SUBJECT: VARIANCE FOR SIDE YARD SETBACK FOR A GARAGE
AT 1612 HOWARD AVENUE, ZONED R-1
Paula Poor is effectively requesting an extension to the side
setback variance granted on January 4, 1984 to allow a new 360 SF
garage to be built in the side setback (0' requested, 5' required)
(Code Sec. 25.66.050). In fact, because of the time limitations
in the zoning ordinance, she needs to have a new variance (Code
Sec. 25.16.130).
After receiving the side setback variance in 1984, the applicant's
contractor applied for a demolition permit (February 3, 1984) for
the existing garage and a building permit (No. 7121, March 23,
1984 ) to build a family room/den addition to the house and a new
garage. The garage was demolished. Then construction on the
addition to the house commenced along with regular inspections,
until the point of final inspection. Final inspection was never
done because the applicant had not built the garage. Just prior
to the expiration of the building permit in March, 1985 the city
building department called and left a message for the applicant
reminding her that the building permit was going to expire. No
action to renew the building permit was taken and the permit
expired on March 23, 1985. Since issuance of a building permit
automatically continues the planning approval, the expiration of
the building permit also marked the expiration of the planning
approval of the variance. Thus the need for reapplication for the
variance at this time.
The applicant has expressed concern since she was unaware of the
link between the Planning approval of the variance and the
building permit. Financial circumstances on the construction of
the addition to the house conspired against her and she could not
afford to build the garage in 1985. The problem with both
building and planning permits came to light when she came to the
city recently to make application for a building permit to build
the garage. She feels she was never informed that the planning
approval could expire.
Since the existing garage was removed and the family room/den
addition have been completed without the garage being replaced,
the property is presently out of compliance with the zoning code.
Clearly a garage needs to be built and the applicant is now
willing to build the previously approved garage. Only reissuance
of the variance and paying the fees to extend the original
building permit retroactively remain to be accomplished before
reconstruction can begin.

The Proiect
The project submitted in 1983 for Commission review was the
reconstruction of the existing 12' x 20' freestanding garage with
a new 18' x 20' freestanding garage 20' behind the front of the
original garage. The new garage would be accessed by a 94�
driveway, about 79' of which were behind the 15' front setback.
The driveway is 9' wide. A two car garage was not required for
the three bedroom/one den house because the project provided one
covered off-street parking space and at least one uncover�d space
in the driveway behind the front setback (Code Sec. 25.70.030
a-1). The placement of the house and physical constraints created
by the creek on this site preclude placing the garage back far
enough to allow access to a two car garage.
Planninct Commission Action
Staff would recommend that the Planning Commission grant the
variance for the side setback on the same grounds they did in
January, 1984 (Planning Commission Minutes, December 12, 1983).
Moreover, it would be helpful to staff if at a future meeting we
could discuss a better procedure for handling such a situation.
The Planning Commission should hold a public hearing. The reasons
for any Planning Commission decision should be clearly stated. At
the public hearing the following conditions should be considered:
1. that the conditions of the Fire Marshal�s March 1, 1988
memo, City Engineer�s memos of November 29, 1983 and
February 29, 1988, Chief Building Inspector�s memo of
December 1, 1983, and the DES letter of November 4, 1983
shall be met;
2, that the project as built shall be consistent with the
plans submitted to the Planning Department and date stamped
November 15, 1983 except that the standards of the 1985
Uniform Building Code as they apply shall be met; and

3. that the applicant shall pay� the required fees as set by
city ordinance for Cextending, her building permit from
March, 1985 until the present time.

Because the construction of the garage is close to the side property line
and within the creek slope, the following will be required at the Building
Permit stage:
a. The lot be surveyed at the boundary next to garage.
b. That a Civil Engineer confirm cree�,capacity through the property,
especially at the new garage if required by the City Engineer.
As conditions of this variance, the following should be attached:
1. That the driveway to the new garage be paved.
2. That the creek area be cleared and debris cleaned if required by the
City Engineer and that slope protection be installed to protect
the garage foundation.

to relocate the detached garage. Ref. staff report dated 12/5/83; Project Application
& CEQA Assessment received 11/16/83; staff review: Fire Marshal (11/21/83), City
Engineer (11/29/83) and Chief Building Inspector (12/1/83); Design & Engineering Systems,
Inc. 11/4/83 letter to Pete Kriner, Building Department; applicant's letter dated
November 14, 1983; aerial photograph; and plans date stamped November 15, 1983. CP
discussed details of the request, location of the lot on Easton Creek, staff review,
letter from the structural engineering company, applicant's justification for the
variance. Two conditions were suggested for consideration at the public hearing. Chm.
Graham opened the public hearing. The applicants were present and stated their desire
not to interrupt the flow of the creek or to create an eyesore for their neighbors.
There were no audience comments and the public hearing was closed.
Discussion: CE's requirement that the driveway to the new garage be paved.
C. Schwalm found there were exceptional circumstances in the location of this lot on
Easton Creek, that the new garage was necessary for the preservation and enjoyment of the
property rights of the owners, that granting of the variance would not be detrimental to
the public health, safety or welfare or injurious to other property owners, and that it
would not adversely affect the comprehensive zoning plan of the city. C. Schwalm then
moved to grant this variance. Second C. Taylor; motion approved unanimously on roll call
vote. Appeal procedures were advised.

