renovation) two and a half story single family dwelling with an existing detached garage.

Project Description: The subject property slopes towards the rear with an approximately four foot difference
between the front and rear property lines. Due to the slope the house appears as one story at the front but it is
two-stories at the rear. Because the lower floor contains less than two-thirds of the floor area of the main floor
located directly above it is considered a lower floor half story. There is detached one car garage located in the
right rear corner.
The applicant is proposing a major renovation with removal of more than 50% of the exterior walls therefore
while the project entails retaining a large portion of the fountain and some of the exterior wall, it is defined as
substantial construction under the zoning and treated as a new construction project terms of code requirements.
The project includes demolishing the rear deck and reconstructing the lower floor level below. The front of the
main living level (which is the existing first floor as viewed from the street) will be demolished and reconstructed.
The left side wall, which is currently non-confirming with a 3'-1" side setback, will also be demolished and
reconstructed with a code complying 4' side setback. The proposal includes construction of a new 1,038 SF
second floor. The project will increase the total floor area to 3,362 SF (0.56 FAR), where 3,362 SF (0.56 FAR) is
the maximum allowed.
With this application, the number of bedrooms will increase from two to four (office on the main level has no door
and is open to the staircase and does not count as a bedroom). The applicant proposes no changes to the
detached garage. The existing detached garage is non-conforming and does not qualify as a two car garage at
17'1" wide by 18' deep. However, the parking requirements is unchanged, with two on-site spaces required, one
of which must be covered. The existing garage, while non-conforming, is considered to provide one space and
the driveway provides one uncovered space (9' x20'). The application includes a request for a Special Permit for
Declining Height envelope because the proposed second floor encroaches 52.33 SF on the left side. The
applicant is requesting the following application:
■ Design Review for substantial construction (removal and reconstruction of 50% or more of the exterior
walls) (C.S. 25.57.010 (a)(3);
■ Design Review for a new second story addition (C.S. 25.57.010 (a)(2)); and

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. InterFace of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.

Findings for a Special Permit: In order to grant a Special Permit for declining height envelope and an attached
garage, the Planning Commission must find that the following conditions exist on the property (Code Section
25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistent with the city's reforestation requirements, and the mitigation forthe removal that is proposed is
appropriate.

1. A remove/replace utilities encroachment permit is required to (1) replace all curb, gutter, driveway and
sidewalk fronting site, (2) plug all existing sanitary sewer lateral connections and install a new 4" lateral, (3) all
water line connections to city water mains for services or fire line are to be installed per city standard
procedures and specification, (4) any other underground utility works within city's right-of-way.
2. A survey by a licensed surveyor or engineer is required. The survey shall show how the property lines were
determined and that the property corners were set with surveyors license numbers on durable monuments. This
survey shall be attached to the construction plans. All corners need to be maintained or reinstalled before the
building final. All property corners shall be maintained during construction or reestablished at the end of the
project.
3. Sewer Backwater Protection Certification is required for the installation of any new sewer fixture per
Ordinance No. 1710. The Sewer Backwater Protection Certificate is required prior to the issuance of Building
Perm it.
4. Based on the scope of work, this is a"Type I" project that requires a Stormwater Construction Pollution
Prevention Permit. This permit is required prior to issuance of a Building Permit. An initial field inspection is required
prior to the start of any construction (on private property or in the public right-of-way).
5. Please submit an erosion control plan. This plan shall include, but not limited to, delineation of area of
work, show primary and secondary erosion control measures, protection of creek or storm drain inlets,
perimeter controls, protections for construction access points, and sediment control measures.

1. On the site plan, please show the location of all proposed locations for utilities (PG&E, water,
sewer, and sewer cleanout).
2. Show the location of down spouts for the entire roof and that there is enough finish grade elevation
around the perimeter of the property to demonstrate the direction of storm water runoff for the
property. For all new impervious areas (approximately 85SF) from the pre to post construction,
stormwater must be retained onsite. Show design and location of proposed stormwater retention
system.

1) On the plans specify that this project will comply with the 2013 California Building Code, 2013
California Residential Code (where applicable), 2013 California Mechanical Code, 2013
California Electrical Code, and 2013 California Plumbing Code, including all amendments as
adopted in Ordinance 1889. Note: If the Planning Commission has not approved the project prior
to 5:00 p.m. on December 31, 2016 then this project must comply with the 2016 California
Building Codes.
2) Specify on the plans that this project will comply with the 2013 California Energy Efficiency
Standards.

3) Place the following information on the first page of the plans:

Weekdays: 7:00 a.m. — 7:00 p.m.

