REVIEW OF SPECIAL PERMIT FOR INSTALLATION OF A SATELLITE
5"BE`T: DISH ANTENNA AT 1080 CAROLAN AVENUE, ZONED R-4
RECOMMENDATION;
City Council hold a public hearing and take action.
Conditions recommended by the Planning Commission:
l. that the 9' diameter satellite dish antenna shall be installed at
the location identified in the plans submitted to the Planning
Department and date stamped September 30, 1986;
2. that the maximum height of the dish a installed shall not exceed
6' above the existing grade and the antenna shall be fixed at a
maximum height of 6';
3. that the dish shall be painted or finished in a dark color (green
or black?, be nonreflective and the nonreflective surface shall be
maintained by the property owner;
4. that the dish shall be enclosed with a 6' maximum wooden fence with
a locked gate;
5. that the city shall be notified in the event of the future removal
of this dish and the property owner shall be responsible for
removing any concrete slab, replacing any excavated area and
replacing the removed and disturbed landscaping; and
6. that this use permit shall be reviewed for compliance with its
conditions in 18 months time.
Action Alternatives:
1. The City Council may uphold the Planning Commission and grant the.
special permit for a dish antenna with conditions. This action
should be taken by resolution.
2. The City Council may reverse the Planning Commission and deny or
modify the applicant's request for a dish antenna. Council should
state clearly the reasons for denial or modification of the
request. Modification action should be taken by resolution and
conditions appropriately adjusted.
.
-2-
3. City Council may deny the request for a dish antenna without
prejudice. Should Council take this alternative they should give
the applicant, Planning Commission and city staff clear direction
as to what changes to the project they would consider in
reapplication.
BACKGROUND;
Ed Reece ofPremier Channel, representing Northpark Apartments, is
requesting a special permit to install a 9' diameter dish antenna with
a height not to exceed 6' above grade in a landscaped area enclosed by
Buildings 7, 8, 9 and 10 (1075 Rollins Road, 1055 Rollins Road, 1060
Carolan Avenue, 1050 Carolan Avenue) at the Northpark apartment
complex, zoned R-4. A special permit is required of all dish antennas
in residential zoning districts (Code Sec. 18.18.020-1). This same
code section limits antenna heights to a maximum of 6' from grade in
residential zones. Other criteria of the code are that the antenna
shall be installed at a location which has the least aesthetic effect
on surrounding properties and shall be installed in the rear yard.
Because Northpark Apartments' development consists of a collection of
buildings, rear yard in this case is a matter of judgment. Our code
defines rear yard as a"yard extending across the width of the lot and
measuring between the rear line of the lot and the rear line of the
main building" (Code Sec. 25.08.690). From the site plan submitted it
appears that the rear yard of these individual buildings is the side
opposite the parking lot or main entrance. The dish is proposed to be
located in these combined rear yard areas. However, the rear yard of
the entire Northpark site would be the area opposite the shorter street
frontage (Cadillac Way). An antenna placed in the rear yard of the
entire site would be clearly visible from Carolan.
In reviewing this application the Commission added the requirement that
the dish antenna site be enclosed with a 6' wooden fence with a
lockable gate.
Planninq Commission Action
At their meeting on November 10,. 1986 the Planning Commission held a
public hearing and voted 6-1 (Commissioner S. Graham dissenting) to
approve with conditions the special permit for a 9' diameter dish
antenna which would rise no more than 6' above established grade in the
rear area of Buildings 1055 Rollins, 1050 Carolan, 1060 Carolan and
1075 Rollins and that the dish would be enclosed by a 6' solid wooden
fence (Planning Commission Minutes, November 10, 1986). In their
discussion the Commission expressed concern that the dish height/angle
be fixed at a maximum of 6' above ground level; enclosing the dish with
a fence to protect children from potential safety hazards; encroachment
on required landscaping; the screening value of the existing trees;
role of the Commission under the new ordinance; impact of the proposed
dish on the views from the 27 adjacent apartments and the importance of
that view to the tenants; the fact that there are 510 apartments in the
complex; and the fact that the impact is reduced by the 6' maximum
height.

