SUBJECT: FENCE EXCEPTION TO CONSTRUCT A 6' HIGH FENCE IN A PORTION OF THE
FRONT SETBACK, WHICH IS AT THE SIDE OF THE HOUSE AT 1601 HOWARD AVENUE
1601 Howard Avenue is a corner lot with 66' frontage on Crescent Avenue and 114'
frontage on Howard Avenue. The zoning ordinance limits the height of a fence in the
Crescent Avenue "front setback" to 5', but permits up to a 6' height along the property
line adjacent to Howard Avenue. Unfortunately, Mr. and Mrs. Jensen's home faces
Howard (the side setback) and the dining room patio and children's play equipment are
at the side of the house (in the front setback). To provide privacy to these areas,
and allow a height sufficient to offset a gradual slope from the house down to the
sidewalk, a Fence Exception is requested for a 6' high fence.
A contractor recently started work on the proposed fence without a building permit;
Mrs. Jensen states that she was unaware of the need for a permit. The work has been
stopped since mid December to allow time for Conmission's review of this petition,
and to allow Council an opportunity to act on an Encroachment Permit application
(the fence posts were set immediately behind the back edge of sidewalk, a 2' encroach-
ment into the public right-of-way). Council approved the Encroachment Permit
December 18, 1978; the fence posts may remain as installed.
In reviewing the applicant's site plan and cross sections Commission should note the
following features:
1. The fence will be almost 19' behind the Howard Avenue sidewalk (the Jensen's
front yard).
2. The 6' height along Crescent Avenue will extend for 42'-9" (only 65% of the
frontage).
3. The fence has been .off-set 9'-4" away from the Crescent Avenue neighbor's
driveway to improve sight distances.
4. The average height of the "6' fence" will be 5' or less over half of its
length because of the slope of the lot; however, the full 6' height will
be constructed immediately adjacent to the Crescent Avenue sidewalk.
After reviewing the proposed plans, staff has no objection to an approval of this
petition. A site inspection is recommended prior to the January 8, 1979 hearing.
At the conclusion of the hearing Commission should review the December 27, 1978 letter
from the Jensens and determine if the following four requirements have been satisfied:
1. That there are exceptional circumstances to this property;
2. That there will be no public hazard created by the fence;
3. That neighboring properties will not be materially damaged; and
4. That the regulations cause unnecessary hardship upon the Jensen family.
