Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section15303 (e), which states that construction and location of limited
numbers of new, small facilities or structures including accessory (appurtenant) structures including garages,
carports, patios, swimming pools and fences is exempt from environmental review.
Project Description: The site currently contains a one-story, three-bedroom house and a detached one-car
garage (199 SF, 12'-3" x 16'-3"). Burlingame Creek traverses the rear of the lot; there is an existing large
Redwood tree between the creek and the existing detached garage. The applicant is proposing to replace the
existing nonconforming detached one-car garage and with a new code compliant 288 SF (12'-6" x 23'-0")
detached one-car garage in its place. With the new detached garage, the floor area for the entire property will
increase from 2,171 SF (0.28 FAR) to 2,260 SF (0.29 FAR), where 3,847 SF (0.50 FAR) is the maximum allowed
(project is 1,587 SF below the maximum allowed FAR).
The existing detached garage is located within the rear 45% of the lot due to the location the creek. The
applicant is proposing to replace the existing detached garage in the same location given the location of the
creek. Since the proposed detached garage is located forward of the rear 40% of the lot (rear 46% proposed) it
must comply with side setback requirements, which in this case is 5'-0". A Side Setback Variance is required
since the proposed detached garage is located 1'-2" from the right side property line where 5'-0" is the minimum
required (the existing detached garage is located 1'-2" from the right side property line).
Two parking spaces, one of which must be covered, are required for the existing three-bedroom house. The
existing detached garage, which is nonconforming in length (15'-5'h" clear interior dimension), will be removed
and replaced with a new conforming detached garage (11'-6" x 22'-0" clear interior dimensions) which will
provide one (1) covered space (10' x 20' minimum clear interior dimensions required); one (1) uncovered space
(9' x 20') is provided in the driveway. All other zoning code requirements have been met. The applicant is
requesting the following application:

Planning staff would note that since this request for Side Setback Variance is for replacement of an existing
nonconforming one-car garage with a code compliance one-car garage in its place, the application was placed
directly on the action calendar. If the Commission feels there is a need for more discussion, this item may be
placed on a future action calendar for a second review and/or public hearing with direction to the applicant.

Required Findings for Variance: In order to grant a variance for side setback the Planning Commission must
find that the following conditions exist on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or conditions applicable to the property involved
that do not apply generally to property in the same district;

(b) the granting of the application is necessary for the preservation and enjoyment of a substantial property
right of the applicant, and to prevent unreasonable property loss or unnecessary hardship;
(c) the granting of the application will not be detrimental or injurious to property or improvements in the
vicinity and will not be detrimental to the public health, safety, general welfare or convenience; and
(d) that the use of the property will be compatible with the aesthetics, mass, bulk and character of existing
and potential uses of properties in the general vicinity.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
August 5, 2013, sheets A0.1, A1.0 and A2.0 and that any changes to footprint or floor area of the
accessory structure shall require an amendment to this permit;
2. that the detached garage shall only be used for parking and shall not be used for accessory living or
sleeping purposes;
3. that if the accessory structure is demolished or the envelope changed at a later date the Side Setback
Variance as well as any other exceptions to the code granted here will become void;
4. that the conditions of the Chief Building Official's July 3, 2013 memo, the City ArborisYs July 9 and
August 7, 2013 memos, the City Engineer's August 8, 2013 memo and the Stormwater Coordinator's July
15, 2013 memo shall be met;
5. that demolition or removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
6. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit; and
7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2010
Edition, as amended by the City of Burlingame.

The Planning Commission is required by law to make findings as defined by the City's Ordinance
(Code Section 25.54.020 a-d). Your answers to the following questions can assist the Planning
Commission in making the decision as to whether the findings can be made for your request.

The location of Burlingame Creek to the rear of the property, and the inclined slope from the backyard down to the
creekbed, which bounds the property on a diagonal heading along the property line, eliminates any other feasible
alternative to the existing garage location. Moreover, the existing principal entryway into the home is located on
the east side of the house, along the existing driveway, requiring the garage to be located in its present location
toward the rear of the property. __ ___.____ ___
b. Explain w y t e variance request is necessary for the preservation and enjoyment of a
substantial property right and what unreasonable property /oss or unnecessary
hardship might result from the denial of the application.
The variance is intended to re-build a dilapidated existing garage that is the only vehicle enclosure on the property.
Without the variance there would be no enclosed garage that could be built on the property. A single-family
residence without a garage would be difficult to re-sell, and would be a hardship in bad weather.
c. Explain why the proposed use at the proposed /ocation will not be detrimental or
injurious to property or improvements in the vicinity or to public health, safety,
general welfare or convenience.
The variance is necessary to replace an existing structure which is typical of the homes bordering the creek. The
existing structure provides security in lieu of a fence for the property and the adjoining property. The
improvement will upgrade existing electrical, and remove a dilapidated structure. The variance would allow
improvement to a necessary existing structure and would have no adverse effect on the public health, safety,
general welfare or convenience.
d. How will the proposed project be compatible with the aesthetics, mass, bulk and
character of the existing and potential uses on adjoining properties in the general
vicinity?
The project will not alter the aesthetics, mass, bulk, or character of any current or potential uses for adjoining
properties, as it will rebuild the garage in the same style, and essentially the same dimensions as the existing
structure. The new structure will be more pleasing as it will not appear to be about to fall down.