MINUTES - The minutes of the October 27, 1986 meeting were approved
un3nimously.
AGENDA - Items #1 and #8 - changes in the applications to be explained
by the CP in her presentation; Item #3 - continued at the
request of the applicant; Item #4 - a public hearing will
be held. Order of the agenda approved.
ITEMS FOR ACTION
1. SPECIAL PERMIT TO ALLOW INSTALLATION OF A STELLITE DISH ANTENNA
AT 1080 CAROLAN AVENUE, ZONED R-4
Reference staff report, 11/10/86, with attachments. CP Monroe reviewed
details of the request, code requirements, staff review, Planning staff
comment, applicant's letter, study meeting questions. CP stated
applicant has revised the application to request a 9' diameter dish
antenna which will be angled so it will not exceed a 6' height from
grade. Four conditions were suggested for consideration at the public
hearing.
Commission discussed adding to the conditions that the antenna be fixed
at a maximum height of 6', landscaping requirements, are there children
living in the complex, enclosing the antenna with a fence, Commission's
function under the antenna ordinance (definition of rear yard and a
determination that the proposed location would have the least aesthetic
effect upon surrounding properties).
Chm. Giomi opened the public hearing. Ed Reece, Premier Channel,
821 Malcolm Road addressed Commission: there will be a fence around the
installation, type of fence (minimum height 4', possibly 6') will be
determined by the property owner; existing landscaping will not be
removed, only a small amount of grass; there are two trees which will
be used to screen the dish from view; regarding safety, voltage is not
enough t harm someone. He wished to clarify the CBI's requirement

for engineerng calculations and commented that the ordinance states
engineering alculations are needed only in certain instances, none of
which relate to this installation. He did not feel this proposal would
require a str3ctural engineer's report and replied to the CE's question
that windloadg would be very minimal particularly s'Fnce the
installation wuld be almost hidden by the fence. 'lternative
locations (par 'ng lot, around swimming pool or re 'reation building)
were reviewed, his location seemed best aesthet' ally and with the
least interferen e; antenna will be painted a f t dark forest green
and will be nonr flective. He confirmed his u derstanding of the 6'
height limit, a 9 diameter dish at a 45 degr e angle will meet code
requirements.
There were no audie ce comments and the pulic hearing was closed. A
Commissioner wished to question a represtative of the property owner.
The Chair allowed An` Slider, representaive of complex management
company, 1080 Carolan',venue to respond`. She confirmed rents for
apartment buildings fa ing garden are`s are higher than for those
facing the parking lot, people in th'complex are asking for Cable TV
and she believed regula cable can be received at this location; there
are 510 apartments in th complex.
;f
Commission comment: from a thoro'gh site inspection this location seems
to be the least obtrusive ea,,r°it is as near to being a rear yard as
possible without putting th atenna in the parking area; it will be
located where surrounding pr erties cannot see it; tenants have not
objected and it will be a bei fit to them.
C. Schwalm moved for appro, ial o the special permit and for adoption of
Commission Resolution Appoving ecial Permits with the following
conditions: (1) that th:'9' diame er satellite dish antenna shall be
installed at the locatin identifi in the plans submitted to the
Planning Department and date stampe September 30, 1985; (2) that the
maximum height of the'dish as install d shall not exceed 6' above the
existing grade and tfie antenna shall b fixed at a maximum height of
6'; (3) that the d.'sh shall be painted r finished in a dark color
(green or black),;rfe nonreflective and t e nonreflective surface shall
be maintained byhe property owner; (4) at the dish shall be
enclosed with a:-' maximum wooden fence wi a locked gate; (5) that
the city shall:be notified in the event of t e future removal of this
dish and the g:`roperty owner shall be responsi e for removing any
concrete slab;; replacing any excavated area an replacing the removed
and disturbed landscaping; and (6) that this use ermit shall be
reviewed fo,r compliance with its conditions in 18 onths time. Second

Comment n the motion: even if the proposed location w re classified as
rear ya d, tenants consider the parking lot as rear yar of the
buildir4gs, desirability of facing the garden area is to e joy the
landscaping, if it is possible to get Cable TV through con entional
means rather than with a dish it would be more appropriate, 50$ of the

for engineering calculations and commented that the ordinance states
engineering calculations are needed only in certain instances, none of
which relate to this installation. He did not feel this proposal would
require a structural engineer's report and replied to the CE's question
that windloading would be very minimal particularly since the
installation would be almost hidden by the fence. Alternative
locations (parking lot, around swimming pool or recreation building)
were reviewed, this location seemed best aesthetically and with the
least interference; antenna will be painted a flat dark forest green
and will be nonreflective. He confirmed his understanding of the 6'
height limit, a 9' diameter dish at a 45 degree angle will meet code
requirements.
There were no audience comments and the public hearing was closed. A
Commissioner wished to question a representative of the property owner.
The Chair allowed Ann Slider, representative of complex management
company, 1080 Carolan venue to respond. She confirmed rents for
apartment buildings facing garden areas re higher than for those
facing the parking lot; people in the complex are asking for Cable TV
and she believed regular cable can be received at this location; there
are 510 apartments in the complex.
Commission comment: from a thorough site inspection this location seems
to be the least obtrusive area, it is as near to being a rear yard as
possible without putting the antenna in the parking area; it will be
located where surrounding properties cannot see it; tnants have not
objected and it will be a benefit to them.
C. Schwalm moved for approval of the special permit and for adoption of
Commission Resolution Approving Special Permits with the following
conditions: (1) that the 9' diameter satellite dish antenna shall be
installed at the location identified in the plans submitted to the
Planning Department and date stamped September 30, 1985; (2) that the
maximum height of the dish as installed shall not exceed 6' above the
existing grade and the antenna shall be fixed at a maximum height of

