Conditions recommended by the Planning Commission: l. that the 9' diameter satellite dish antenna shall be installed at the location identified in the plans submitted to the Planning Department and date stamped September 30, 1986; 2. that the maximum height of the dish a� installed shall not exceed 6' above the existing grade and the antenna shall be fixed at a maximum height of 6'; 3. that the dish shall be painted or finished in a dark color (green or black?, be nonreflective and the nonreflective surface shall be maintained by the property owner; 4. that the dish shall be enclosed with a 6' maximum wooden fence with a locked gate; 5. that the city shall be notified in the event of the future removal of this dish and the property owner shall be responsible for removing any concrete slab, replacing any excavated area and replacing the removed and disturbed landscaping; and 6. that this use permit shall be reviewed for compliance with its conditions in 18 months time. Action Alternatives: 1. The City Council may uphold the Planning Commission and grant the. special permit for a dish antenna with conditions. This action should be taken by resolution. 2. The City Council may reverse the Planning Commission and deny or modify the applicant's request for a dish antenna. Council should state clearly the reasons for denial or modification of the request. Modification action should be taken by resolution and conditions appropriately adjusted. . -2- 3. City Council may deny the request for a dish antenna without prejudice. Should Council take this alternative they should give the applicant, Planning Commission and city staff clear direction as to what changes to the project they would consider in reapplication. BACKGROUND; Ed Reece of�Premier Channel, representing Northpark Apartments, is requesting a special permit to install a 9' diameter dish antenna with a height not to exceed 6' above grade in a landscaped area enclosed by Buildings 7, 8, 9 and 10 (1075 Rollins Road, 1055 Rollins Road, 1060 Carolan Avenue, 1050 Carolan Avenue) at the Northpark apartment complex, zoned R-4. A special permit is required of all dish antennas in residential zoning districts (Code Sec. 18.18.020-1). This same code section limits antenna heights to a maximum of 6' from grade in residential zones. Other criteria of the code are that the antenna shall be installed at a location which has the least aesthetic effect on surrounding properties and shall be installed in the rear yard. Because Northpark Apartments' development consists of a collection of buildings, rear yard in this case is a matter of judgment. Our code defines rear yard as a"yard extending across the width of the lot and measuring between the rear line of the lot and the rear line of the main building" (Code Sec. 25.08.690). From the site plan submitted it appears that the rear yard of these individual buildings is the side opposite the parking lot or main entrance. The dish is proposed to be located in these combined rear yard areas. However, the rear yard of the entire Northpark site would be the area opposite the shorter street frontage (Cadillac Way). An antenna placed in the rear yard of the entire site would be clearly visible from Carolan. In reviewing this application the Commission added the requirement that the dish antenna site be enclosed with a 6' wooden fence with a lockable gate. Planninq Commission Action At their meeting on November 10,. 1986 the Planning Commission held a public hearing and voted 6-1 (Commissioner S. Graham dissenting) to approve with conditions the special permit for a 9' diameter dish antenna which would rise no more than 6' above established grade in the rear area of Buildings 1055 Rollins, 1050 Carolan, 1060 Carolan and 1075 Rollins and that the dish would be enclosed by a 6' solid wooden fence (Planning Commission Minutes, November 10, 1986). In their discussion the Commission expressed concern that the dish height/angle be fixed at a maximum of 6' above ground level; enclosing the dish with a fence to protect children from potential safety hazards; encroachment on required landscaping; the screening value of the existing trees; role of the Commission under the new ordinance; impact of the proposed dish on the views from the 27 adjacent apartments and the importance of that view to the tenants; the fact that there are 510 apartments in the complex; and the fact that the impact is reduced by the 6' maximum height. ♦ -3- The Planning Commission staff report with staff comments and information from the applicant as well as the site plan is attached for Council review. A special p�l'JLT' permit is required by Code Sec. 18.18.020-1 for all antennas in ���residential zoning districts. The code also establishes a number of prohibitions on location and height to which the Planning Commission cannot grant relief. These prohibitions include that the antenna shall only be installed in the rear yard and that the antenna shall not exceed 6' in height from ground level. The code points out that the antenna shall be installed at a location which has the least aesthetic effect upon surrounding properties (this is a discretionary action). Staff Review City staff have reviewed this request. The Fire Marshal (October 10, 1986 memo) had no comments. The City Engineer (October 20, 1986 memo) notes he has no comments so long as no utility easements will be affected by the installation. The Chief Building Inspector (October 14, 1986 memo) notes that the installation would require a building permit with engineering calculations. Planning staff would note that the code as now written prohibits dish antenna with a hight in excess of 6', as well as those placed anywhere but in the rear yard. This antenna as proposed is 9.5' from grade. In order to be installed at all it would have to be placed in a hole about 3.5' deep so that the top of the dish did not rise more than 6' above the existing grade. In this case, because this development consists of a group of buildings, rear yard is a matter of judgment. Our code (Code 25.08.690) defines rear yard as a"yard extending across the width of the lot, and measuring between the rear line of the lot and the rear line of the main building." From the site plan submitted it appears that the rear yard of a building is the side opposite the parking lot or main entrance. This d.ish is proposed to be located in the area which serves as the rear yard for buildings 8, 9 and 10 (1060 Carolan, 1050 Carolan, 1055 Rollins). However the rear yard of the entire site would be the area opposite the shorter street frontage (Cadillac Way). This rear yard area is principally open parking area and a dish antenna placed in this area would very likely be visible from Carolan and probably take required parking. Applicant's Letter In his letter of October l, 1986 Mr. Reece notes that his company, Premier Channel, has contracted with the company managing Northpark -2- to install and maintain a state-of-the-art television system for the residents of the apartment complex. The only way to do this is to install a satellite antenna. He notes review of the site by technical experts found only one location for the antenna where they could get good quality reception. He notes that when installed the antenna will not be visible from any streets or right-of-way and will be visible to a minimum of Northpark residents. The area, he notes, is not being used by residents for anything. Study Questions At their meeting on October 27, 1986 the Planning Commission studied the antenna request (Planning Commission minutes, October 27, 1986). The dish antenna at the proposed location will be visible from 27 apartments. A notice of the public hearing on the dish antenna was posted on the main entrance doors to the five buildings most affected and on the two closest telephone poles to the area on Carolan Avenue. In the Planner's memo (October 30, 1986) the proposal is compared to the requirements and prohibitions of the ordinance regulating antenna adopted June 2, 1986. Based on this review the proposed project complies with all the requirements except height - 6' above existing grade maximum allowed, proposed dish is 9.5'. Planninq Commission Action The Planning Commission should hold a public hearing and take action. In stating the reasons for their action the Commissioners shall consider and include the facts included in the Planning Commission's staff report. Affirmative action shall be taken by resolution. The reasons for any action shall be clearly stated.
