VARIANCES TO SIDE YARD SETBACK AND LOT COVERAGE
FOR A DINING ROOM ADDITION AT 1$30 CA5TENADA
DRIVE, ZONED R-1.
Applicant/Property Owner Han-Te and Joanne Liu are requesting
variances to the side yard setback and lot coverage requirements
to build a first floor extension to the dining room of an
existing home, located at 1830 Castenada Drive, zoned R-1. The
side setback variance is requested to allow a 5�-0" setback where
7�-0" is required (CS 25.66.050). In addition, a variance to lot
coverage requirements is requested to allow 42.8� where 40� is
required (CS 25.62.010). Existing lot coverage is non-conforming
(41.6�); the proposed structure would increase lot coverage 68 SF
to 42.8� (2707 SF existing footprint, 2775 SF proposed; 2600 SF
permitted). The addition and existing house will be 107 SF
greater than the maximum lot coverage allowed.

reviewed this application and there are no
On their application for the two variances, Mr. and Mrs. Liu note
that their family has grown recently and they need additional
space in the dining room to accommodate the increased family
size. The side yard setback of 5'-0" is required to properly
align the new addition with the existing structure, to create a
uniform room without an indentation. The increased room size will
be in the rear yard and hidden from public view, and will be in
keeping with the character of the neighborhood.
Findinas for a Variance
In order to grant a variance the Planning Commission must find
that the following conditions exist on the property (Code Section
25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to praperty in the same district;
(b) the granting of the application is necessary for the
preservation and enjoyment of a substantial property right
of the applicant, and to prevent unreasonable property loss
or unnecessary hardship;

(c) the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and
will not be detrimental to the public health, safety,
general welfare or convenience;
(d) that the use of the property will be compatible with the
aesthetics, mass, bulk and character of existing and
potential uses of properties in the general vicinity.
Plannina Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should include findings made for the variances requested.
Reasons for any action should be clearly stated. At the public
hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans
submitted to the Planning Department and date stamped
September 20, 1990; and
2. that the project shall meet all Uniform Building and Fire
Code requirements as amended by the City.

We have an irregular lot and small dining room area. After the propose addition
we will have a bigger dining room area to fit our family comfortablely., also
the set back we need of 5' where 7' is require, I hope you can grant us this set
back various so our new addition will stay the same size as the;�cisting dining
room, so it won't look so awkward. �

preservation and enjoyment of a substantial property right
and what unreasonable property loss or unnecessary hardship
might result from the denial of the application.
We need to have a bigger and expanded dining room area for our big fanily.
so we don't have to all pack like a sardine in a can, set back is not affecting
our neighbor nor the neighborhood. also we have plenty of room to walk to
the rear yard. This variance will not be an inconvience to anyone, it will help
us to have a uniform looking dining room instead of an indented dining room .

impact. also, it's necessary for our family's expansion to have a bigger dining

half of my family members were living out of the country. now thier back to stay
and live in the house with us. we do need the additon room. this is the only
dining area we have in the house. and sometimes we can't even have room to walk
behind the dining chairs. see attacted photos.

We're just adding a small portion of about 67 sq.ft. of space to the existing dining
room in the house, also the addition is in the back of the house so the neighbor's
couldn't even see us from the front. The addition is in the back of the property
where is hidden from public view, and it will blend in with existing structure.

�he variance is necessary for the preservation and enjoyment of the
p��operty, the way it was designed originally was a waste of space an-d
it1* was inefficient, it could not accommodate all the amenities ,u�ed
tod,ay. It will not be detrimental to other properties in the_; area,
then.e was a major fire on the property, now the carport wil�,�'be torn
down;�. a driveway removed, the only entrance will be on �Surlingame
Avenue�;,, the property will become a legitimate single n�'amily home.
Roof lines will remain consistent, there is a two car'�garage, they
are tryinc� to make the structure conform, it has b�en nonconforming
for 48 years. He presented a petition in supp�irt signed by 22
families wi`�h 28 signatures. Applicants ha<w'e no objection to
eliminating th� driveway and will tear down the�carport, landscape in
front and at �'�the rear, will keep the s;C�"ucco and wood siding.
Responding to a�-.,question applicant foun�� there are exceptional
circumstances in tl�r-'s dwelling which is �dt functional and not usable
the way it is prese�ly designed. ,�.,�''
The following members'`�-�of the au�dience spoke in support: Jane
Calavano, 715 Burlingame�`'yAvenue �fi�d Niels Ploug, 218 Arundel Road.
They expressed their pleasiire i�`�the plans for upgrading this house,
it has been a disgrace to th neighborhood for many years. There
were no further audience comm�'nts and the public hearing was closed.

