family residences maybe constructed or converted under
this exemption.
History: On May 8, 2006, the Planning Commission approved by consent calendar an application for design
review, special permit and parking variances for a second story addition (May 8, 2006, P.C. Minutes). A building
permit was issued on October 24, 2006, and construction is underway.
Proposed Revisions: The applicant is now requesting an amendment to design review for changes to a
previously approved second story addition at 1625 Howard Avenue, zoned R-1. The applicant submitted revised
plans, dated stamped February 1, 2007, which include the following proposed revisions:
■ Replace two existing windows in bedroom number two on the second story, facing the rear of the house,
with two inward swinging French doors; and
■ Add a new 18 SF uncovered balcony (6' x 3') off of the new French doors in bedroom number two on the
second story, facing the rear of the house, therefore increasing the existing lot coverage by 18 SF.
The proposed changes do not increase the previously approved floor area because the proposed balcony on the
second floor projects over an exit area on the first floor, therefore, this area is included in the covered porch
exemption (2,795 SF, 0.52 FAR approved and proposed where 2,814 SF, 0.52 FAR is the maximum allowed).
There are no other changes proposed to the project. The applicant is requesting the following:
■ Amendment to design review for changes to a previously approved second story addition (C.S.
25.57.010).
Summary (includes proposed revisions, plans date stamped February 1, 2007): The existing two-story
house, with an attached garage, contains 2,312 SF (0.43 FAR) of floor area and has three bedrooms. The 378 SF
second floor is tucked within the roof structure and is currently has only one bedroom. The proposed second
story addition would add 587 SF and bring the second floor total to 965 SF. With the proposed addition, the
floor area will increase from 2,312 SF (0.43 FAR) to 2,795 SF (0.52 FAR) where 2,814 SF (0.52 FAR) is the
maximum allowed. The proposed project is 19 SF below the maximum allowed FAR.
The code requires two covered parking spaces (20' x 20') and one uncovered parking space (9' x 20') for this
five bedroom house. The den on the first floor meets the code definition of a bedroom and is therefore counted
as such. There is one covered parking space (8'6" x 18') provided in the existing attached garage and one
uncovered space (9' x 20') provided in the driveway. Therefore, a parking variance is required for one covered
parking space where two are required and for parking space dimension for the existing covered parking space that
is 8'6" wide by 18' deep where a 10'wide by 20' deep space is required. As proposed 20 SF along the right side
of the second floor encroaches into the declining height envelope and requires a special permit. The following

Staff Comments: See attached. Planning staff would note that since this request is an amendment to a
previously approved project, the amendment was taken directly to action. If the Commission requires any
additional information before action, this item can be continued.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be by resolution and include findings made for amendment to design review and the reasons for any action
should be clearly stated. At the public hearing the following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
February 1, 2007 sheets A-1.0, A-2 and A-3, date stamped March 14, 2006, sheets A-0 through A-6, and
that any changes to building materials, exterior finishes, footprint or floor area of the building shall
require an amendment to this permit;
2. that the conditions of the Chief Building Official, City Engineer, Fire Marshal, Recycling Specialist, and
the NPDES Coordinator's March 14, 2006 memos shall be met;

VARIANCE APPLICATION FOR GARAGE LENGTH
a. This variance request is to retain an existing condition. The length of the garage is
non-conforming at just under 18'. This garage is unique in that it is attached to the
house and has one wall on the interior property line. The garage cannot be
extended to conform to the required 20' depth because even non-conforming
setbacks can only be e�ended with a minimum 3' setback from the property line.
There is also obviously no way to expand the width to make it into a two car
garage.
b. Garages of this length are not uncommon in this neighborhood. Most cars will fit
easily into the garage, including those of the residents. It would be unreasonable
to have to tear the garage off the house and construct a detached garage in the
back of the property, destroying the yard, in order to conform to the garage
length. Due to the configuration of the existing structures, a detached two car
garage will not fit on this property; it would end up being only 30" from the house
on one side which is not allowed in Burlingame, and also force the owner to pave
the entire backyard. While technically he would be, it's not the owner's desire to
create a five bedroom house; the front room downstairs will be a study, and the
other downstairs bedroom will be a guest room. That kicks in a two car garage
requirement that could be circumvented by opening the stair railing to the study or
opening up the guest room to the dining room, but the owners don't want to
pursue a silly solution; they do want the family sleeping on the same floor of the
house.
c. The proposed use at the proposed location will not be detrimental or injurious to
property or improvements in the vicinity or to public health, safety, general
welfare, or convenience. There are no proposed changes that would impact public
health, safety, or convenience; in fact, there are no changes being proposed.
d. The proposed project will be compatible with the aesthetics, mass, bulk, and
character of the existing and potential uses on adjoining properties in the general
vicinity. The garage structure and use would not be altered, and therefore would
not create any new compatibility or aesthetic impact, and has no impact on
adjoining properties.

