M/NOR MODIFICATION REQUEST FOR SIDE AND REAR SETBACKS
Dear Property Owner,
The Burlingame Planning Division has received an application for Minor Modifications at the following address:
900 CAROLAN AVENUE APN: 026-253-090
Application for two first floor additions that total 250, a 195 SF first floor addition at the right side
(facing Larkspur Drive) and a 55 SF addition at the rear of the existing house located at 900
Carolan Avenue, zoned R-1. A Minor Modification has been requested to encroach into the right
setback by 1 foot, to a 6'-6" setback where a 7'-6" setback is required (for a new wall
encroachment of 5'-0" in length). A second Minor Modification has been requested to encroach
into the rear setback by 3 feet, to a 12'-0" setback where a 15'-0" setback is required (for a new
wall encroachment of 21'-6" in length). All other zoning requirements have been met.
Your property is located within 100 feet of this property. The Minor Modifications have been requested to allow for
additions that will encroach into the required side setback by 1 foot and to encroach into the required rear setback
by 3 feet based on Municipal Code Sections 25.55.010 (a)(4) and 25.55.010 (a)(5). Any noticed property owner
may call this item up for review. If you would like to request that this project be reviewed, which includes a
public hearing, you should submit a written request to the Community Development Director within seven
days of the postmark on this letter (by December 27, 2018). Unless review of the application is requested, the
Minor Modification shall be approved based upon the following findings:
that the location of the proposed 55 SF first floor addition is at the rear of the existing residence so that it
will not alter the character of the neighborhood and will not have a detrimental impact on the character of
the adjacent properties; the existing rear setback exceeds the required minimum and the addition that is
proposed to encroach into the required setback will be screened from the neighboring property by two
new landscape trees;
2. that the width of this corner property increases from the front to the rear of the property, which makes it
difficult to maintain the required exterior side setback along the length of the right side of the dwelling; and
that the majority of the walls along the right side of the existing residence exceed the minimum required
setback;
3. that the proposed addition complies with floor area ratio, lieight, and all other development requirements
and therefore is compatible with the aesthetics, mass and character of the property and of adjacent
properties and the neighborhood; and
4. that the construction will meet the requirements of the California Building and Fire Codes, 2016 Edition as
amended by the City of Burlingame, and therefore will not be detrimental to public health, safety, or
welfare.
