HomeMy WebLinkAbout4 East Carol Avenue - Staff ReportP.C. 10/11/83 I tem # 1 MEMO T0: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: THREE VARIANCES FOR A SECOND STORY BEDROOM ADDITION TO AN EXISTING SINGLE FAMILY RESIDENCE AT 4 EAST CAROL AVENUE David Behling is requesting three variances to add a second story bedroom addition to his home at 4 East Carol Avenue. One variance is for off-street parking; Code Section 25.70.030 (a) requires two off-street parking spaces for a single family home with three or more bedrooms. These required spaces must be provided behind the front �etback; in this case the second space is in the driveway within the front setback. The other two variances are for encroachment of the existing building into the required side and rear yard setbacks (Code Section 25.66.050). The existing building and proposed second story addition would extend within 1�" of property line on the side yard (minimum 5' required). The proposed exterior stairway to the second floor addition would extend two feet into the same side yard. The existing house extends 6" into the required yard. The proposed second story addition would conform to the minimum 15' rear yard required. The proposed plan complies with zoning requirements for height and lot coverage. City staff reviewed the project. The City Engineer (September 2, 1983 memo) and Fire Marshal (September 6, 1983 memo) had no comment. The Chief Building Inspector (September 6, 1983) commented that the existing foundation needs to be inspected by a licensed engineer to determine if it is adequate to carry the second floor load. The applicant in his letter (September 9, 1983) points out the following exceptional circumstances regarding his project: replacing the existing garage to conform the the side yard setbacks would be expensive, would significantly change the architechture and would cause existing trees to be removed; because of long street frontages on this corner lot there is more than enough on-street parking; his family has expanded and they need more room. The addition will not change the use of this home as a single family residence. Planning staff would note that the copy of the Sanborn Map included in the packet dates from 1920. According to City records the accessory structure shown on the plot plan for 4 East Carol was subdivided off to 1532 Barriolhet prior to 1932. In order to grant a variance the Commission must make the following findings of fact associated wit the property, (Code Section 25.54.020): a. That there are exceptional or extraordinary circumstances applicable to the property or class of uses in the District, so that a denial of the app1ication would result in undue property loss; b. That such variance would be necessary for the preservation and enjoyment of the property right of the owner of the property involved; ♦ c. That granting of such variance would not be materially detrimental to the public health, safety or welfare or injurious to property or improvements of other property owners, or the quiet enjoyment of such property or improvement; d. The granting of such variance will not adversely affect the comprehensive zoning plan of the City. The Planning Commission should hold a public hearing. One hearing can cover all three variance requests. The two variances regarding side and rear yard setbacks could be taken in one action. The parking variance should be taken separately. At the public hearing the following conditions should be considered: 1. That the conditions of the Chief Building Inspector's memo of September 6, 1983 be met; 2. The Barriolhet frontage be defined as the front yard and the 63' pro�erty line opposite be defined as the rear yard for this property; 3. Developer advised economic return on the penthouse makes the entire project viable, the other units would retail at a lower price; he felt the project was well designed for this difficult lot. CP explained the reason for the variance is that it is a structure in the front setback, which is different than a protrusion on the face of the building; the slab would be bermed over with landscaping. Further discussion: feasibility of moving the building back and lengthening the driveway; this is too much project for the lot; a massive building, a big box. C. REVIEW OF PLANNING COMMISSION FENCING REQUIREMENT FOR STAR EXCAVATION TRUCK STORAGE AT 1645 ROLLINS ROAD CP Monroe reviewed this item. Reference staff report dated 9/21/83; Planning Commission minutes of September 12, 1983; Star Excavation letter dated September 19, 1983 with attached revised proposal for fencing; and Monroe letter to Diana Miley, Star Excavation dated September 21, 1983 requesting a spokesman for Star and for the property owner, Hiram Walker & Sons, be present this evening. CP discussed fencing requirements in Planning Commission action at its September 12, 1983 meeting, property owner's objection to either of the two alternatives and a further alternative agreed to by Star and the property owner. Commission review of this latest proposal was requested and an alternative condition suggested in the staff report. CP suggested there be a gate in the fence, unlocked at all times; purpose of the fence is visual, not for security. She further advised of a phone call from Mr. Roberts of Hiram Walker; he was unable to attend this meeting but approved of the latest alternative if agreeable to the Fire Department. Discussion: Fire Marshal had agreed to a gate as long as it is not locked; desire of the Commission to successfully screen this storage area; suggest installation of a rolling gate, parallel to the fence; desirable height for the fence; believe Commission should require written direction from the property owner that such a fence is acceptable before the fence requirement becomes effective. Carol Good People: I wish to add additional living space at the above referenced property and in order to do so I am requesting that two variances be granted as follows: A. The continued variance granted that allowed subject property!s one car garage to encroach onto the setback of the property next door on Barroilhet. B, A waiver of the second parking space requirement. Exceptional Circumstances When I purchased subject property I knew nothing of the existing variance. To correct the existing variance today aside from being costly would make the existing garage un— usable. To relocate the garage would be ruinous architecturally and would require the removal of existing trees. The addition of an additional parking space would require removal of trees and land— scaping. It would detract from both the subject property and adjoining properties. The subject property is a corner lot that affords an unusual amount of off street park— ing. Together with the parking on Carol and Barroilhet there is over 150 feet of park— ing. Accross the street on Barroilhet is a property that faces another street and thus acts like a vacant lot affording yet an additional 100 feet of off street parking. Why the Need When I purchased the subject property I was a single man living with my daughter on weekends and some weeknights. Three months ago I married a lady with yet another child and suddenly the house has become too small especially considering more children. By re—granting the original variance of the encroachment, the garage will continue to be usable and will have the least effect on the subject property and the neighborhood. By granting a variance that would allow construction without additional parking would have the least effect on both the subject property and the neighboring properties because of the unusual amount of parking the subject property has off street. A variance or two will be required because of the placement of the existing house on the lot. The lot is unusual in that it has two street frontages and both street frontages exceed 100' in length. The code, in defining corner lots, states that where there are two frontages the frontage less than 100' will be the front yard (Code Sec. 25.62.050). However, this does not apply to this lot because both frontages exceed 100'; although East Carol is the shorter of the two frontages at 104'. Staff cannot determine the extent of the exceptions to the code caused by this project until yards are established because the definition of yard is critical to the setback measurement, e.g., front yard setback is 15' while side yard setback is 7'-6" on a street frontage and 5' on a property line. Figures I and II show two choices for setback definition. The existing house is shown on each diagram. Staff would like to review the alternatives with the Commission; and determine,for this request and the future�the definition of yards for this lot. CP discussed the proposed addition and the setback violations of the existing home. It was suggested that one action could cover all three variances. Three conditions were suggested for consideration. The public hearing was opened. The applicant, Dave Behling, was present. Wayne Clapper, architect for the project, spoke in favor of the application, stating that the addition will not extend the existing non-conformities of the house, that at one time the property compli�ed with all setbacks but a garage was subdivided off prior to 1932 which caused the non-conforming setbacks to be created. There were no comments against the application and the public hearing was closed. C. Giomi made a motion to grant the three variances for the addition based on the following findings: the original placement of the home is the cause for the variance, there is an unusual amount of street frontage to accommodate a second vehicle, there is no feasible way to make the addition without ex^essive �xpense or the loss of trees, the addition will not be injurious to adjacent prepe�-ties and the �ot will retain its singie family character.
