Following a public hearing Council upheld the Planning Commission's approval of your application. This approval is effective February 20, 2002. The February 1 l, 2002 minutes of the Planning Commission state that your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped November 5, 2001, sheets A1.1 through A3.3, site plan, floor plans and building elevations, and sheet L-1 and A1.3, landscape plan and adjacent building elevations, date stamped January 30, 2002; 2. that the conditions of the City Engineer's and Recycling Specialis�'s memos dated November 5, 2001 shall be met; 3. that any increase to the habitable basement floor area and any changes to the size or envelope of the first or second floors, which would include expanding the footprint or floor area of the structure, replacing or relocating a window(s), adding a dormer(s) or changing the roof height or pitch, shall be subject to design review; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame. Reimbursement of your design review deposit has been processed and will be mailed to you in the next few weeks. March 5, 2002 1369 Bernal Avenue page -2- All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