SUBJECT: VARIANCE FOR A GARAGE AT A SINGLE FAMILY HOME AT 1612 HOWARD AVENUE
Paula Poor is requesting a variance to the required 5' side yard setback in order to
relocate the detached garage at her residence at 1612 Howard Avenue. The new 360 SF
garage is proposed to be located 20' further back on the lot, but not within the rear
third of the lot. This lot backs onto Easton Creek and drops off sharply into the
creek.
Staff have reviewed the proposed project. The Fire Marshal (November 21, 1983 memo)
notes that the property line wall must be one hour construction. The City Engineer
(November 29, 1983 memo) notes that because of the location of the garage relative
to the creek the applicant needs a survey. The City Engineer needs to confirm the
creek's capacity through the property and the driveway to the garage needs to be
paved. The creek needs to be cleared of debris (cleaned if required by the City
Engineer) and slope protection installed to protect the garage foundation. The
Chief Building Inspector (December 1, 1983 memo) asks for a site survey. Since this
project was first submitted to the city for a building permit the Chief Building
Inspector had already sent the plans out for structural check when the Planning
staff identified the need for a variance. The letter from the structural engineer
(DES, November 4, 1983) shows that as designed the structure at this location on
the lot will be adequate so long as the changes itemized in the letter are made.
In her letter (November 14, 1983) the applicant identifies her reasons for requesting
the side yard setback variance: they need to enlarge the house to provide more living
space; the garage must be on this side of the lot because it is the only side with a
driveway; the rear 42' to 62' of the lot is unusable because it slopes into Easton
Creek; if the garage is placed back an additional 10' to come under the requirements
of the accessory structure code no portion of the structure will be on the flat (bank
top) part of the lot; placing the qarage further back would also interrupt the flow
of the creek and be highly visible to neighbors; and the proposal will not affect the
zoning of the site.
A site visit shows that this lot is affected significantly by the presence of Easton
Creek. As the site plan shows, at least the rear third of the lot is in the creek or
creek bank. Easton Creek drains to the bay about a third or a quarter of the hill area
of the city. City staff is satisfied that as proposed the new construction will not
affect the capacity of the creek. However, the applicant would not be allowed to build
any structure which could affect the capacity of the creek. Therefore there are limits
on the use of the rear portion of this lot which are clearly peculiar to this property.
To grant a variance the Commission must make findings regarding the following (Code
Sec. 25.54.020):
a. that there are exceptional or extraordinary circumstances applicable
to the property or class of uses in the district, so that a denial of
the application would result in undue property loss;
b. that such variance would be necessary for the preservation and enjoyment
of a property right of the owner of the property involved;
c. that the granting of such variance would not be materially detrimental to
the public health, safety or welfare, or injurious to the prooerty or
improvements of other property owners, or the quiet enjoyment of such
property or improvements; and .

d. that the granting of such variance will not adversely affect the
comprehensive zoning plan of the city.
The Planning Commission should hold a public hearing. At the hearing they should
consider the following conditions:
1. that the conditions of the Fire Marshal's memo of November 21, 1983,
the City Engineer's memo of November 29, 1983, the Chief Building
Inspector's memo of December 1, 1983 and the DES letter of November 4,
1983 be met; and
2. that the project be built consistent with the plans submitted to the
Planning Department and date stamped November 15, 1983.

My husband and I are in need of expanding the living
area of our home which necessitates relocating the .
existing garage 20� back form its present location.
Th'e garage has to be located in thi's area as tive have
access onlv from this side of our property. �
Our problem is further componded by the fact that the
rear 42� to 62� of our property slopes into the creek
situated behind our house. '
If we move the garage back the 10� the cod� requires�
w.e will be completely off the level area and �vill be
involved in additional retaining walls for the drive-
way as well as the retaining walls already neccessary
for the garage itself.
In addition if we situat.e the garage further back,
we could be obstructing the flow in the creek as well as
creating a disturbing appearance from the neighbors
view point.
I do not believe that r�y request vrill have any adverse
effect on the present zoning plan of the City of
I3urlingame.
