CEQA Status: Article 19. Categorically Exempt per Section: 15301 Class 1-(e) additions to existing
structures provided the addition will not result in an increase of more than 50% of the floor area of the
structures before the addition.
History: On April 17, 2001, the Planning Commission voted 5-0-2 (Cers. Bojues and Osterling
absent) to approve an application for design review at 1532 Howard Avenue. The existing site
consisted of a two-story house with detached garaged. The approved plans showed additions to the
first and second floors of the main dwelling and a new detached garage. The approved changes added
an additional 593 SF of floor area on the property. The project is currently under construction. The
applicant is now requesting a design review amendment to change some of the architectural elements,
including roof pitch, for the main dwelling entryway and the detached garage.
Summary: The applicant is proposing changes to the approved plans for the main entrance and the
detached garage. The approved plans showed an entryway with a 3:12 pitch and composed of cedar
shingles. The proposed entryway has a 12:12 pitch and is composed of a stone veneer.
The approved detached garage had a 6:12 roof pitch, a plate height of 8'-9", and a single sectional
garage door. The proposed changes include a gambrel roof with a combination 4:12 and 8:12 pitch, a
reduced plate height of 8'-1 ", and double redwood garage doors. No change to the overall height of the
garage is proposed with the amended plans.
The approved roofing material on the main dwelling and garage was asphalt shingle and the applicant
is now proposing a shake roof.
A copy of sections of the approved plans is attached to the plans for the proposed amendments. The
proposed revisions are shown on the revised plans date stamped September 14, 2001. This change is
being brought to your attention since condition #2 of the approved project requires a change in roof
pitch and architectural features to be reviewed by the Planning Commission. There are no proposed
changes to the approved floor area and footprint of the house and detached garage. The applicant is
requesting the following:

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted
by the Council on Apri120, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2

2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for a design review amendment, and the
reasons for any action should be clearly stated. At the public hearing the following conditions should
be considered (Conditions for the April 17, 2001 approval are in italics):
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped March 30, 2001, sheets A.1 through A.7, and as amended by sheet A.1, date stamped
September 14, 2001, and that any changes to the footprint or floor area of the building shall
require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would
include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's March S, 2001, and the City Engineer's
September 17, 2001, memos shall be met;
4. that the project shall comply with the proposed demolition and construction recycling
ordinance recently approved by the City Council; and
S. that the project shall meet all the requirements of the California Building Code and California
Fire Code, 1998 edition, as amended by the City ofBurlingame.

Dear Mr. Salon,
Since there was no appeal to or suspension by the City Council, the Apri19, 2001 Planning Commission approval
of your application for a design review became effective April 16, 2001. This application was to allow for first
and second story additions at 1532 Howard Avenue, zoned R-1.
The Apri19, 2001 minutes of the Planning Commission state your application was approved with the following
conditions:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
March 30, 2001, sheets A.1 through A.7, and that any changes to the footprint or floor area of the
building shall require and amendment to this permit;
2. that any changes to the size or envelope of the basement, first or second floors, which would incIude
adding or enlarging a dormer(s), moving or changing windows and arch�tectural features or changing
the roof height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's March 5, 2001, memo shall be met;

4. that the project shall comply with the proposed demolition and construction recycling ordinance recently
approved by the City Council; and
5. that the project shall meet all the requirements of the California Building Code and California Fire Code,
1998 edition, as amended by the City of Burlingame.
Reimbursement of your design review deposit has been processed and will be mailed the property owner under
separate cover.

All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

Chairman Luzuriaga asked if anyone in the audience or on the Commission wished to call any item
off the consent calendar. C. Deal noted for the record that because of a business relationship with the
applicant, he will abstain from comment and vote on Item 2c, 1324 Drake. One member of the
audience clarified that her item was on the regular action calendar.
Dave Woodrow, 1316 Drake asked for a clarification of what the exception for height meant for the
project at 1324 Drake. Charmin Luzuriaga noted that since the overage was between 30' and 36' it
required a special permit which is an exception granted if the proposed additional height is needed in
order to achieve the architectural integrity of an architectural style. The standards for granting a
special permit are less rigorous than those for a variance. A variance is required when the height
requested is over 36 feet. Mr. Woodrow did not call the item off the consent calendar for further
hearing and action. There were no further comments from the floor.
There were no requests from commission to remove any of the items on the consent calendar.

AND DESIGN REVIEW AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a desi�r►
review amendment for first and second stor�,additions at 1532 Howard Avenue. zoned R-1. Tim and Cappie
Fav Alverson,�r�ertv owners, APN: 028-291-080;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
September 24, 2001, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, 15301 Class 1-(e) additions to existing structures provided the addition will not result in
an increase of more than 50% of the floor area of the structures before the addition, is hereby approved.
2. Said design review amendment is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such design review are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.