Note: The trigger for the Special Permit in this case is a proposed dormer that e�ends
into the Declining Height Envelope (DHE) and does not meet the 25% glazing
requirement that would exempt this intrusion. The proposed area of the structure where
this occurs is built over an existing attached garage that was built at the right side
property line.
The mass, scale, and dominant structural characteristics of the new construction
are consistent with the existing street and neighborhood. The footprint of this
house with it's new addition have not increased nor is the height of the addition
higher than the existing ridge line. The new massing of this house is comparable
with the wide variety of houses on the street (in tenns of style, mass, scale etc. ..)
and only about 1/3 of this new addition is visible from the street. The steep
`Tudor' roof pitch and stucco siding has been incorporated into the addition to
keep consistent with the existing structure.
2. The rooflines, fa�ade, materials, and elevations of the proposed addition are,
again, consistent with the neighborhood and street. The proposed materials and
detailing form a seamless transition from the existing structure to the new area.
The proposed addition will use the materials to match existing materials, the roof
pitch of 18/12 will also be used but side dormers with 6/12 pitch will help soften
the massing (6/12 pitch is currently used on existing roof area at the rear of the
house) and keeping with the existing type of roof lines, only gables are being
proposed for the new addition (as hipped roofs are not part of the `Tudor' style).
3. 1. The architectural style is compatible with the character of the neighborhood.
2. The existing garage is substandard in length (17'-9") and a variance
application is part of this package (see Attachment A). Parking remain unchanged

4. The proposed second floor addition is not built directly above the exterior
walls, but has been brought in on both sides to be sensitive to both Burlingame
building regulations and to proximity to adjacent neighbors.

While the project appears to not require sprinklers based upon proposed addition
and remodel, the project is close. Be advised where more than one (1) addition
and/or alteration for which building permits are required are made within a two (2)
year period and said alterations are made to the premises of the same occupant. In
such circumstances, the sum of these additions and/or alterations construction costs
during this two (2) year period shall be aggregated for the purpose of calculating the
replacement cost value formula. Final determination will be made and the plan
review phase of the project.
It is very important that you understand the threshold indicated by BMC §17.04.030.
Designer, contractor, and owner should communicate specifically the extent of
demolition and remodel. Keeping in mind any change orders and addendums
which increase the total amount of square footage added or remodeled after
plan review would be applied to the sprinkler ordinance.

Conditions of approval for categorical exemption and amendment to design review

Effective March 8, 2007
1. that the project shall be built as shown on the plans submitted to the Planning Department and
date stamped February l, 2007 sheets A-1.0, A-2 and A-3, date stamped March 14, 2006,
sheets A-0 through A-6, and that any changes to building materials, exterior finishes, footprint
or floor area of the building shall require an amendment to this permit;
2. that the conditions of the Chief Building Official, City Engineer, Fire Marshal, Recycling
Specialist, and the NPDES Coordinator's March 14, 2006 memos shall be met;
3. that if the structure is demolished or if the building envelope is ever changed at a later date, the
parking variances shall become void and the side setback requirements in effect at the time of
demolition or additional remodel also shall be met;
4. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be required
to comply with all the regulations of the Bay Area Air Quality Management District;
5. that any changes to the size or envelope of the basement, first or second floors, or garage,
which would include adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to Planning
Commission review;
6. that prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification
that the architectural details shown in the approved design which should be evident at framing,
such as window locations and bays, are built as shown on the approved plans; architectural
certification documenting framing compliance with approved design shall be submitted to the
Building Division before the final framing inspection shall be scheduled;
7. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of
the roof ridge and provide certification of that height to the Building Department;
8. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans;
9. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
10. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2001 Edition, as amended by the City of Burlingame;
11. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to

submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition
of a structure, interior or exterior, shall require a demolition permit; and
12. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance.