the city shall be notified in the event of the future removal of this
dish and the property owner shall be responsible for removing any
concrete slab, replacing any excavated area and replacing the removed
and disturbed landscaping; and (6) that this use permit shall be
reviewed for compliance with its conditions in 18 months time. Second
C. Leahy.
Comment on the motion: even if the proposed location were classified as
rear yard, tenants consider the parking lot as rear yard of the
buildings, desirability of facing the garden area is to enjoy the
landscaping, if it is possible to get Cable TV through conventional
means rather than with a dish it would be more appropriate, 50$ of the
tenants may not have seen a copy of the notice of hearing since those
with automobiles do not use the front door; has anyone approached

Chm. Giomi opened"'^he public hearing. Ivan Hg"''o Villa II, applicant,
stated they agree ti, seven of the conditions,'ut feel the requirement
for a drain to the stet is unnecessary;ie "V" in the pavement
drains off over the si ewalk; they will ing their own water, a five

the use permit from the c''y, all details submitted to the city have
been submitted to Caltra s; applic t is limited to 50 SF at their

public; if flower cutting is done will the garbage can be located by
the stand, is one can enough. In rebuttal applicant advised the area
is fairly wel lighted, they see no reason they will need to add
lighting; flo ers will be precut, what little cutting might e needed
can be handle with their own garbage can; they do not plan,,to have a
radio on site. There were no further audience comments a the public
hearing was cl sed. :
Commission disc ssion/comment: would like to conditi this application
to allow a 50 SF area and change condition #8 to r uire review in
three months rat er than one year. A concern was xpressed about the
nuisance factor o outdoor businesses in downto Burlingame, with
previous outdoor erations there have been norflagrant abuses but it
is a nuisance, emp oyees tend to be less car ul. Such nuisances
include: it is easi r to dump water than tae it away, truck could
arrive earlier and ake up parking space, ome cuttings might be left
due to employees' ca elessness; these ar not serious enough for
revocation of a permi but they are a nsance. Further Commission
comment: have mixed f lings about thi type of business, am in favor
of the free enterprise system but th train depot is an historical
landmark, the city migh be desecra, ng it by putting businesses on
site and it will detract from the pearance of the station.
With the statement Burlin me ca support another flower stand, this is
not a large business and t s gested conditions will regulate it, C.
Jacobs moved for approval o e special permit and for adoption of
Commission Resolution Approv g Special Permits with the following
conditions: (1) that the co tions of the Chief Building Inspector's
September 26, 1986 and Oct er 31, 1986 memos shall be met prior to any
use of any portion of the ite or the sale of flowers; (2> that the
flower stand shall be li ited to an uncovered removable structure 6'
long, 3' wide and 3.5' igh to be placed at the location shown on the
plans submitted to the Planning De artment and date stamped October 30,
1986; (3) that the fl,wer stall sha 1 be operated by one employee from
11:00 A.M. to 6:00 P.M. weekdays and 0:00 A.M, to 6:00 P.M. Saturdays,

