Categorically Exempt per Section: 15301 Class 1-(e) additions to existing structures provided the addition will not result in an increase of more than 50% of the floor area of the structures before the addition. Summary: The applicant is requesting an amendment to an approved application for design review and front setback variance for a first and second-story additions at 1509 Howard Avenue, zoned R-1. The original application was approved on December 10, 2001 (see attached December 10, 2001 Conditions of Approval). A front setback variance for a front setback of 13'-6", where 21'-3" is required, was approved based on the findings that the 6'-0" deep porch element at the front of the residence improved the design of the house and provided the residence with architectural compatibility with the neighborhood. The house has been sold and the new owner is proposing changes to the approved style for the house and to the size and configuration of the additions to the lower, first, and second floor additions. The following changes to the approved plans are proposed with the current application: • the materials on the house will change from stucco with 6-inch horizontal Masonite siding to stucco with wood shingles and copper gutter and leaders; • the roof materials will change from asphalt shingles to slate tile; • the roof pitch will change from a mix of 6:12 and 8:12 to primarily a 6:12 pitch with a 4:12 shed roof over the front porch; • the windows type will change from Milgard, double-paned, vinyl-clad, fully divided light slider to Anderson wood casement windows with 1/3 of the window having divided lights and wood trim; • the basement size counted towards FAR will decrease from 1,336 SF to 572 SF; where the approved plans allowed for storage, a laundry room, a utility area, and a wine room on the lower floor, the proposed plans have only a utility room with a half bath; (all areas over 6 feet in height on the lower floor, including crawl space, are included in the total FAR calculation); • the proposed floor area will be 3563 SF (0.41 FAR), where the approved FAR was 4,152 SF (0.47 FAR); and • the proposed height will increase from 28'-4" to 29'-6". Although the style of the proposed porch is different from the approved porch, the proposed porch depth and overall area encroaching into the front setback are the same as the approved project. The existing Design Review Amendment 1509 Hownrd Avenue detached garage, which provides 2 covered parking spaces on site, will remain. There are no changes proposed to the number of bedrooms or the approved Landscape Plan. The applicant is requesting the following: An amendment to a previously approved application for design review and a front setback variance for first and second floor additions. On November 5, 1999, another building permit was issued for reinforcing the foundation. The scope of work was exceeded under these permits with a first and second story addition in process when the Building Department placed a stop work notice on the project. The house has been sitting since then with bare plywood and new vinyl windows. In response to the stop work order, the applicant submitted plans for the addition and remodel. When these plans for the addition were routed to the Planning Department, the applicant was notified that the proposed addition would be required to go through the Design Review process. This proj ect was before the Planning Commission on November 27, 2000 for preliminary design review. The Commission referred the project to a design reviewer. The project returned to the Commission for action on December 10, 2001 and was approved (see attached conditions of approval for December 10, 2001 PC meeting). Staff Comments: See attached. Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council on Apri120, 1998 are outlined as follows: Compatibility of the architectural style with that of the existing character of the neighborhood; 2. Respect for the parking and garage patterns in the neighborhood; Architectural style and mass and bulk of structure; 4. Interface of the proposed structure with the structures on adjacent properties; and Landscaping and its proportion to mass and bulk of structural components. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative Action should be by resolution and include findings made for a design review amendment. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped August 30, 2002, Sheets A.1 through A.4, and date stamped November 29, 2001, Sheet L1; 2. that the conditions of the City Engineer and Chief Building Official memos dated October 22, 2001 and November 15, 2001 shall be met; and the Recycling Specialist's memo dated August 26, 2002, shall be met; that any increase to the habitable basement floor area and any changes to the size or envelope of the first or second floors, which would include expanding the footprint or floor area of the structure, replacing or relocating a window (s), adding a dormer (s) or changing the roof height or pitch, shall be subject to design review; Design Review Amendment 1509 Howard Avenue 4. that all the windows on the approved plans, shown as true divided light windows, shall be installed as true divided lights with wood trim; 5. that the project shall comply with the proposed demolition and construction recycling ordinance recently approved by the City Council; and 6. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame. ZT Lewit presented the report, reviewed criteria and Planning Department comments. Four conditions were suggested for consideration. Chairman Vistica opened the public hearing. Kamal Tabib, designer, was present to answer questions. The Commission asked if the windows shown are true divided lights. The designer noted that the window type true divided lights was included on the revised plans and that hopefully the owner would install the correct windows. The Commission commented a condition of approval should be added to insure that true divided light windows are used. There were no further comments and the public hearing was closed. Commission discussion: the applicant has made many changes to this project and has complied with the requests for a 6'-0" porch and landscaping. C. He poi�fed out that there are numerous two-story houses `in the neighborhood and that the floor area of the proposed house is 500 SF less than the amount the code allows. He noted that no views will be blocked by,>the proposed house. Susan Smith, 1515 Los Montes Drive, spoke concerning the proposed house. She feels that the story poles do not show the whole picture or impact of the new house; she will lose a view from the living room of her house, looking south; the house does not fit into the neighborhood; 90% of the homes have attached garages ' and this house has a detached garage. There were no further comments and the public hearing was c�osed. Commission discussion: story poles were a great help in evaluating the project; the proposed hea�ght is only 3'-0" higher than the existing; the Bay tree has been saved on the property; there are other homes of this size in the neighborhood. C. Auran moved to approve the application, by resolution. There was no second on the motion to approve. Further Commission discussion: height of the proposed project is not greatly;increased over the existing height; the roof lines of the house are blended well; an attached garage would-inake the house look massive; the proposed detached garage is pedestrian friendly; the design of the house is still too massive; a smaller project would be more appropriate to the fabric of the neighborhood; riot having an attached garage vycith doors on the street is, an asset to the neighborhood; the project has been greatly improved by the d'esign review process.
