SUBJECT: FENCE EXCEPTION IN THE FRONT SETBACK OF A SINGLE
FAMILY HOME �T 1315 BERNAL AVENUE, ZONED R-1
Thomas and Maureen Byrne are requesting a fence exception in order to
build four 6'-4" high columns eacY� two feet wide within the front
setback (maximum height allow�d 5') (�ode..�Sec•: 25.78.020). The
existing stairway, built at the time the house was built, is being
replaced and the 6'-4" x 2' x-2'�columns are needed so that a handrail
can be provided. The columns at the driveway entrance are being raised
to 6'-4" in order to match those on the stair.
Staff Review
City staff have reviewed the request. The Chief Building Inspector
(November 6, 198�.memo), t�e Fire Marshal (November 7, 1986 memo) and
the City Engineer.(November 10, 1986 memo) had no comments.
Applicants' Letter .
In their.letter of November 3, 1986 the ap.plicants state that their
home was built about 1905. The front.stairs which are original need to
be replac�d. They ar.e.proposing to rep]:ace the existing stairs and
wall with brick and the columns exce.ed the height limit. The column
height is,needed,in order to ins.tall a_.handrail on the stairs.

Fence Exception ,
To grant a fence exception, the following items must be shown (Code Sec.
25.78.050): �
1, that there are exceptional circumstances;
2. that there is no.public hazard;
3: th.at neighboring properties will not be materially
damaged; and
4. that the regulations caus,e unnecessary hardship
upon the petitioner.
Summary
A fence-exception is required because the decorative columns of this
replacement stair and at the driveway entrance are located in the
required front setback and exceed 5' in height. The columns and wall

6'-4" and a maximum girth of 2' x 2' and shall be installed at the
location shown on the plans submitted to the Planning Department
date stamped November 4, 1986; and
2. that before installation the applicant shall obtain a building
permit from the Building Department.

Dear Burlingame Planning Commissioner:
Our home at 1315 Bernal Avenue was built approximately in 1905. I am sure the
front concrete stairs and wa11 are original and are in definite need of replace
ment. We have submitted plans drawn by a local Architect Arline Castleberry to
replace the existing wa11 and stairs with a beautifuZl brick wa.Z1. Apparently
the columns exceed the allowable heiqht limit.
Mrs. Castleberry is out of town and without her explanation for the submited
height, I have determined that it is necessary by section A-1 to facilitate the
handrail heiqht. In addition the Zot is sloped up hi11 from the sidewalk to
the house, please note the columns are only two feet wide and have a two foot
set back. HopefuZly you wi11 approve this " Fence Exception " as submitted.

NOTICE IS HEREBY GIVEN that Monday, the 24th dav of November, 1986 , at
the hour of 7:30 P.M. , i n the Ci ty Hal l Council Chambers , 501 Primrose Road,
Burlingame, California the Planning Commission of the City of Burlingame will conduct —
d public hearing on the application to allow four 6'4" hiah columns within the
front vard setback where 5 feet is the maximum heiQht for fences at
