Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of more than 10,000
SF in areas where all public services and facilities are available and the area in which the project is located is not
environmentally sensitive.
Project Description: There is an existing two story house with a detached garage on the site. The applicant is
proposing first and second story additions to the existing house. The existing detached garage will not be
altered. With the proposed additions, the floor area will be 3,110 SF (0.52 FAR) where 3,239 (0.54 FAR) is the
maximum allowed on site.
The applicant is requesting a special permit for height for the proposed second story. The height of the existing
house is 29'-7", as measured from the average top of curb to the highest ridge. The proposed addition will be
31'-4" to the highest ridge. The applicant is requesting a special permit for a height between 30'-0" and 36'-0".
The existing house has four bedrooms and the existing detached garage provides one covered parking space
that is non-conforming in length (10' x 17'-5", where 10' x 18' is required for an existing space). With the
proposed additions to the house, the number of bedrooms will not be increased. The detached garage will not
be altered and therefore, the non-conforming covered parking space is not required to meet current code
requirements for parking space length.
The applicant is requesting the following applications:
■ Design review for a second story addition (C.S. 25.57.010,a,2); and
■ Special Permit for Height between 30'-0" and 36'-0". (C.S.25.26.060,a).

Staff Comments: See attached memos from the Chief Building Official, Fire Division, Engineering Division,
Parks Division, and Stormwater Division.
Design Review Study Meeting: At the Planning Commission design review study meeting on February 24,
2014, the Commission had several suggestions regarding this project (February 24, 2014 Planning Commission
Minutes). The designer submitted a response letter dated February 26, 2012, and revised plan sheets A-3 and
A-3.1, dated stamped February 26, 2014. Listed below are the Commission's comments and responses by the
applicant.
1. The picture window on the first f/oor, rear elevation, left side, appears inconsistent because there are
no muntins proposed in the /argest center pane of the window.
• Sheet A-3 has been revised to add a row of muntins to the center portion of the window.
2. The smaller window on the firsf floor, righf side elevation, has muntins to echo the window on the
second f/oor; this repetition seems too busy when it is on both of those windows.
• The muntins on the first floor window have been removed.
3. Want to confirm that the windows will be aluminum clad wood windows; the plans only state
"aluminum clad" windows.
• The two revised sheets have an added note to specify that all windows will be "aluminum clad wood"
windows.

4. A gas chimney does not have to have such a large separation from ofher sfructures as a wood
burning chimney. If is possible fo vent the chimney of the new fireplace at the top.
• Sheet A-3.1 has been revised to confirm that the proposed electric, gas, or direct vent fireplace shali vent
out the top of the chimney.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Design Review Findings: Based on the findings stated by the Planning Commission in the attached minutes of
their February 24, 2014, Design Review Study meeting, that the proposed addition and the massing of the
addition blend with the existing style of the house, and that the architectural style, mass and bulk of the house
will be consistent with the existing character of the neighborhood, the project is found to be compatible with the
requirements of the City's five design review guidelines.
Findings for a Special Permit: In order to grant a Special Permit, the Planning Commission must find that the
following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistent with the city's reforestation requirements, and the mitigation forthe removal that is proposed is
appropriate.
Special Permit Findings: Based on the findings stated in the attached minutes of the Planning Commission's
February 24, 2014, Design Review Study meeting, that the proposed height encroachment is 1'-4" and only
applies to a small section of the proposed roof ridge, that this ridge is set back from the front of the house, and
that the proposed encroachment is necessary to work with the existing rooflines, the Planning Commission is
supportive of the Special Permit request and the project is found to be compatible with the special permit criteria
fisted above.
Planning Commission Action:
The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be
considered:

that the project shall be built as shown on the plans submitted to the Planning Division date stamped
February 11, 2014, sheets A.0 through A1.2, A3.2 and A-7, and date stamped February 26, 2014, sheets
A-3 and A-3.1;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staffl;
3. that any changes to the size or envelope of the first or second floors, or garage, which would include
adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that the conditions of the Building Division's October 25, 2013, January 3 and January 31, 2014 memos,
the Parks Division's November 5, 2013 memo, the Engineering Division's October 30, 2013 memo, the
Fire Division's October 24, 2013 memo, and the Stormwater Division's October 31, 2013 and January 6,
2014 memos shall be met;
5. tha# any recycling containers, debris boxes or dumpsters for the construction project shall be placed
upon the private property, if feasible, as determined by the Community Development Director;
6. that demolition for removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
7. that prior to issuance of a building permit for construction of the project, the project construction plans
shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning
Commission, or City Council on appeal; which shall remain a part of all sets of approved plans
throughout the construction process. Compliance with all conditions of approval is required; the
conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination
and installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
10. that during demolition of the existing residence, site preparation and construction of the new residence,
the applicant shall use all applicable "best management practices" as identified in Burlingame's Storm
Water Ordinance, to prevent erosion and off-site sedimentation of storm water runoff;
11. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame;

THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:
12. that prior to scheduling the framing inspection the applicant shall provide a certification by the project
architect or residential designer, or another architect or residential design professional, that
demonstrates that the project falls at or below the maximum approved floor area ratio for the property;
13. that prior to scheduling the framing inspection the project architect or residential designer, or another
architect or residential design professional, shall provide an architectural certification that the
architectural details shown in the approved design which should be evident at framing, such as window
locations and bays, are built as shown on the approved plans; architectural certification documenting
framing compliance with approved design shall be submitted to the Building Division before the final
framing inspection shall be scheduled;
14. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height to the Building Division; and
15. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural
details (trim materials, window type, etc.) to verify that the project has been built according to the
approved Planning and Building plans.

All Commissioners had visited the project site. Commissioner Bandrapalli indicated she had met some
neighbors across the street. There were no other ex-parte communications. Reference staff report dated
February 24, 2014, with attachments. Community Development Director Meeker briefly presented the
project description. There were no questions of staff.
Chair Sargent opened the public comment period.
Daryl Buckingham represented the applicant.
Commission comments:
■ Wil� all windows on the house be replaced? (Buckingham: Yes. They will be wood windows that are
clad.) Plans only specify "aluminum-clad windov�' but should specify material of window; for example
"aluminum-clad wood windows" if that is what is planned. Determine what window type will be
installed before coming back for action.
■ On the window on the right-hand side with the shed roof on top — will there be an issue with the roof
below it? (Buckingham: It will be relatively close, but if you look at the previous front in the 1970s the
windows had been placed in strange locations. Trying here to reorganize it and get it back to a
shape that it would have been originally. The shed will work here.)
■ What is the material of the decorative vent underneath the gable end? (Buckingham — wood.
Mostly wood horizontal slats with some base behind.)
■ On Sheet A3.1 questioned need for grids on the horizontal transom window on the first floor of the
left side. Remove the grids on that window since they emphasize the long rectangle.
■ On Sheet A3 the rear elevation picture window, consider installing grids in the middle pane — carry
across the picture window.
■ Leave the grids on the upper-level horizontal window on the left side elevation.
■ None of the new addition is encroaching into the declining height envelope. The only encroachment
is the existing part of the house.
■ Have done a nice job blending the addition and retaining the character of the existing house.
■ What is the circle in the middle of the chimney? (Buckingham — the existing chimney has an
unattractive extension that will be removed. Will then be installing a direct-vent fireplace and
keeping the chimney for character.) Would prefer running the fireplace vent to the top of the
chimney.

The current residence is a 2 story home w/ 1,330.4 S.F. on the ground floor, and
530 S.F. on the second floor, and the garage is 219 S.F.
The proposed house addition and remodel include a ground floor addition of
529 S.F. and a 2nd floor addition of 630.5 S.F., enclosure of a portion of the
existing front porch for an entry hall, new street entry steps, enlarging the great
room and renovation of or new kitchen and bathrooms.
The new FAR is 2,912.3 S.F. /allowable 3,020. The new ground floor coverage is
1909.7/allowable 2,400.
The existing house has 3 bedrooms and 2 baths, and the proposed house will
have 4 bedrooms and 3 baths.
The existing stucco bungalow is non descript, with a low pitched roof. Previous
additions did not consider the vintage. The addition and remodel will add detail
and character. All windows will be replaced to be consistent.
There will be some additional planting of shrubs and ground cover to the front
yard where steps have been removed and new landings are provided and
landscape steps extend to the sidewalk. The existing driveway and garage
remain. No trees will be removed.