Construction hours in the City Public right-of-way are limited to weekdays and non-City
Holidays between 8: 00 a. m. and 5: 00 p. m.
Note: Construction hours for work in the public right of way must now be included on the
plans.
4) On the first page of the plans specify the following: "Any hidden conditions that require work to
be performed beyond the scope of the building perinit issued for these plans may require further
City approvals including review by the Planning Commission." The building owner, project
designer, and/or contractor must submit a Revision to the City for any work not graphically
illustrated on the Job Copy of the plans prior to performing the work.
5) This project will be considered a New Building because, according to the City of Burlingame
Municipal code, "when additions, alterations or repairs within any twelve-month period exceed
fifty percent of the current replacement value of an existing building or structure, as determined
by the building official, such building or structure shall be made in its entirety to conform with
the requirements for new buildings or structures." This building must comply with the 2013
California Building Code for new structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be submitted to, and
approved by, the Building Division prior to the implementation of any work not specificalty
shown on the plans. Significant delays can occur if changes made in the field, without City
approval, necessitate further review by Gity departments or the Planning Commission.
Inspections cannot be scheduled and will not be performed for work that is not shown on the
Approved plans.
6) Due to the extensive nature of this construction project the Certificate of Occupancy will be
rescinded once construction begins. A new Certificate of Occupancy will be issued after the
project has been final. No occupancy of the building is to occur until a new Certificate of
Occupancy has becn issued.
NOTE: A condition of this project approval is that the Demolition Permit will not be issued
and, and no work can begin (including the removal of a� building components), until a
Building Permit has been issued for the project. The property owner is res�onsible for
assuring that no work is authorized or performed.
7) When you submit your plans to the Building Division for plan review provide a completed
Supplemental Demolition Permit Application. NO'TE: The Demolition Permit will not be
issued until a Building Permit is issued for the project.
8) On the plans specify that the roof eaves will not project within two feet of the property line.
9) Provide details on the plans which show that all roof projections which project beyond the point
where fire-resistive construction would be required will be constructed of one-hour fire-
resistance-rated construction per 2013 CBC §705.2.
10) Indicate on the floor plans that exterior bearing walls less than five feet from the property line
will be built of one-hour fire-rated construction. (2013 CBC, Table 602)
11) On the plans show that all openings in exterior walls, both protected and unprotected, will
comply with 2013 CRC, Table 302.1(1). Provide a table or chart that specifies 1) the openings
allowed and; 2) the size and percentage of the openings proposed.
12) IZESIDENTIAL: Rooms that could be used for sleeping purposes must have at least one window
or door that complies with the egress requirements. Rooms that could be used for sleeping

the elevation drawings specify the location and the net clear opening height and width of all
required egress windows. 2013 California Residential Code (CRC) §R310.
Note: The area labeled "Office" is a room that can be used far sleeping purposes and, as such,

13) Indicate on the plans that a Grading Permit, if required, will be obtained from the Department of
Public Works.
14) NOTE: Areas with a headroom height greater than 5' 11" are considered to be floor area by the
Plannin� Division.
15) On sheet A2.1 in the kids play room it shows a number 11 which on the key notes reflects an
existing kitchen; two kitchens in a single family dwelling is not allowed unless prior plans were
submitted and approved by the Planning Division for there to be a legal duplex with the benefit
of a building permit. Please clarify
16) Provide lighting at all exterior landings.
17)18.10.100 Appendix C, Figure C amended—Exit terminals of inechanical draft and direct-vent
venting systems.
The Figure in Appendix C. of the 2013 California Residential Code is amended by adding the
following note:
Note: Where the property line is less than ten (10) feet from the exit terminal of any newly installed or
replacement high efficiency mechanical equipment the pipe size of the final ten (10) feet of any terminal must
be increased to three inches (3") or, as an alternative, manufacturer-approved baffles must be installed.

The following comments do not need to be addressed now, but you should be aware of them as they
will need to be addressed at time of building permit submittal.
1. A remove/replace utilities encroachment permit is required to (1) replace all curb, gutter, driveway and
sidewalk fronting site, (2) plug all existing sanitary sewer lateral connections and install a new 4" lateral, (3) all
water line connections to city water mains for services or fire line are to be installed per city standard
procedures and specification, (4) any other underground utility works within city's right-of-way.
2. A survey by a licensed surveyor or engineer is required. The survey shall show how the property lines were
determined and that the property corners were set with surveyors license numbers on durable monuments. This
survey shall be attached to the construction plans. All corners need to be maintained or reinstalled before the
building final. All property corners shall be maintained during construction or reestablished at the end of the
project.
3. Sewer Backwater Protection Certification is required for the installation of any new sewer fixture per
Ordinance No. 1710. The Sewer Backwater Protection Certificate is required prior to the issuance of Building
Permit.
4. Based on the scope of work, this is a"Type I" project that requires a Stormwater Construction Pollution
Prevention Permit. This permit is required prior to issuance of a Building Permit. An initial field inspection is required
prior to the start of any construction (on private property or in the public right-of-way).
5. Please submit an erosion control plan. This plan shall include, but not limited to, delineation of area of
work, show primary and secondary erosion control measures, protection of creek or storm drain inlets,
perimeter controls, protections for construction access points, and sediment control measures.

Provide a residential fire sprinkler system throughout the residence:
Provide a minimum 1-inch water meter.
2. Provide a backflow prevention device/double check valve assembly — A schematic of water
lateral line after meter shall be shown on Buildinq permit plans prior to approval indicating location of
the device after the split between domestic and fire protection lines.
3. Drawings submitted to Building Department for review and approval shall clearly indicate fire
sprinklers shall be installed under a separate deferred fire permit, approved by the Fire Department
prior to installation.

Thanks for your message. We generally terminate projects that are inactive after 6 months of inactivity. However, given
our workload and staffing we did not terminate your project.
If the project has not substantially changes and you wish to resubmit revised plans in response to the Planning
Commission comments from the February 13, 2017 meeting we will accept them. However, given the amount of time
between meetings and changes in our Commission make up (new Commissioners) we would need to charge you a new
plan check fee and because we would be bringing this back to Design Review Study (and then action) we would also
need to change for noticing cost for another (third meeting as we only collect fees for 2 meetings). I've attached the
original comments from the study meeting in February 2017 and also the receipt for the new plan check and noticing
fees. We would need 1 full size set of plans and 3 half sized sets of plans to get things moving again, as we would have to
route the plans to the other City Departments for review.
If the project is a new design and an entirely new project then we will need have to deem the original application void
and would require a new application, plans and fees. If this is the scenario then you would be entitled to a refund of the
design review deposit that was collected with the original fee since the project never went through a design review
consultant.