On the plans specify that this project will comply with the 2010 California Building
Code, 2010 California Residential Code (where applicable), 2010 California
Mechanical Code, 2010 California Electrical Code, and 2010 California Plumbing
Code, including all amendments as adopted in Ordinance 1856-2010. Note: If the
Planning Commission has not approved the project prior to 5:00 p.m. on
December 31, 2013 then this project must comply with the 2013 California
Building Codes.
Specify on the plans that this project will comply with the 2008 California Energy
Efficiency Standards.

submit a Revision to the City for any work not graphically illustrated on the Job
Copy of the plans prior to performing the work.
Anyone who is doing business in the City must have a current City of Burlingame
business license.

8) This project will be considered a New Building because, according to the City of
Burlingame Municipal code, "when additions, alterations or repairs within any

existing building or structure, as determined by the building official, such building
or structure shall be made in its entirety to conform with the requirements for new
buildings or structures." This building must comply with the 2010 California
Building Code for new structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be
submitted to, and approved by, the Building Division prior to the implementation
of any work not specifically shown on the p/ans. Significant delays can occur if
changes made in the field, without City approval, necessitate further review by
City departments or the Planning Commission. Inspections cannot be scheduled
and will not be performed for work that is not shown on the Approved plans.

completed Supplemental Demolition Permit Application. NOTE: The Demolition

Copper from Buildings May Harm Aquatic Life
Copper can harm aquatic life in San Francisco Bay. Water that comes
info contact with architectural copper may contribute to impacts,
e specially during installation, cleaning, treating, or washing, Patination
solutions that are used to obtain the desired shade of green or brown
typically contain acids. After treatment, when the copper is rinsed to
remove these acids, the rinse water is a source of pollutants.

• If patination is done on-site, implement one or more of the following BMPs:
o Discharge the rinse water to landscaping. Ensure that the

o Collect rinse water in a tank and pump to the sanitary
sewer. Contact your local sanitary sewer agency before
discharging fo the sanitary sewer.
o Collect the rinse water in a tank and haul off-site for
proper disposal.
• Consider coating the copper materials with an impervious
coating that prevents further corrosion and runoff. This will
also maintain the desired color for a fonger time, requiring
less maintenance.
During Maintenance
Implement the following BMPs during routine maintenance activities, such as power washing the roof,
re-patination or re-application of impervious coating:
• Block storm drain inlets as needed to prevent runoff from entering storm drains.
• Discharge ihe wash water to landscaping or to the sanitary sewer (with permission from the local
sanitary sewer agency). If this is not an option, haul the wash water off-site for proper disposal.

If you are responsible for a discharge to the storm drain of non-
stormwater generated by instaliing, cleaning, treating or washing
copper architectural features, you are in violation of the municipal
stormwater ordinance and may be subject to a fine.

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per CEQA Article 19, Section15303 (e),
which states that construction and location of limited numbers of new, small facilities or
structures including accessory (appurtenant) structures including garages, carports,
patios, swimming pools and fences is exempt from environmental review, is hereby
approved.
2. Said Side Setback Variance is approved subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Side Setback Variance are set forth in the staff
report, minutes, and recording of said meeting.

date stamped August 5, 2013, sheets A0.1, A1.0 and A2.0 and that any changes to
footprint or floor area of the accessory structure shall require an amendment to this
permit;
that the detached garage shall only be used for parking and shall not be used for
accessory living or sleeping purposes;
that if the accessory structure is demolished or the envelope changed at a later date the
Side Setback Variance as well as any other exceptions to the code granted here will
become void;
4. that the conditions of the Chief Building Official's July 3, 2013 memo, the City Arborist's
July 9 and August 7, 2013 memos, the City Engineer's August 8, 2013 memo and the
Stormwater Coordinator's July 15, 2013 memo shall be met;
5. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall
be required to comply with all the regulations of the Bay Area Air Quality Management
District;
6. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit; and
7. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2010 Edition, as amended by the City of Burlingame.
