Applicants and Property Owners: James and Michelle Delia Designer: J D & Associates Lot Area: 6,000 SF APN: 026-172-240 General Plan: Low Density Residential Zoning: R-1 CEQA Status: Article 19. Categorically Exempt per Section: 15303- Class 3- construction and location of limited numbers of new, small facilities or structures including (a) single-family residences not in conjunction with the building of two or more such units. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption. History: The applicant was granted an approval by the Planning Commission for a design review permit and a special permit for declining height envelope on October 23, 2000 (see 10/23/00 PC mimites). The applicant went before the Planning Commission on January 22, 2001, with a floor area ratio variance and an amendment to the design for the detached garage. The Planning Commission denied the FAR variance and denied without prejudice the design for the garage (see 1/22/O1 PC minutes). Direction was given to the applicant to revise the garage design, which was submitted with an eave at the west elevation and a barge rafter only at the east elevation, so that the eaves matched at both elevations. The applicant appealed this decision to the City Council. At the February 5, 2001, CC meeting, the Council determined that the Planning Commission misunderstood the garage issue at the time of the amendment hearing (see 2/5/O1 CC minutes and 2/8/Ol letter). The City Council directed that the appeal fee be refunded to the applicant and that the garage design, which was denied without prejudice, be sent back to the Planning Commission for reconsideration. The P1anYing Commission approved the proposed amendment to the garage on 1Vlarch 12, 2001 (see 3/12/O1 PC minutes). Summary: The applicant is requesting a design review amendment to the project approved on March 12, 2001. The applicant proposes to alter the design of the covered porch at the south elevation of the house. The plans approved on 3/ 12/O 1 showed four full columns, positioned at the front of the porch, and two split columns, positioned at the rear of the porch and abutting the front wall of the house. All six columns extended to the floor of the porch. There was a 3'-0" wood shingle wall at the east and west sides of the porch, extending between the front full column and the rear split column. The proposed amendments show four full columns at the front of the porch that extend to a 3'-0" wood shingle wall surrounding the entire porch. The proposed columns are spaced at different intervals from the approved columns, so that they frame the windows and the door on the south wall of the residence. The proposed amendment does not extend the porch beyond the footprint that was approved on 3/12/Ol and therefore, there are no proposed changes to the approved FAR, lot coverage, or landscaping. Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council on Apri120, 1998 are outlined as follows: 2 Design Review Amendment 1228 Bernal Avene 1. Compatibility of the architectural style with that of the existing character of the neighborhood; 2. Respect for the parking and garage patterns in the neighborhood; 3. Architectural style and mass and bulk of structure; 4. Interface of the proposed structure with the structures on adjacent properties; and 5. Landscaping and its proportion to mass and bulk of structural components. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be made by resolution and should include findings made for the requested amendment to the design review permit. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Building Department date stamped January 30, 2001, sheets 3, 3.1, 5 and L1, and on the plans submitted to the Planning Department and date stamped December 15, 2000, sheet G and on the plans submitted to the Planning Department and date stamped May 16, 2001, sheets 1, 2 and 4; with the proposed ceiling height of 12'-0" in bedroom # 1; with the proposed detached garage with an eave extending 1'-6" at the west elevation and a barge rafter extending 1'-6" at the east elevation, an overhang at the front of the garage which measures 1'-6", and a side setback of 1'-6"; and with the proposed porch showing four full columns extended to a 3'-0" wood shingle wall enclosing the porch and with a 19'-8" front setback; and 2. that any changes to the footprint or floor area of the building shall require an amendment to the permit; 3. that any changes to the size or envelope of the second floor, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; 4. that the conditions of the City Engineer's and Chief Building Official's September 5, 2000, memos shall be met; and 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame. C. Deal noted that he would abstain from voting on the project because of a business relationship with the applicant; he stepped down from the dais. ZT Lewit presented the staff report. Commission asked staff the amount of floor area counted for the loft is only 8 SF; the majority of the floor area requiring the variance is then the result of the raised ceiling height in the bedroom. Staff explained that although the ceiling height in the loft measures from 3'-3" up to 5'-6", only spaces above 5'-0" are included in the total floor area, and this amounts to 8 SF for the proposed loft. There were no further questions. Chairman Luzuriaga opened the public hearing. Jim Delia, property owner, was present to answer questions. He noted that the purpose of the loft was to render the existing space under the roofline useable area. He would support a condition preventing the variance from being transferred to any other area in the house. Applicant explained he believed there was some confusion in the interpretation of the Commission's original comments; believes they did not want to see matching eaves on the garage, and instead wanted to see the overhang at front of the structure increased in depth; does not want to lose any backyard space. He noted that he feels the redesigned garage matches the approved main dwelling. Commission pointed out to applicant that originally eaves on garage were lopsided and the Commission requested a design change to address this discrepancy. This was done and approved, now applicant is returning with exact same lopsided design. FAR variance can be eliminated by creating a 12' ceiling in the bedroom over the bathroom; there is no physical hardship for FAR variance and new house should be designed to meet requirements. Commission asked what stage the project was in and applicant responded that it is still on paper, no building permits have been issued. There were no further comments from the floor and the public hearing was closed. Commission discussion: garage redesign preserves character of structure and the barge rafter makes the eaves appear symmetrical. Garage is not uniform and cannot support the redesign. There is no justification for the FAR variance on this lot. Chairman Luzuriaga moved to deny the FAR variance and deny without prejudice the garage redesign. Direction concerning the garage was given to make the design symmetric, either with full eaves on each side and a 3'-0" side setback or matching clipped eaves on both sides and a narrower side setback.