Item # 1
MEMO TO: PLANNING COMMISSION
FROM; CITY PLANNER
SUBJECT: SPECIAL PERMIT FOR A DISH ANTENNA AT NORTHPARK
APARTMENTS, 1080 CAROLAN AVENUE, ZONED R-4
Ed Reece of Premier Channel, representing the Northpark partments, is
Crequesting a special permit to install a_ldiameter dish antenna with
m a height of .Kv'in an enclosed landscaped area between buildings 7, 8,
L 9 and 10 (1075 Rollins Road, 1055 Rollins Road, 1060 Carolan Avenue,
5;yp 1050 Carolan Avenue) at the Northpark Apartment complex. A special
pl'JLT' permit is required by Code Sec. 18.18.020-1 for all antennas in
residential zoning districts. The code also establishes a number of
prohibitions on location and height to which the Planning Commission
cannot grant relief. These prohibitions include that the antenna shall
only be installed in the rear yard and that the antenna shall not
exceed 6' in height from ground level. The code points out that the
antenna shall be installed at a location which has the least aesthetic
effect upon surrounding properties (this is a discretionary action).
Staff Review
City staff have reviewed this request. The Fire Marshal (October 10,
1986 memo) had no comments. The City Engineer (October 20, 1986 memo)
notes he has no comments so long as no utility easements will be
affected by the installation. The Chief Building Inspector (October
14, 1986 memo) notes that the installation would require a building
permit with engineering calculations.
Planning staff would note that the code as now written prohibits dish
antenna with a hight in excess of 6', as well as those placed anywhere
but in the rear yard. This antenna as proposed is 9.5' from grade. In
order to be installed at all it would have to be placed in a hole about
3.5' deep so that the top of the dish did not rise more than 6' above
the existing grade. In this case, because this development consists of
a group of buildings, rear yard is a matter of judgment. Our code
(Code 25.08.690) defines rear yard as a"yard extending across the
width of the lot, and measuring between the rear line of the lot and
the rear line of the main building." From the site plan submitted it
appears that the rear yard of a building is the side opposite the
parking lot or main entrance. This d.ish is proposed to be located in
the area which serves as the rear yard for buildings 8, 9 and 10 (1060
Carolan, 1050 Carolan, 1055 Rollins). However the rear yard of the
entire site would be the area opposite the shorter street frontage
(Cadillac Way). This rear yard area is principally open parking area
and a dish antenna placed in this area would very likely be visible
from Carolan and probably take required parking.
Applicant's Letter
In his letter of October l, 1986 Mr. Reece notes that his company,
Premier Channel, has contracted with the company managing Northpark
-2-
to install and maintain a state-of-the-art television system for the
residents of the apartment complex. The only way to do this is to
install a satellite antenna. He notes review of the site by technical
experts found only one location for the antenna where they could get
good quality reception. He notes that when installed the antenna will
not be visible from any streets or right-of-way and will be visible to
a minimum of Northpark residents. The area, he notes, is not being
used by residents for anything.
Study Questions
At their meeting on October 27, 1986 the Planning Commission studied
the antenna request (Planning Commission minutes, October 27, 1986).
The dish antenna at the proposed location will be visible from 27
apartments. A notice of the public hearing on the dish antenna was
posted on the main entrance doors to the five buildings most affected
and on the two closest telephone poles to the area on Carolan Avenue.
In the Planner's memo (October 30, 1986) the proposal is compared to
the requirements and prohibitions of the ordinance regulating antenna
adopted June 2, 1986. Based on this review the proposed project
complies with all the requirements except height - 6' above existing
grade maximum allowed, proposed dish is 9.5'.
Planninq Commission Action
The Planning Commission should hold a public hearing and take action.
In stating the reasons for their action the Commissioners shall
consider and include the facts included in the Planning Commission's
staff report. Affirmative action shall be taken by resolution. The
reasons for any action shall be clearly stated. At the public hearing
the following conditions should be considered:
f
l. that the 2' diameter satellite dish antenna shall be installed at
the location identified in the plans submitted to the Planning
Department and date stamped September 30, 1986;
2. that the maximum height of the dish as installed shall not exceed
six feet (6') above the existing grade;
3. that the dish shall be painted or finished in a dark color (green
or black), be nonreflective and the nonreflective surface shall be
maintained by the property owner; and
4. that the city shall be notified in the event of the future removal
of this dish and the property owner shall be responsible for
removing any concrete slab, replacing any excavated area and
replacing the removed and disturbed landscaping.

Dear Commissioners:
Premier Communications Network, Inc. has contract with
Friedkin-Becker Management Corporation to install and maintain
a state-of-the-art television system for the use of the resients
of the Northpark Aartments. To facilitate this and to provide
a maximum channel selection, it is our intent to install a satllite
receive antenna on the property. After extensive on.-site technir.al
surveys, the only location for this antenna that would result
in usable pictures without extensive filtering (with subsequent
degradation of pictures) has been selected an.d is marked on the
attached site plan. When installed at this location, the an.tenna
will not be visable from any public streets or right-of-ways
and will be visable from a minimum number of Northark tenant
apartments. Further, the area which has been selected is not
currently being used by the tenants for any purpose.
Friedkin-Becker has agreed with us that this is the proper
location and we respectfully request your concurrence so that
we may proceed as quickly as possible towards providing the much
desired satellite programming to the residents of this nroperty.
Thank you,
`r, :...