C. Deal commented there i�'a 40� T�ot coverage maximum in Burlingame,
its intent is to keep a�}ibuse up to �,hat point, in this case they are
decreasing the amount'of lot cover�age square footage, that is
commendable; since itr�'is a reduction in amount of square footage it
is a valid increas �;' it is only .3� over what would be needed to
allow a minor moc��fication. With these�,,statements and with the
neighborhood supp�rt C. Deal found this is `�� good use of 'a variance
for lot coverag� and moved for approval of`�,the variance with the
following cond�tions: (1) that the project shaT�3, be built as shown on
the plans su�bmitted to the Planning Departme� and date stamped
September 28`, 1990, and f�ont setback and lot cov age as amended on
the plans date stamped October 16, 1990; (2) that t�� unused driveway
will be �removed from the sidewalk to the curb a'�d gutter (City
Enginee�fs memo dated October l, 1990 ) and from the s'�' dewalk to the
carport; and (3) that the project shall meet all Uniform� uilding and
Fire,�ode requirements as amended by the City of Burlinga�.
Mo ion was seconded by C. Galligan. Comment: pleased to s�e this
h use returned to single family status. Motion approved on'�� 7-0

6. VARIANCES TO SIDE YARD SETBACK AND LOT COVERAGE FOR A DINING ROOM
ADDITION AT 1830 CASTENADA DRIVE, ZONED R-1

reviewed details of the request, staff review, applicant's letter.
Two conditions were suggested for consideration at the public

hearing. Responding to questions CP advised the lot is 6,500 SF,
under the change to the minor modification regulations walls are
allowed to extend along a side setback but the minor modification
does not apply in this case because the applicant is also requesting
a variance.
Chm. Graham opened the public hearing. The following spoke in
support. Allen Lin, 1724 Escalante Way: in favor of this request,
the house does not have a formal dining room, only a small area for
eating purposes; addition will improve the house and property values
in the neighborhood, it is on the first floor and will not obstruct
anyone�s view, it will be only 67 SF. Joanne Liu, daughter of the
applicant: they have lived in this house for four years, additional
family members are coming home to live and they need more dining room
space. There were no further .audience comments and the public
hearing was closed.
With the statement this is one of the smaller lots in Mills Estate,
it was over lot coverage when built, it will be a small dining room
addition, will not impact any neighbors, site is on the brow of a
hill, C. Jacobs moved for approval of the side yard setback and lot
coverage variances with the following conditions: (1) that the
project shall be built as shown on the plans submitted to the
Planning Department and date stamped October 16, 1990; and (2) that
the project shall meet all Uniform Building and Fire Code
requirements as amended by the City of Burlingame. Motion was
seconded by C. Ellis.
Comment on the motion: will vote for the motion but have a minor
problem, very few cities allow 40� lot coverage, this is a minor
addition but wish it were designed more into the home, if possible
would ask the addition be designed to incorporate the roof line into
the house; side setback requirements on these lots have changed, they
were originally 5'; cannot support the motion, in reviewing the plans
cannot justify a finding of exceptional circumstances, understand the
need for a larger dining room, they are already over lot coverage,
think there is room in the existing house to reconfigure space for
dining/family room purposes.
Motion was approved on a 4-3 roll call vote, Cers Galligan, Graham
and Mink voting no. Appeal procedures were advised.