9) This project will be considered a New Building because, according to the City of
Burlingame Municipal code, "when additions, alterations or repairs within any twelve-
month period exceed fifty percent of the current replacement value of an existing
building or structure, as determined by the building official, such building or structure
shall be made in its entirety to conform with the requirements for new buildings or
structures." This building must comply with the 2013 California Building Code for new
structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be submitted to,
and approved by, the Building Division prior to the implementafion of any work not
specifically shown on the plans. Significant delays can occur if changes made in the
field, without City approval, necessitate further review by City departments or the
Pfanning Commission. Inspections cannot be scheduled and will not be performed for
work that is not shown on the Approved plans.
10) Due to the extensive nature of this construction project the Certificate of
Occupancy will be rescinded once construction begins. A new Certificate of
Occupancy will be issued after the project has been finaled. No occupancy of the
building is to occur until a new Certificate of Occupancy has been issued.
11) Provide a complete demolition plan that indicates the existing walls, walls to be
demolished, new walls, and a legend. NOTE: A condition of this project approval is
that the Demolition Permit will not be issued and, and no work can begin
(including the removal of a� building components), until a Building Permit has
been issued for the project. The property owner is responsible for assuring that
no work is authorized or performed.

RESOLUTION APPROVING CATEGORICAL EXEMPTION, DESIGN REVIEW, AND SPECIAL
PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been prepared and application has been made for Desiqn
Review and a Special Permit for Heiqht for first and second story additions to an existinq two-story
house at 1349 Bernal Avenue, Zoned R-1. Sonia Wadhawan and Deepak Chuqh propertv owners

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March
10, 2014, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of
more than 10,000 SF in areas where all public services and facilities are available and the area
in which the project is located is not environmentally sensitive, is hereby approved.
2. Said Design Review and Special Permit are approved subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such Design Review are set forth in the staff report,
minutes, and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Division
date stamped February 11, 2014, sheets A.0 through A1.2, A3.2 and A-7, and date
stamped February 26, 2014, sheets A-3 and A-3.1;
2. that any changes to building materials, exterior finishes, windows, architectural features,
roof height or pitch, and amount or type of hardscape materials shall be subject to
Planning Division or Planning Commission review (FYI or amendment to be determined
by Planning staf�;
3. that any changes to the size or envelope of the first or second floors, or garage, which
would include adding or enlarging a dormer(s), shall require an amendment to this
permit;
4. that the conditions of the Building Division's October 25, 2013, January 3 and January
31, 2014 memos, the Parks Division's November 5, 2013 memo, the Engiraering
Division's October 30, 2013 memo, the Fire Division's October 24, 2013 memo, and the
Stormwater Division's October 31, 2013 and January 6, 2014 memos shall be met;
that any recycling containers, debris boxes or dumpsters for the construction project
shall be placed upon the private property, if feasible, as determined by the Community
Development Director;
6. that demolition for removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall
be required to comply with all the regulations of the Bay Area Air Quality Management
District;
7. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall
not be modified or changed without the approval of the Planning Commission, or City
Council on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the p�rtions of the roof not visible from the street; and
that these venting details shall be included and approved in the construction plans
before a Building permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;

10. that during demolition of the existing residence, site preparation and construction of the
new residence, the applicant shall use all applicable "best management practices" as
identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site
sedimentation of storm water runoff;
11. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2013 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
12. that prior to scheduling the framing inspection the applicant shall provide a certification
by the project architect or residential designer, or another architect or residential design
professional, that demonstrates that the project falls at or below the maximum approved
floor area ratio for the property;
13. that prior to scheduling the framing inspection the project architect or residential
designer, or another architect or residential design professional, shall provide an
architectural certification that the architectural details shown in the approved design
which should be evident at framing, such as window locations and bays, are built as
shown on the approved plans; architectural certification documenting framing
compliance with approved design shall be submitted to the Building Division before the
final framing inspection shall be scheduled;
14. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the
height of the roof ridge and provide certification of that height to the Building Division;
and
15. that prior to final inspection, Planning Division staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has
been built according to the approved Planning and Building plans.
